The work covered by this application may not be commenced before issuance of Building Permit. d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a pennit shall be kept on the premises available for inspection throughout the work. e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector issues a Certificate of Occupancy. f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of issuance or has not been completed within 18 months from such date. Thereafter, a new permit shall be required. Box 2492 Sag Harbor, NY 11963 Re: Approval: Site Plan for the Cutchogue/New Suffolk Historical Council Located at 27320 Main Road, on the S/W corner of Main Road and Case's Lane, Cutchogue SCTM#1000-109-5-6.1 Zoning District: R-40 Dear Mr. Studenroth: The Southold Town Planning Board adopted the following resolutions at a meeting held on Monday, January 10, 2011: WHEREAS, this site plan is for the construction of a 660 sq. ft. storage building on a 1.38 acre parcel owned and operated by the Cutchogue/New Suffolk Historical Council located in the R-40 Zoning District on the s/w/c/o Main Road and Case's Lane, Cutchogue; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEQR) (6 NYCRR, Part 617.5 (c) (3) has determined that the proposed action is a Type II Action as it falls within the following description for (6 NYCRR, Part 617.5 (c) (7): "construction or expansion of a primary or accessory/appurtenant, non- residential structure or facility involving less than 4,000 s.f ...... ' and not subject to review under SEQRA; and WHEREAS, pursuant to Southold Town Code §280-133 C, the Planning Board has found that requiring the entire set of site plan application requirements for this site is not necessary for the following reasons: the application is for a storage building on a previously developed site, will not be open to the public, and is small in size relative to the existing structures on site and size of the parcel. Therefore, the Planning Board will require only the following site plan application items: §280-133 A. (1-5), B. The Planning Board has found that this application is eligible for a waiver of parking requirements because there is no need to provide for parking - the storage building is not open to the public, and there is parking existing on site in connection to the over-all use of the site; and WHEREAS, an application for a site plan was submitted on October 8, 2010, including a site plan prepared by John C. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 6, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The property is improved with four framed buildings and a rest room structure as shown on the survey dated 6/4/2010 prepared by John C. Ehlers, LS.. It is used for historical tours and storage of items related to the town's history. BASIS OF APPLICATION: Request for Variance from Special Exception per Code Section 280-13B(15) and Variance from Code Section 280-18 based on an application for building permit and the Building Inspector's July 19, 2010, Notice of Disapproval concerning construction of a new building; #6416 - owners request a Special Exception for Historical Society, #6420 ,- an area variance for a location at less than the code required front yard setback of 50 feet. RELIEF REQUESTED: The applicant proposes to construct a museum exhibiffstorage building at a 16.5 foot setback from the front yard when the code requires a 50 foot setback from a front yard as shown on the survey prepared by John C. Ehlers, L.S. dated June 6, 2010. The applicant also requests a special exception for the structure to be used by a historical society. ADDITIONAL INFORMATION: The Town of Southold Planning Board reviewed the application and in a memorandum dated August 5, 2010, the Planning Board stated no objection to the requested Special Exception, and recommended that the ZBA rely on comments from the Landmarks Commission regarding the proposed area variance for the front yard setback. FIND1NGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 23, 2010, at which time written and oral evidence were presented. Based upon ali testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(l). Granting of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed accessory structure is only 660 sq. fi. and will have the same characteristic design as the other historic structures on this parcel. The subject property has two front yards and the proposed location appears to be set back from Case's Lane at a greater distance than the proposed non-conforming 15 feet because the property line is not near the road bed. 2. Town Law §267-b{3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed structure could be constructed at a conforming setback, however the proposed location is close to an existing paved parking area and another historic structure, which will facilitate the orderly touring of these historic buildings and museums. It is also to the advantage of the applicant to cluster the buildings so as to maintain its open spaces for summer concerts and other outdoor events enjoyed by the residents of the Town of Southold. Finally, the proposed accessory structure needs to be close to the road because it will house an antique truck that will be regularly driven in and out of the building. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial requiring a 33.5 foot or 67% variance from the code required 50 feet. However, the variance requested herein may be considered less substantial when considering the parcel has to two front yards, one along the Main Road where the proposed structure is setback greater than 100 feet and the other (subject setback) along Case's Lane where the proposed structure is approximately 40 feet from the edge of pavement. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The accessory structure is proposed to be located on a relatively flat portion of the site and will be fitted with gutters and leaders for control of roof runoff as per code. 5. Town Law §267-b{3){b)(5). The difficulty has been self-created. The applicant could have proposed the structure in a conforming location without the need of a variance; but due to the location on the property of various historic buildings and the need to preserve open space for outdoor events, the proposed non-conforming best meets the needs of the Society (see 2 above) 6. Town Law 1~267-b. Grant of requested relief and Grant of the Special Exception for use by a Historical Society is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a museum exhibit/storage building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
