' CT' 7 2011 Town Clerk A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex (Capital One Building), First Floor Conference Room, 54375 Main Road, Southold, New York. Present were: Leslie Kanes Weisman, Chairperson/Member Gerard P. Goehringer, Member Ken Schneider, Member George Homing, Member (via video conferencing) Vicki Toth, ZBA Secretary James Dinizio, Member, absent 5:10 P.M. Chairperson Leslie Kanes Weisman called the meeting to order and proceeded with agenda items as follows: STATE ENVIRONMENTAL QUALITY REVIEW: A. New Applications: reviews (pending). DELIBERATIONS~DECISIONS~RESOLUTIONS OR OTHER The Board continued with agenda items, and commenced deliberations on the following applications. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: Approved with Conditions: JOHN and ALEXANDRA KAPETANOS #6499 Page 2 - Minutes Southold Town Zoning Board of Appeals September 15. 2011 - Special Meeting FRANK C. GILBERT #6501 DEBORAH PENNEY #6484 Approved as Applied: WILLIAM L. BOSWELL #6494 CURTIS HORTON #6495 MICHAEL PHILLIPS #6500 MICHAEL GREENLY MARKETING PENSION PLAN #6503 Denied; Grant Alternative Reliefi MICHAEL and SUSAN JEFFRIES #6498 PUBLIC HEARINGS BRIAN GLENN (CV) for WILLIAM BERGRATH #6492 - Request for Variance from Code Sections 280-13 and 280-14, based on an application for building permit to operate a riding academy and keep, breed, raise and train horses, and the Building Inspector's February 14, 2011, Updated June 28, 2011, Notice of Disapproval stating that the proposed use on this parcel in the AC zone is not permitted and exceeds the code permitted number of uses per the Bulk schedule; located at: 1375 Ackerly Pond Lane Southold, NY. SCTM#1000-69-5-7.1 Resolution Adopted: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to close the hearing reserving decision. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Dinizio was absent. BRIAN GLENN (CV) for WILLIAM BERGRATH #6493 - Request for Special Exception under Article III, Section 280-13B(I 2) for equestrian stables and riding academy, located at: 1375 Ackerly Pond Lane Southold, NY. SCTM#1000-69-5-7.1 Resolution Adopted: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to close the hearing reserving decision. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Dinizio was absent. RESOLUTIONS/UPDATED REVIEWS/OTHER: A. Resolution Adopted: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to authorize advertising of hearings for Regular Meeting to be held October 6, 2011 which Regular Meeting will commence at 8:30 A.M., Town Meeting Hall, 53095 Main Road, Southold. Vote of the Board: Ayes: All. This Resolution was duly adopted 4-0. Member Dinizio was absent. B. Resolution Adopted: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to approve minutes from September 1, 2011 Regular Meeting. Resolution Not Adopted: Chairperson Weisman, explained the request by Thomas McDermott in a letter dated September 14, 2011, to re-open the hearing of Penney #6484, Chairperson Weisman then asked if any Board Member would like to make a motion to consider the request; No motion was offered by Board Members, as such, the request is denied. D. Resolution Adopted: Motion was offered by Chairperson Weisman, seconded by Member Goehringer, to adopt as Board policy Time Limits on Submission of Information Requested by the Board of Appeals. Draft 4, Sept. 12, 2011. Vote of the Board: Ayes: All. This Resolution was duly adopted 4-0. Member Dinizio was absent. WORK SESSION A. Discussion: re: Time Limits on Submission of Information requested by the Zoning Board of Appeals. There being no other business properly coming before the Board at this time, Chairperson Weisman declared the meeting adjourned. The meeting adjourned at 6:48 P.M.
