Whereas, a certain execution was issued oul of the Supreme CourL County of New York, Slate of
New York on the eighth day of August of 2006, on a judgment rendered in an action between
Chester Kutschcr, Plaintiffand Theodore Diachun, as defendant on the eighth day of August, 2006,
in favor of said plaintiff and against said defendant, for the sum of Forty seven thousand, tv~.o hundred

of the Supreme Court, County of Suffolk, which said judgment was docketed in the offitc' of~c Clerk.

Whereas, said execution was directed and delivered to the Sheriffof the County of Suffolk commanding
him to satisfy said judgment out of the real property belonging to the judgment debtor Theodore Diaehun,
on the day when said judgment was so docketed in said County of Suffolk, or any time thereaRer.
Whereas, under the term of the execution, the interest of the judgment debtor of, in and to the premises
hereinafter conveyed and described was subject to the lien of said judgment when the execution was
delivered to the Sheriff.
Whereas, the said Sheriff in obedience to the command of said execution duly sold at public auction
on the 22''d day of July 20 ! 1, all the estate, right, title and interest whivh on thc eighth day of
August, 2006, the judgment debtor had of, in and to said premises. The public au~._i, on was held in
the audilorium of the Suffolk County Office Building, 360 Yaphank Avenue, Yaphank, New York, in
the said County of Suffolk, having first given public notice of the time and place of such sale, by
advertising, serving and posting the same according to law, at which sale the said premises were struck
offto: CAPITAL ASSET RETIREMENT FUND LLC, for the sum of seventy three thousand dollars
and 00/100 ($73,000.00) he being the highest bidder and that being the highest sum bidden for the same.
Whereupon, the Sheriffof Suffolk County after receiving from the said purchaser the said sum of money
so bidden as aforesaid, gave to said CAPITAL ASSET RETIREMENT FUND LLC, the proofs of publication,
service and posting of thc notice of said sale as directed by the law be given.
Now This Indenture Wi~nesseth, That thc said party of the first part, by virtue oftbe said execution, and
in pursuance of the act in such case made and provided, and in consideration of the sum of money so
bidden as aforesaid, to him duly paid, hath sold and by those presents doth, grant and convey unto the said
party of the second part, all the estate, right, title and interest which the said defendant THEODORE
DIACHUN, had on the eighth day of August, 2006, or any time afterward, of, in and to all that cerlain plot,
piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at
Laurel, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a monument on the northerly line of Peconic Bay Boulevard al the southwesterly comer
of land now or formerly of Robinson and the southeasterly of the land herein described and from said
point of beginning running along said northerly line of Peeonic Bay Boulevard South 51 degrees 30'00"
West, 110.61 feet to a monument and land now or formerly of Oakes; thence along said land of Oakes,
being also along the westerly line of a 50 foot right of way, North 26 degrees 09'30' West 200.0 feet to a
monument; thence continuing along said land of Oakes, South 51 degrees 30' Wes190.0 feet; thence
along land now or formerly of Harry Young, two courses as follows: (I)North 26 degrees 09'30" West
173.30 feet and (2) South 33 degrees 11' West 100 feet more or less to Brushes Creek; thence northerly
along said Brushes Creek 1150 feet more or less to land about ~o be Conveyed to Leo Diachun; thence
along said land about to be conveyed to Leo Diachun North 69 Degrees 59' 40" East 605 feet more or
less lo land of Wilcenski; thence along said land of Wi lcenski and along now or formerly of Robinson
South 20 degrees 14' 40" East 1356 feet more or less to the point or place ofbegirming, containing about
11 acres according to a survey of Otto W. Van Tuyl & Son, revised September 5, 1962. Subject to a 50
foot right of way across the westerly portion of the premises above described. Together with all the right,
title and interest in and to the land lying under water in brushes creek. Address: 2445 Peconic Bay Bohlevard;

To Have and to Hold the said above mentioned and conveyed premises unto the ~aid party of the second
part, and assigns of the party of the see. oM part, their heirs or successors, as fully and absolutely as the said
party of the first part, as Sheriffas aforesaid, can or ought to sell and convey the same by virtue of thc said
execution and Iht law ~elating thereto. Thc word "party" shall be construed as if it reads "parties" whenever
the sense of this indenture so requires.
