Dear Mr. Schwartz:
The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft
Corwin III, last dated May 16, 2011, and received on July 18, 2011, and determined that
the proposed demolition of the existing house and detached garage and build a new
house with detached garage, is out of the Wetland jurisdiction under Chapter 275 of the
Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.

Evan Giniger, Owner, would like to obtain permits for the work described in the attached Site Plan.
The Southold Building Depaxtment has stated that they do not require a permit from your office,
however, I would like to obtain a letter of non-jurisdiction for this project. We are proposing to
demolish the existing house and detached garage and build a new house with detached garage as
shown on the survey. The proposed construction is over 140 feet from the landwards limits of
wetlands line. Please review the attached survey and call this office if you have questions or need any
