SEA DRIVE, SOUTHOLD SCTM# 1000-54-4-24 Dear Mr. Betsch: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, March 15, 2023: WHEREAS, on January 17, 2023 an application for an Administrative Amendment was submitted requesting to increase length of post rail fence, seaward of the existing; and WHEREAS, on February 15, 2023, a Member of the Board of Trustees inspected said property for the proposed modification; and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, WHEREAS, the Board has considered all of the documentation submitted concerning this application; and, WHEREAS, the Board has previously granted approval for the installation of a post and rail fence and one 12"x12" or smaller sign along eastern property line, no closer than 60' seaward of concrete monument by Administrative Permit#7598A; and WHEREAS, the Board of Trustees determined that the fence is located in a Duneal area and would have a negative impact on the dune; and therefore there is no need to extend fence any further seaward than existing; and there is no justification for altering the prior actions of the Board; and 2 THEREFORE BE IT RESOLVED, that the Southold Town Board of Trustees DENY the Administrative Amendment to Administrative Permit#7598A for one (1) additional 10' section of two-rung-post-rail fence, seaward of the existing, resulting in_34 feet of fence _. in total. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. Metes & Bounds and MHW Deeding Definition 6. New York State Definition of MHW(275-2: definitions) On 2/26, Trustee Peeples called to discuss the Board's rationale in tabling my amendment request. She stated it was felt that the requested fence section would not be on the applicant's property. (assuming based on the submitted survey.) I tried to explain that waterfront property can be deeded by "metes and bounds" or by MHW. It has been explained to me that if MHW is used, it is common practice of surveyors to note approximate "more or less" boundaries on a printed survey and not the MHW mark based upon the NYS definition of MHW. On 2/27, 1 met with the Richard Caggiano, the assigned town assessor for Block 54 as well as Kevin Webster, chairman of the Board of Assessors Office.. As a result of that meeting, I am attaching three example extracts from recorded deeds (ATTACHMENT 1-a,b c,) of MHW deeding on North Sea Drive including my property noting ownership to MHW. I am also including pictures (ATTACHMENT 2-a, b, c) measuring from the end of the existing fence to the normal rack line and (ATTACHMENT 3) picture of the measurement during the 2/28 snow event. I believe this information appropriately documents ownership as well as an appropriate determination of the typical MHW. The requested amendment still falls well within the Trustee requirement of 275-11A (4)(c). Town Wetlands and Shoreline Code 275-11A (4) - (A,C) Background: The above referenced permit was initially submitted as a result of the Department of Public Works determination they would no longer install snow fence separation on the east/west sides of McCabe's Town Beach with "End of Public Area" signage as they had done for many years, and that it was now the responsibility of each adjacent homeowner to do so if wanted. A two-rung post/rail fence was installed per permit requirements of 7598A, fifty-nine (59) feet seaward of an existing concrete property monument. Since that installation in 2013, this applicable beach area has significantly accreted both in depth and breadth/width. It is my belief that this accretion is due to the failing nature of the Goldsmith Inlet Jetty permitting significant more littoral flow. The applicable beach has accreted so much that the bottom rail of the original approved/installed post/rail fence became completely buried with the original top rail barely visible, necessitating installation of"sister" posts with a new rail installed above the existing one to prevent people from injuring themselves on the buried fence. That "original" middle rail is now about to also become buried due to continued beach accretion. (Pictures attached) I am now requesting an amendment to Permit 7598A for one (1) additional section of two-rung post rail fence seaward of the existing fence. The result would make the final fence approximately thirty-four(34)feet landward of the most recent measured winter rack line which I believe is also considerably landward than the Chapter 275 defined MHW and also in compliance with the Trustee interpretation of 275-11A (4) (C). Trustees reserve the right to permit erection of a fence where the applicant has shown that there is a need to protect his/her private property. In these rare cases, only split-rail fences are allowed on beaches and wetlands. Such fences shall be perpendicular to the waterline and not closer than 10 feet to MHW. Only one posted sign per 1001inear feet offence is allowed. Posted signs shall be no larger than 12 inches by 12 inches square. I was told a permit is needed for a sign noted above I was also told by one of the Trustees doing a site inspection,a permit is NOT required have been told that the Supervisor has stated at a civic group meeting,a permit is NOT needed. I have had numerous people ask me what is correct. In your letter you request clarification of the condition put on your pending approved administrative permit requesting a post/rail fence and signage on your property line bordering the town's beach. While we acknowledge that our code 275 states that a fence, when permitted, is to be split-rail and to be perpendicular to the waterline and not closer than 10 ft. to MHW, it does not preclude the Trustees from requiring a fence to be more than 10 ft. from MHW. The code, in fact, begins with the statement, "Trustees reserve the right to permit erection of a fence where the applicant has shown that there is a need to protect his/her private property." By the Code addressing the Trustee's right to permit something, it is implicit that the Trustees also have the right to deny also. That being said, without the need to be written into the code, the Trustees reserve the right not to permit erection of a fence. Therefore, the Trustees can approve a fence up to 10 from MHW, no fence at all, or any length in between. In your particular case, as I recall, during the field inspection, which was the fact gathering inspection upon which the particulars were used to make the final determination at our regular meeting held July 20, 2011, you stated that you were not planning on installing a fence but were taking up a suggestion that you request a fence along with the application for a sign. At that point the Trustees found a concrete monument to use as a reference point and measured out various lengths using the apparent high water mark, our only true mark that is useful on a field inspection. After discussion, which you were involved with, it was suggested that 60 feet from the monument seemed reasonable enough to accomplish what your goal would be should you decide, after all, to install the fence. That was reiterated at the meeting on July 20t', 2011 and the application was approved pending revised plans showing the fence to be located no more that 60 ft. seaward of the concrete monument. • z • Should you decide that when you put up the fence, that you would like to extend it further than currently allowed by this permit, you are welcomed to apply for an amendment. BACKGROUND: Inquiring about the "End of Public Area" signs normally installed each year by DPW at the outward boundaries of town beaches, I was originally told "they are on order" and subsequently that they would no longer be provided by the Town and that it is now the owner's responsibility. It was explained that a permit for a similar sign would be required. Upon inquiring about necessary paperwork, it was suggested that it would be prudent to include a request for a post/rail fence in that same application (so it would be in hand.) I did so but knowing in my mind that I was not planning on installing a fence at this time. During the field inspection, I was told by a Trustee that a permit is NOT required for posting a sign. But, ss I had already submitted all the paperwork/fees, I continued the process. CLARIFICATON REQUEST: Reference (2) above states: "Fence to be located no more than 60' seaward of the concrete monument." Town Wetlands and Shoreline Code 275-11A.(4) states "... Such fence shall be perpendicular to the waterline and not closer than 10 feet to MHW." From measurements taken on July 18th (at exactly high tide) in preparation for the July 20th Trustee Meeting, this 60' requirement is considerably more stringent than is required by Town Code. Why? A documentation photograph submitted with this letter, with verifiable camera time, along with High Tide Tables for July 18th- shows much different debris lines, and these debris lines include past storms etc- not the MHW as mentioned in Chapter 275. 1 would appreciate review and explanation of this "60ft" measurement prior to my further action.
