party of the first part, and

WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL'that certain plot, piece or pamel of land, with the buildings and improvements thereon
erected, situate, lying and being north of the Village of Greenport, Town of Southold, County of
Suffolk and State of New York, being more particularly bounded and described as follows:
BEGINNING at a monument at the intersection of the northerly side of North Road with the
westerly side of Sound Road and from said point of beginning;
RUNNING THENCE along said northerly side of North Road, South 74 degrees 39 minutes 30
seconds West, 200.00 feet to a monument and land of Krzyminski;
THENCE along said land of Krzyminski, North 27 degrees 29 minutes 00 seconds West, 109.98
feet to a monument;
THENCE along land of Krzyminski and along land of Brandi, North 63 degrees 23 minutes 00
seconds East, 97.77 to a monument;
THENCE along said land of Brandi, the following two courses:
1. South 27 degrees 29 minutes 0O seconds East, 29.53 feet to a monument;
2. North 74 degrees 39 minules 30 seconds East, 100.00 feet to a monument on the westerly
side of Sound Road;
THENCE along said westerly side of Sound Road, South 27 degrees 29 minutes 00 seconds East,
100.00 feet to the point or place of BEGINNING.
'BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated May 29, 2001, and recorded June 28, 2001, in the Office of the Suffolk County Clerk
in Liber 12126, Page 886.
TOGETHER with all right, title and interest, if any, of the party of' the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOOETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pan, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying tlie cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as ifil read "parties" whenever the sense of this indenture so
requires.
