paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,

State of New York, known and designated as Lots numbered 21 and 22
on a certain map entitled, "Map showing Subdivision of Property
A/95 lee, I known as Summer Haven, belonging to William G. Herx, near Southold,
Suffolk County New York" filed in the Suffolk County Clerk' s office

BEGINNING at a point on the southwesterly side of Bayview Avenue
where the division line between lots 20 and 21 intersect said
southwesterly side of Bayview Avenue as shown on the above trap;
vU RUNNING THENCE South 52 degrees 30 minutes 00 seconds west along
last mentioned division line 230.00 feet more or less to the
ordinary high water mark of Arshamomoque Harbor;
THENCE northwesterly along said high water mark, 50.00
feet more or less to the division line between lots 22 and 23
on the above map;
THENCE Norte 52 degrees 30 minutes 00 seconds east along the last
mentioned division line 223.00 feet more or less to the south-
westerly side of Bayview Avenue;

southwesterly side of Bayview Avenue 50.00 feet to the point
or place of BEGINNING.
BEING and intended to be the same premises conveyed to the
party of the first part by deed dated 2/27/85, recorded 3/7/85
in Liber 9748, Page 231.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
d AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
he same first to the payment of the cost of the improvement before using any part of the total of the same for
y other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture 5o requires.
