2. Final Approval from Health Dept. of water supply and sewerage-disposal (S_9 form).
3. Approval ofelech"ical installation from Board 0fFire Underwriters.
4. Sworn statement from plumber certifying thai the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, indtmtrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer re.~ponsible for the building.
6, Submit Planning Board Approval &completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming useS, or buildings and "pre-existing" land uses:

a. This application MUST be completely filled in by typewriter or in ip& and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

DESCRIPTION: This property is located in an R-40 Residential Zone
District, being situate on the northeasterly side of Bay Shore Road
wi~h I00 ft. water frontage and 100 ft. road frontage. This lot
contains a total area of 24,000 sq. ft. and is improved with a
single-family, one-story frame house and accessory shed in the front
yard area, all as shown on the survey map prepared by Anthony
Lewandowski, L.S. dated June 24, 1995.
BASIS OF APPEAL: Building Inspector's Action of Disapprovnl dated
March 18, 1997, under Article III, Section t00-33C for permission to
construct an accessory garage in the front yard at less than the
required 40 feet for a parcel containing 24,000 sq. ft. in area.
AREA VARIANCE RELIEF RE(~UESTED BY APPLICANT: To locate an
24 ft. by 24 ft. accessory garage at a distance of 20 feet from the
front yard property llne at its closest point {and wkieh location is
shown behind the existing shed to be removed, which is at nine '(9')
feet from the front property Iine.]
REASONS FOR BOARD ACTION~ DESCRIBED BELOW:
(1) The granting of the area variance will produce an undesirable
change in character of neighborhood or a detriment to nearby
properties because it would be built too close to the road.
(2) The benefit sought by the applicant can be achieved by some
method~ feasible for applicant to pursue, other than an area variance
by locating the proposed garage at a greater setback distance.
(3) The requested area variance is substantial from the setback
requirement of 40 feet provided by Sections 100-33C and 100-244B
for a waterfront parcel consisting of 24,000 square feet in size.

The Department of Environmental Conservation has completed its review of your recent request to
modify the referenced Tidal Wetlands permit to authorize the installation of two drywells as part of the
approved project to remove an existing house and construct a new single family dwelling with septic
system and driveway.
We have determined, pursuant to the Uniform Procedures Regulations and the Tidal Wetlands Land Use
Regulations, that the permit may be modified. Accordingly, the permit is hereby modified to authorize
the removal of an existing house, the construction of a new single family dwelling with decking, septic
system, driveway and two drywells as shown on the attached survey by Robert H. Fox, L.S. dated
January 12, 2006, last revised June 19, 2007 and stamped "NYSDEC Approved Modification 8/13/07".

Regulations (6NYCRR Parts 621 and 661 respectively) that the requested changes will not exceed the
scope of the original permit and can, therefore, be approved.
