Guild RR#3 36400 North Road Peconic, NY 11958 Please take notice that your application dated August 9, 2005 For permit to construct a greenhouse at Location of property: 34695 CR #48, Peconic, NY County Tax Map No. 1000 - Section 6~8 Block4 Lot 1~9 Is returned herewith and disapproved on the following grounds: The proposed greenhouse addition, on this 261,444.92 square foot lot in the Agricultural Conservation District, is not permitted pursuant to Article III, Section 100-31, A (2) C., which states, "Barns, storage buildings, greenhouses (including plastic covered) and other related structures, provided that such buildings shall conform to the yard requirements for principal buildings." Bulk Schedule requires a rear yard setback of 75 feet, a single side yard setback of 20 feet, and a total maximum lot coverage of 20 percent. The proposed addition will have a rear yard setback of+/- 56 feet and a total lot coverage of+/- 32 percent. In addition, an expired permit exists on the existing greenhouse (which is the subiect of this addition). That greenhouse was approved with a 20-foot setback, but was located at +/- 19.8 feet. There is no certificate of occupancy on this existing greenhouse, and one will not be granted until a variance is given for that insufficient "as built" setback. In addition, the proposed greenhouse will require approval from the Southold Town Planning Board. The applicant was inadvertently referred to the Planning Department for a permit. I hand delivered a Site Plan Application and Site Plan Application Guide to the applicant. The site plan process was explained in detail and a review of the Planning Departments file occurred. The current file is incomplete and has no preliminary site plan. Mr. Guild was instructed to execute the site plan application, waiver form, fill in the Long Form EAF, create a site plan and submit the agricultural site plan fee to the Planning Department for review. During the meeting the applicant disclosed that the proposed greenhouse was a new separate greenhouse and would be temporary in construction type. The review under the site plan use determination dated 08/16/05 was for a greenhouse addition. The applicant was therefore advised to resubmit the changes to the Building Department. Additionally, the applicant was instructed that the new proposed greenhouse would be considered a permanent property improvement on an approved site plan. GUILD CTM Parcel # 68-4-19 Property Location: 34695 C.R. 48 (a/Ida Middle Road or North Road), Peconic BASIS OF APPLICATION: Request for a Variance under Section 100-31A(2-C), based on the Building Inspector's August 30, 2005 Notice of Disapproval, amended March 1, 2006 concerning commercial agricultural greenhouses in a location at less than 75 feet from the rear lot line, less than 20 feet on a single side yard, and exceeding the code limitation of 20 percent lot coverage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 30, 2006 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: BACKGROUND On April 27, 2006, the applicant testified at a public hearing, seeking a variance on an existing 108' x 324' greenhouse side yard which violates the approved 20-foot setback which detailed an existing 19.9 feet. The applicant further requested to construct a new 108' x 324' greenhouse with a proposed 18' x 132' covered connector addition hand drawn in scale with black magic marker on a survey prepared and certified by Joseph Ingegno dated September 20, 2005. Applicant sought variances for the new proposed greenhouse rear yard setback of 56 feet instead of the code-required 75' and for an increase in lot coverage from 20 percent to 32 percent, based on the applicant's hand drawn site plan. Based on this hand-drawn map with applicant's calculations noted under the first application, the new proposed greenhouse and connector also violated the required 20 foot side yard setback by detailing a 19.9' setback, proposed along a continuous line with the existing greenhouse along the southeast boundary of the subject property. Based on this information and estimated calculations, the Board of Appeals, at it Special Meeting of May 11, 2006 granted the variances for the side yard setbacks, as applied for, denied the variance for a rear yard setback, and granted alternative relief for a maximum lot coverage of 30 percent. Page 2 - December 14, 2006 ZBA File No. 5866 - Jay Guild CTM 68-4-19 The owner applicant, dissatisfied with the relief granted, wrote to the NYS Department of Agriculture and Markets. The Board of Appeals at its November 9, 2006 Meeting, voted to rehear the application of ZBA File #5866, and again asked the ownedapplicant to furnish seven (7) prints of an accurate site plan prepared by a surveyor showing all data relative to the applicant's new construction (including but not limited to all setbacks to property lines and lot coverage calculations of both the existing and proposed). This Resolution was prepared in a letter and forwarded to the owner /applican'~.~ St'[~tJ ownedapplicant again contacted NYS Ag and Markets, which agency, through Mr. Simmer, on November 13, 2006 queried "why Mr. Guild had to bear the expense of having seven more copies prepared when the ZBA already has copies in their files... and nothing has changed from his last submittal?" On November 16, 2006 the Southold Town Attorney replied in a letter to Mr. Sommer explaining several reasons, and that Mr. Guild had only fumished an existing survey, altered by him to show his calculations of the proposed location of the buildings and estimated lot coverage, and that the applicant refused to furnish the updated survey previously to the ZBA staff, with the proposed locations and building/lot coverage calculations (without requiring field work and using the same survey)." This irregularity was pointed out by Board Member Weisman at the Public Hearing on April 27, 2006 (see transcript lines 3-23). On November 27, 2006, Mr. Guild, the owner/applicant, submitted the required updated information by his surveyor using the available survey. It is also noted that the surveyor calculations of lot coverage is noted as 28.9% on this updated survey, less than the applicant's previous request. AREA VARIANCE RELIEF REQUESTED: Owner/applicant requests an area variance for a rear yard setback of 56 feet instead of the required 75 feet, as noted on the survey prepared and certified by Joseph A. Ingegno, dated November 22, 2006. The lot coverage REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new greenhouse and connector are located at the rear (north) of the subject property behind the existing greenhouse and the view shed from County Road 48 is protected based upon the proposed location. The surrounding land in this AC Zone is also farmland. The elevation of the subject property is lower than surrounding properties shielding the operations of the greenhouse structures from those propedies. 2. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the relief requested. Applicant states that he wishes to grow hardy crops in the space between the existing and proposed greenhouses, and that the proposed 132' distance between the two structures, which requires a rear yard setback variance, is based upon the need for proper air[Iow within the greenhouses and seasonal changes. However, while the ownedapplicant has stated that the 132' space is desirable, no evidence has been submitted to demonstrate that the 132' space is absolutely necessary to achieve the owner/applicant's objectives of expansion of his business. ,Page 3 - December 14, 2006 ZBA File No. 5866 - Jay Guild CTM 68-4-19 3. The variance granted herein is substantial. The requested variance of 56 feet in the rear yard setback represents approximately 19 feet or 25% more than the code-required minimum of 75 feet. 4. The alleged difficulty has not been self-created. The applicant states that he needs to expand the size of his business operations in order to increase sales to cover the cost of doing business. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. The subject parcel is zoned Agricultural Conservation and a controlled agricultural use in this location is appropriate. 6. Grant of the requested variances are the minimum action necessary and adequate to enable the applicant to enjoy the benefit of expanded commercial-agricultural operations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carried to GRANT the variances as applied for, as shown on the survey updated November 22, 2006, prepared by Joseph Ingegno, Surveyor, and that the applicant follow current recommendations and technologies to minimize leaching of nutrients and pesticides from plant containers under the Suffolk County Agriculture Stewardship Program and Cornell Cooperative Extension's Best Management Practices. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. SCTM#1000-68-4-19; and WHEREAS, Jay W. Guild is the owner of the property located approximately 2,646' e/o Mill Road, on the n/s/o County Road 48, in Peconic; and WHEREAS, on August 30, 2005, the Building Department issued a Notice of Disapproval s abng: The proposed greenhouse will require approval from the Southold Town Planning Board"; and WHEREAS, on September 6, 2005, the applicant/owner, Jay W. Guild, submitted a new formal site plan application for approval; and WHEREAS, on September 12, 2005, the Southold Town Planning Board held a Work Session and accepted the incomplete application; and WHEREAS, on November 28, 2005 and February 28, 2006, the Planning Department issued letters to the applicant stating that the site plan application is on hold pending the receipt of additional information and a revised site plan; and WHEREAS, on March 1, 2006, the Architectural Review Committee reviewed the associated site plan materials and approved the application and the Planning Board accepts this recommendation; and WHEREAS, on March 1, 2006, the Building Department issued an amended Notice of Disapproval indicating variances would be required from the Zoning Board of Appeals in addition to "approval from the Southold Town Planning Board"; and Guild Greenhouse Pa.qe Two Auqust 14, 2007 WHEREAS, on April 25, 2006, the Planning Board responded to the April 3, 2006 memo from the 7BA stating the application is still pending the receipt of revised plans; and WHEREAS, on May 8, 2006, the Planning Board issued an additional letter to the applicant stating that the application is still on hold pending the receipt of a revised site plan requiring the necessary site plan elements/information; and WHEREAS, on May 11, 2006, the Southold Town Zoning Board of Appeals, under Appeal #5866, issued the following decision: GRANT the variances for the side yard setbacks, as applied for. DENY, the variances for the rear yard setback and lot coverage as applied for, and GRANT Alternative Relief for a maximum lot coverage of 30 percent, subject to the following: 1. That no additional structures on the subject parcel be built in the future that would cause this lot coverage to be exceeded; 2. That a maximum 75 ft. rear yard setback be maintained; 3. That the applicant follow current recommendations and technologies to minimize leaching of nutrients and pesticides from plant containers under the Suffolk County Agriculture Stewardship Program and Cornell Cooperative Extension's Best Management Practices; and WHEREAS, on May 12, 2006, Suffolk County Department of Public Works responded, after review, stating: "We have reviewed this development and find that improvements within the County right-of-way in the vicinity of this site are not required. Therefore, a permit from this Department is not necessary"; and WHEREAS, on May 24, 2006, the Planning Department issued a letter to the applicant stating that the application is still on hold pending the receipt of a revised site plan incorporating the requirements of the ZBA Decision (#5866) and necessary site plan elements/information; and WHEREAS, on August 28, 2006, the Planning Department issued another letter to the applicant requesting, in writing, a status of the site plan application and referencing the previously issued letters requesting information; and WHEREAS, on September 20, 2006, the applicant submitted a copy of a letter to the Town from the State of New York Department of Agriculture and Markets regarding ZBA Decision #5866; and WHEREAS, on December 14, 2006, the Southold Town Zoning Board of Appeals granted the "variances as applied for, as shown on the survey up-dated November 22, 2006 prepared by Joseph Ingegno, Surveyor, and that the applicant follow current recommendations and technologies to minimize leaching of nutrients and pesticides from plant containers under the Suffolk County Agriculture Stewardship Program and Cornell Cooperative Extension's Best Management Practices" under ZBA rehearing #5866; and WHEREAS, on January 8, 2007, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5 c (3), made a determination that the proposed action was a Type II and not subject to review; and WHEREAS, on March 7, 2007, Allan Connell of the Natural Resources Conservation Service responded after review with two (2) roof run-off management options to "collect and dispose of the run-off to prevent flooding and reduce or eliminate any potential impact on groundwater" and Guild Greenhouse PaRe Three August 14, 2007 the Planning Board accepted these options and required the applicant to incorporate one (1) of these options into the revised site plan in a letter to the applicant dated April 16, 2007; and WHEREAS, on April 20, 2007, the applicant submitted hand-drawn revised plans with an attached note detailing drainage and the Planning Board accepted this revised plan and referred it to the necessary agencies for comments; and WHEREAS, on May 2, 2007, the Southold Town Board of Trustees responded that the proposed construction is "out of the Wetland Jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111), no permit is required"; and WHEREAS, on May 14, 2007, the Suffolk County Department of Planning responded, after review, and determined this matter is for "local determination as there appears to be no significant county-wide or inter-community impact(s)" and the Planning Board accepts this pursuant to 239L & M General Municipal Law; and WHEREAS, on June 13, 2007, the Southold Town Engineer responded, after review, with four (4) comments and the Planning Board accepted these comments and required that they be incorporated into the revised site plan, specifically, the following comments regarding drainage: Proposed drainage designs have been taken from a report prepared by the U.S. Dept. of Agriculture Natural Resource Conservation Service. This report indicated two alternates for the collection and disposal of run-off generated by the proposed development. From the notes on the drawing, it would appear that the second option was selected by the property owner. This option would include the construction of a drip trench along the northerly edge of each greenhouse that would be 4' deep and 3' wide at the top. This trench would then be filled with #2 stone to stabilize the trench from erosion. The greenhouse gutter system would then be installed with downspouts that would outlet directly into the trench. This proposed drainage design recommend by the Conservation Service is considered satisfactory. The survey/site plan should be revised accordingly. All gravel drain locations should be shown and greenhouse downspout locations should be noted. The perimeter of the existing trench drain along the northerly property line should be adequately shown to confirm the existing drainage capacity; and WHEREAS, on June 13, 2007, the Southold Fire District responded, after review of the site plan, and determined there is adequate fire protection; and WHEREAS, on July 2, 2007, the Planning Department issued a letter to the applicant detailing the remaining site plan items to be included in the site plan, including drainage, and requested that copies of the final site plan, prepared and certified by a design professional, be submitted and the applicant submitted the necessary copies on July 17, 2007; and WHEREAS, on July 23, 2007, the Planning Board, pursuant to Town Code §280-131H, determined that the proposed use is agricultural and considered waiving the public hearing requirement; and WHEREAS, on July 25, 2007, the Southold Town Engineer responded, after review of the revised site plan, stating that the revised site plan is satisfactory; and Guild Greenhouse Paqe Four Auqust14,2007 WHEREAS, on August 10, 2007, the Southold Town Building Inspector reviewed and rec-.f ~nded "The proposed use Greenhouse is a permitted use in this A-C district and is so certified" with a reference to the ZBA appeal #5866; and WHEREAS, the following items shall be required: All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet Town Code requirements. 2. As per the Landscape Survivability Guarantee, the applicant agrees to replace any of the landscaping which dies within three (3) years of planting. The owner, agent and/or applicant understands and agrees that the Southold Town Building Department will review the approved proposed build out under a building permit application and that all construction must meet or exceed the required codes and this site plan approval is subject to change to conform to any requirement of Local & State Regulations as applied during the building permit review. 5. The site plan approval requires that all work proposed on the site plan shall be completed within three (3) years from the date of this resolution.
