RESOLVED, that the Town Board of the Town of Southampton hereby directs that a public
hearing shall be held on Tuesday, October 11, 2011, at 1:00 p.m., at Southampton Town
Hall, 116 Hampton Road, Southampton, New York, to hear any and all persons either for or
against a local law entitled: "A LOCAL LAW amending Town Code Section 330-10, Residence
Districts Table of Use Regulations, Section 330-33, Business Districts Table of Use
Regulations, and Section 330-37, Industrial Districts Table of Use Regulations, to replace
the existing Standard Industrial Code (SIC) classifications with the North American Industry
Classification System (NAICS)," which provides as follows:

A LOCAL LAW amending Town Code Section 330-10, Residence Districts Table of Use
Regulations, Section 330-33, Business Districts Table of Use Regulations, and Section 330-
37, Industrial Districts Table of Use Regulations, to replace the existing Standard Industrial
Code (SIC) classifications with the North American Industry Classification System (NAICS).
BE IT ENACTED by the Town Board of the Town of Southampton as follows:
SECTTON 1. Legislative intent.
Currently, Southampton Town uses the Standard Industrial Code, or SIC, to identify, detail,
and expand upon the various uses permitted, prohibited, or allowed by special exception,
within the Town. The SIC Code was created in the 1930s and today, the Town's Table of
Uses for Residential, Business, and Industrial Districts, is based upon a 1970 edition of the
SIC.
In April of 1997, the North American Industry Classification System (NAICS) replaced the
SIC, identifying almost 100% more business sectors than the SIC system, and recognizing
over 30% more industries. In addition, new service industries have been added, and the
system that further describes businesses has been expanded from four (4) digits to six (6)
digits.
Pursuant to the 1999 Comprehensive Plan Update, and the recommendations therein, the
purpose of this Code amendment is to update the current Zoning Code of the Town of
Southampton by replacing the Standard Industrial Code (SIC), used in its Table of Use
Regulations for Residence, Business and Industrial Districts, with the North American

Tndustry Classification System (NATCS). The Department of Land Management, as well as
the Town Board and the Planning Board, support the application of the most updated tools
for the review, delineation, and classification of uses. Tn short, the NATCS is a more specific
and accurate tool for reviewing proposed projects and their related uses. Thus, this
amendment seeks to convert the relevant Use Tables from the current STC numbering and
nomenclature, to the current 2007 NATCS numbering and nomenclature, and does not seek
to amend the uses regulated within each zoning district for any other purpose, other than
incidental changes, errors, or omissions that may have been discovered in the conversion
process.
SECTION 2. Amendment.
The use tables associated with Town Code Sections 330-10, 330-33, and 330-37 are being
replaced in their entirety by deleting the existing tables, which reflect STC classifications,
and replacing them with new tables, which reflect NATCS classifications, as follows:

The proposed local law is enacted pursuant to Town Law Article 16 and Municipal Home Rule
Law §§10(1)(ii)(a)(11) and (12) and §10(1)(ii)(d)(3).
SECTION 4. Severability.
Tf any section or subsection, paragraph, clause, phrase or provision of this law shall be
adjudged invalid or held unconstitutional by any court of competent jurisdiction, any
judgment made thereby shall not affect the validity of this law as a whole or any part
thereof other than the part or provisions so adjudged to be invalid or unconstitutional.
SECTION 5. Effective Date.
This local law shall take effect upon filing with the Secretary of State.
AND BE TT FURTHER RESOLVED, that the Town Clerk is hereby directed to forward a copy of
the proposed law to the Southampton Town Planning Board as well as the Suffolk County
Planning Commission for their review and recommendations; and be it further

persons either for or against a proposed local law entitled, "A LOCAL LAW to amend the
Southampton Town Agricultural Overlay District to include properties identified by Suffolk
County Tax Map Numbers 900-100-1-13.1, 13.2, 13.3 and 13.4/' which provides as follows:

properties identified by Suffolk County Tax Map Numbers 900-100-1-13.1, 13.2, 13.3 and

BE [T ENACTED by the Town Board of the Town of Southampton as follows:
SECTTON 1. Legislative Tntent.
Currently, the Agricultural Overlay District includes land areas characterized by the
Bridgehampton and Haven Soil Associations, which are among the most productive soils in
New York State and constitute a highly significant agricultural and economic resource in
both the Town of Southampton and the state.
The four properties intended for inclusion by this in the Agricultural Overlay District are land
areas characterized by the Bridgehampton Haven Soil Association. They have been
continuously farmed for approximately 60 years and are contiguous to the Agricultural
Overlay District to the east and south across Edge of Woods Road.
The total area of these four tax lots is approximately 12.3 acres of which approximately 6.3
acres are cultivated and approximately 1.3 acres are utilized as support land with farm
buildings and outdoor storage. The total farmland acreage therefore is approximately 7.6
acres.
Tn addition, these areas provide the open rural land use environment so highly valued by
those persons who support the Town of Southampton's recreational and resort economy, as
well as by year-round residents. Therefore pursuant to the Town's well established public
policy, this amendment seeks to designate these parcels as part of the Agricultural Overlay
District in order to encourage and make economically feasible the preservation of these
lands for agricultural purposes.

Pursuant to Chapter 330 of the Town Code (Zoning Map), the boundary of the Agricultural
Overlay District is amended to incorporate four (4) parcels designated as Suffolk County Tax
Map Nos. 900-100-1-13.1, 13.2, 13.3 and 13.4, situate at North Sea north of Edge of
Woods Road, constituting an additional approximate 12.3 acres to the Agricultural Overlay
District.
SECTION 3. Authority.
The proposed local law is enacted pursuant to Town Law {}{}264 & 265.
SECTION 4. Severability.

This Local Law shall take effect upon filing with the Secretary of State pursuant to Municipal
Home Rule Law.

the proposed law to the Southampton Town Planning Board as well as the Suffolk County
Planning Commission for their review and recommendations; and be it further

TAKE NOTTCE that, the Town Board of the Town of Southampton hereby directs that a
public hearing shall be held on October 11, 2011 at 1:00 p.m., at the Southampton Town
Hall, 116 Hampton Road, Southampton, New York, to hear any and all persons either for or
against a proposed local law entitled, "A LOCAL LAW to amend the Southampton Town
Agricultural Overlay District to include properties identified by Suffolk County Tax Map
Numbers 900-100-1-13.1, 13.2, 13.3 and 13.4/' which provides as follows:
Summary of Proposed Law
The Town Code currently regulates agriculture, gardening and animal husbandry in the CR
and R Zoning Districts. This local law will amend the boundary of the Agricultural Overlay
District to include certain properties contiguous with the existing district that have been
actively farmed for the past 60 years, further identified by Suffolk County Tax Map Numbers
900-100-1-13.1, 13.2, 13.3 and 13.4.
Copies of the proposed law, sponsored by Councilwoman Graboski, are on file in the Town
Clerk's Office, Monday through Friday, from 8:30 a.m. to 4:00 p.m.
