Pursuant to the p~visinnz of Chapter 275 and/or Chapter I I 1 of the Town Code oftbe Town of
Southold and in accordance with the Resolution of the Board of Tmstees adopted at the meeting held on

Based on the information you have submitted, the Department of Environmental Conservanon
has determined that the property landward of the functional bulkhead greater than 100 ft. in
length and constructed prior to 8/20/77, as shown on the survey prepared by Otto W. Van Tuyl &
Son on 8/10/64 and I.R. 681, is beyond Tidal Wetlands Act '(Article 25) jurisdiction. Therefore,
in accordance with the current.Tidal Wetlands Land Use Regulations (6NYCRR Part 6611 no
permit is required.
Be advised, no construction, sedimentation, or disturbance of any 'kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction
which may result from your project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your project (i.e. a !5' to 20' wide
construction area) or erecting a temporary fence, barrier, or hale bay berm.
Please note that this letter does not relieve you of the responsibility of obtaimng any necessary
permits or approvals from other agencies or local municipalities.

~EQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration
in this application and determines that this review falls under the Type II category of the State's List of
Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A '14-14 to 23, and the Suffolk County Department of
Planning issued it~ reply dated March 2, 2010 stating that this application is considered a matter for local
determination as there appears to be no significant county-wide or inter-community impact.
LWRP: This application was referred for reviewed under Chap~r 268, Waterfront Consistency review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
LWRP Coordinator issued his reply dated May 17, 2010, based upon the information provided on the LWRP
Consistency A~esament Form submitted to this dcparlment, as well as the r~ords available to us, it is our
re~mmendation that the proposed action is CONSISTENT with LWRP policy standards and thcmforc is
CONSISTENT with the LWRP. It is r~commended that a 10 foot landsc~aped buffer ba r~luired landward from the
wooden bulkhead.
PROPERTY FACTS/DESCRIPTION: The p~ is a non-conforming 15,217 square foot lot improved with a
two story masonry dwelling and attached gm'ago. It has 100.94 feet on Shelter Island Sound, 146.51 foot along the
southern property line, 100 feet on Bay Shem Road and 159.74 fcet along the northern property line.
BASIS OF APPI.,ICATIO~: Request for Variano, from Code S~:tion 280-116B, based on an application for

for the applicant was to provide a signed and sealed letter attesting to the setback of the stoop to the bulkhead. The
agent, Frank Uellendahl, Arehite~t, submitted a letter, signed and s~ed, dated May 20, 2010 slating that tile
setback of the stoop to the bulkhead is 28.1 feet, whereas tho proposed new second stoW seaward balcony is 31.2 ft
as noted in the Notice of Disapproval
FINDINGS OF FACT/REASONS FOR BOARD ACI1ON:
The Zoning Board of Appeals held a public hearing on this application on 5/20/2010, at which time
written and oral evidence were pre~ntcd. Based upon all testimony, documentation, personal inspection
of the property, and other evidence, the Zoning Board finds the foUowing facts to be true and relevant and
makes the following findlnous:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
Town Law §267-bf$}(b)(l}. Grant of the variance of will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The applicant's percel is under 20,000 sq. ft., which is 50%
larger thus (12) other lots in the immediate neighborhood. The immediate area that incorporates this public road,
consists of runny small improved lots. They are serviced with public water. The adjacent 50' lots are significantly
substandard in width and area. Most of the existing lots, with improved primary dwellings exhibit varied setbacks,
based upon those great non-conforming characteristics. Thc updating of this home will improve tl~ character of
the neighborhood.

However, the applicant's home is 35.2' from the bulkhead, which lessons the percentage oftbe requested variance.

will have an adverse impact on the physical or cnvh'onmeatal conditions in this non-~onforming neighborhood.

zoning code, the owners purchased the dwelling with these existing non-conformities.
Town Law §267-b. Grant of this variance is the minimum action necessary and edequatc to enable the applicant to
enjoy the benefit of an updated home, while preserving and protecting the character of the neighborhood and the
health, safety and w~l£are of the community.
