3. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
conmruction of this project shall be completely rvmovot from the adjacent arcs (upland) and removed to
an approved upland area for disposal. No dehri, is permitted in w~tlands and/or protected buffer areas.
4. No Dlsturbange to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
~m~tlands or prot~-~ted buffer arms as a ~lt of the p~m~itted a~ivitica.
5. Storage of ]gquipment~ Materials The stornge ofconstl'udion equipment and materials shall bo
confined within the project work ar~a and/or upland arms greater than 75 linear feet from the tidal
wetland boundary.
6. Establish Vegetated Buffer To protoot the values of the tidal wetlands, a permanent vegetated
buffer zone shall be established. There shall bo no disttnhanc~ to the natural vegetation or topography
within an area extending 20 linear feet landward of the tidal wetland boundary.
7. Area of Disturbance for Stractur~s Disturbance to thc natural vegetation or topography greater
than 25 feet seaward of the approved mature is prohibited.

8- Install, Maintain Erosion Controls Necessary erosion control measures, i.e., straw bales, silt
fencing, etc., are to be placed on the downslope edge of any disturbed area. This sediment barrier is to
be put in place before an}, disturbance of thc ground occurs and is to be maintained in good and
functional condition until thi~ v~gctative cover is astablish~xl.
9- Seeding Disturbed Areas All stems of soil disturbance r~ulting from thc approved project shall bc
stabilized with appropdatc vcgetatlon (grasses, otc.) immediately following project completion or prior
to permit expiration, whiehev~ comes first. If the.project site r~'aains inactive for more than 48 hours
or planting is impractical due to the season, then thc area shall be stabilized with ~traw or hay moleh or
jute matting until weather conditions favor germination.
1o. State Not Liable for Damage Thc State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by er result from future operations
undertaken by the State for thc consc~,ation or improvement of navigation, or for other purposes, and no
claim or fight to compensation shall accrue from any such damage.

require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the

of said waters or flood flows or vmlang~r thc h~alth, safel'y or welfare of the people of the State, or cause
loss or destruction of the natural r~ources of the State, thc owner may bc ordcr~l by the Dcpartm~t to
remove or alter the stmgtural work, obsira~tions, or hazards cavzed thereby without expense to thc State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation~ or other
modifi~lion of the watercourse hereby authorized shall not be completed, thc owners, shall, without
exper~e to the Sta~e, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any poffion of the uncompleted structure or fill
and restore to its former condition the navigable and flgod capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
13. Precautions Against Contamination of Waters All new,saw precsut~ons shall be taken to
preclude contamination of any vaxland or wat~way by suspended ~olids, sediments, fucb, solvents,
lubricants, epoxy coatings, paints, concrete, leacbate or any oth~r environmentally deleterious materials
associated with the project.

GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department Thc p;cifiitted site or facility, including relevant records, is
subject to insp~tion at re~sonablc hours and intgrvals by an authorized r~prcs~ntativc of the Department
of Envlronmantal Conservation (the D~partment) to determine whether the p;rmittcc is complying with
this permit and the ECL. Such represontatlvc may ordvr the work suspended pursuant to ECL 7l- 0301
and SAPA 401(3).
The permittee shall provide a p~tson to accompany tho Dgpartmcnt's representative during an inspection
to the permit urea when requested by the Department.
A copy of this pon,it, including all refi:renced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or faeiliB'. Failur,~ to produce a copy of
the permit upon r~uest by a Department representative is a violation of this permit.
2. Relationship of t~is.Permit to Other Department Orders and Determinations Unless expressly
provided for by thc Dcpurtmcnt, issuance of this permit does not modify, supersede or rescind any order
or determination previously issu~l by the Dc-.partmcnt or any of thc terms, conditions or requirements
contained in such order or dcterrnination.
3. Applications For Permit Renewals, Modifications or Transfers The permittce must submit a
sepm-atc written application to the Department for pe~,ifit nmewal, modification or transfer of this
permit. Such application mu.st include any forms or supplemental information the Depa,'hl',ent requires.
Any renewal, modification or transfer granted by tho Department must be in writing. Submission of

4. Submission of Renewal Application The permi~z~e must submit a renewal application at least 30
days before permit expiration for the following pea'mit authorizations: Tidal Wetlands.
Permit Modifications, Suspensions and Revocations by the Department Tho Dopurtment
res~ves the right to modify, suspend or revoke this permit. Thc grounds for modification, suspension or
revocation include:
a. materially false or inaccurate statements in the perniit application or supporting papers;
b. 'Failure by the p~mfittec to comply with any ten'ns or conditions of the pei-iiiit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material informatlon or a matra, iai change in cnvir0nmental conditions, relevant
technology or applicable law or regulations since the issuance of thc existing permit;

The permittoe, excepting state or fedecal agencies, expressly agrees to indemnify and hold harmless the
Department of Envffonmental Conservation of the State of New York, its representatives, employees,
and agents ("DEC") for all claims, suits, actions, and damages, to the extent at~butable to the
permittee's acts or omissions in conn~;tion with the pcrmittee's undertaking of activities in connection
with, or operation and maintetlance of, the fagility or facilities authorized by the permit whether in
compliance or not in compliance with the tetal$ and conditions of the permit. This indemnification does
not extend to any claims, ~uits, actions, or damage~ to the extent attributable to DEe's own negligent or
intentional acts or oral.ions, or to any claims, suits, or actions naming the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provi~ion
under federal or state l/tws.
