Appellants have appealed to this board seeking a Special Excep-
tion to the zoning ordinance, Article III, Section 100-30B(1) for
permission to convert existing one-family dwelling to two-family use
which is located in an "A" zoning district at the southeast side of
Main Road, Southold, New York.~
The premises in question contains an area of approximately
25,900 square feet with 78' road frontage and a depth of 300.37
feet. The premises is improved with a 2½-story frame house and
separate accessory garage in the rear yard.
Article III, Section 100-30B(1) of the zoning code states
that ..."The following uses are permitted as a special exception
...subject to site plan approval in accordance with Article XIII...:
(1) Two-family dwellings, conversion of existing buildings and new
consruction, not to exceed one (1) such dwelling on each lot..."
Section 100-31 of the zoning code requires that "...No building or
premises shall be used ...in the A Residential and Agricultural
District unless the same conforms with the 'Bulk and Parking
Schedule' incorporated into this chapter, by reference, with the
same force and effect as if such regulations were set forth herein
in full..." The minimum requirements for a two-family dwelling
as shown on the bulk schedule are as follows: 80,000 square feet
total lot area; 270 feet of lot width; 250 feet of lot depth;
50 foot setback in the frontyard; 25-foot setback in the sideyard;
both sideyards a total of 45 feet; livable floor area per dwelling
unit 850 square feet.
In the board's opinion, appellants' remedy is legislative and
not administrative. Inasmuch as the circumstances herein does not
comply with the minimum requirements of the zoning code, the
special exception application must be denied.
On motion by Mr. Grigonis , seconded by Mr. Douglass,
it was
RESOLVED, that the application of Paul and Margaret Radich,
Appeal No. 2942 filed December 21, 1981, is accordingly denied
without prejudice.

The Chairman opened the hearing at 8:00 p.m. and read the
legal notice of hearing in its entirety and appeal application.
MR. CHAIRMAN: We have a copy of the proposed changes that
are indicated in the S~ecial Exception application~ 'We also have
a copy of a survey indicating this particular house on a parcel
of property approximately 78 feet on the road, approximately 330.68
feet on the west side, and similar configurations on the other two
boundaries. We have a copy of the Suffolk County Tax Map indicat-
ing this particular property and surrounding properties in the
immediate area. Is there anybody that would like to speak in
behalf of the application?
MRS. HELEN COCHRAN: I'm Paul and Margaret's daughter. They
plan on using the top half of the house themselves so they would
just be renting one part of it and still be confined...the top half
as a summer residence and weekends.
MR. CHAIRMAN: Thank you very much. Is there anybody else
that would like to speak in behalf of the application? Anybody
like to speak against the application? (None) I should note for
the record that this application has been before the board for a
short period of time. Of course, longer than most applications
for the sole purpose for the fact that we are involved in Zoning
revisions at this particular time. I did and was in contact with
Francis J. Murphy, who is Chairman and Deputy Supervisor of the
Town of Southold, yesterday morning and he indicate to me that
there will be a public hearing forthcoming on two-family housing,
or one-family housing conversions. So at that particular time
we will know more. However, we have accepted this application
and we will make a determination based upon the present zoning
as it exists. Hearing no further comments, I'll make a motion
reserving decision and closing the hearing until a later date.
MEMBER SAWICKI: Second.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was
PJESOLVED, to close the hearing and reserve decision in the
matter of Paul and Margaret Radich, Appeal No. 2942.

We wish to alter our house in the following manner in order
to partition the already existing structure into two separate
apartments. This house was built in 1948 as a "mother-daughter"
type structure with kitchen, bathroom, livingroom and bedrooms
downstairs and the same upstairs. There are now two common
enterances, which is what we would like to change (see diagram).
As you can see,the changes are minor ones.
Over the years our family has lived in and needed this
house in this form. Now, this being our summer/weekend home,
we find these changes necessary as the house is too big for our
needs, our children having grown and moved away.
Also, we find we must rent part of the house in order
to partially cover expenses of heating and taxes on such a
large home. Otherwise, we would have to sell this housel
something we would deeply regret having to do as we love it and
the community. Our family has owned this house for over thirty
years now. Our future plans include moving to Southold and
this house upon retirement so we would like to be able to
keep it for that time.

inasmuch as her parents don't know whether they should

await the decision of the Two-Family Housing Committee.

Dear Mr. and Mrs. Radich:
Recently, you filed a variance application for conversion
of an existing building to two-family located at 51170 Main
Road, Southold, which is in an A-Residential and Agricultural
Zone.
We are not certain whether you are familiar with the
attempts being made within the town to make provisions for
two-family housing, and feel it would be only proper that you
be informed. There is presently a "two-family housing" com-
mittee consisting of individuals from each the Building,
Planning, Zoning and Town Board departments, and we were
informed that an informational public meeting is to be held
some time in the near future.
Would you wish our board to schedule your application
for a public hearing to be held at our next meeting, or would
you prefer to await the anticipated public informational
meeting.
