WITNESSETH, that the pan'y of lhe first part, in consideration of te~ dollars and other valuaMe
consideration paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever.
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
siluate, lying and being at Mattituck, Town of Southold, Suffolk County, New York, boundecl and
described as follows:
BEGINNING at a monument on the eastedy side of Pacific Street, where the same is intemected by the
division line between land hereinafter described and land now or formerly of Andrusio; said point also
being the northwesterly comer of the premises hereinafter described; running thence North 72° 43' 20"
East, along land now or formeriy of Andrusio, 200.0 feet to a monument and land now or formerly of
Deviault; thence South 14° 50' 20" East along the last mentioned land, 50.0 feet to a monument;
thence North 72' 43' 20" East, still along the last mentioned land, 58.64 feet to a monument and land
now or formedy of Young; thence South 7° 41' 10" East, along the last mentioned land, 40.0 feet to a
monument and land now or formerly of Marguard; thence South 68° 06' 50" West, along the last
mentioned land, 255.35 feet to a monument on the easterly side of Pacific Street; thence North 14° 50'
20" West, along the eesteriy side of Pacific Street, 110.0 feet to the monument at the point or place of
BEGINNING.
BEING and intended to be the same premises conveyed to the grantor herein by deed dated December
15, 1975, recorded January 13~ 1976 in Libor 7972, Page 560, and a deed dated 4t29/75, recorded
6/30/75 in Libor 7864, cp 500 and a deed dated 4/21/75. recorded 6130/75 in Liber 7864, cp 506.
SAID PREMISES BEING SUBJECT TO A UFE ESTATE IN JAMES R. WELLS and NANCY WELLS
SUBJECT TO any slate of facts an accurate survey migl~ show
SUBJECT TO covenants, restrictions, utility easements, reservations and agreements of record, if any,
and if same are in force and effect.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the centar lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the 13arty of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been en¢umbered in any way whatever, except as aforesaid.
AND the party of Ihe first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to recek~e such
consideration as a lrust fund to be applied first far the purpose of paying the cost of the improvement and
will appty the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as if it read 'parties"
whenever the sense of this indenture so requires.
