We have found that the subject tree, although in seemingly good health, is quite mature with some dead limbs on it. We also noticed that if this tree were to remain it could pose a serious threat to the existing house, as it presently does, in addition to the future garage were there to be a severs storm. Further, we discovered that if the garage were to be relocated as suggested,two other younger but sizable oak trees in very good health would have to be removed to accommodate such a move. Both myself and my client being sensitive to keeping as many trees as possible were sensitive to the CAC's suggestion but upon further consideration find it would be more beneficial to save the two younger trees in lieu of the older one at the proposed garage location. Accordingly we which to rescind the agreement to relocate the Garage and ask the Board to reconsider our application as originally applied for and as shown on the submitted Site Plan. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the denoted following Policy Standards and therefore is CONSISTENT with the LWRP provided the following: If the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is recommended that a landscaped buffer be required landward of the wetland.
