Herrmann En-Consul~nts, lnc. 1319 North Sea Road Southamp~n, NY 11968 RE: BREEZY SHORES COMMUNITY, INC. 65490 ROUTE 25, GREENPORT SCTM# 53-5-12.6 Dear Mr. Herrmann: The Southold Town Board of Trustees reviewed the project plan prepared by Sag Harbor Engineering, last dated May 13, 2011, and received on June 24, 2011, and determined that the proposed installation of a drainage system of drywells to mitigate rainstorm induced flood events that affect most severely the area of the property situated generally between units "C-2" and "C-7", is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground sur[ace or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. As this area is located between tidal wetlands associated with Shelter Island Sound (to the west and south) and freshwater wetlands to the north, whose boundary was delineated by the New York State Depa~hnent of Environmental Conservation on 6 December 2010, the proposed project area has been carefully designed to remain more than 100 feet from both wetlands boundaries, ail as depicted on the site plan prepared by Sag Harbor Engineering, dated May 13,2011. A copy of this plan is enclosed along with a current land survey of the property and agent authorization letter. As depicted on the plan, a project-limiting fence and staked haybaies would be emplaced a minimum of 100 feet from ail wetlands setbacks prior to construction to ensure that ail construction activities would in fact remain more than 100 feet from ail wetlands. As ail proposed work and related construction activities will therefore occur beyond the jurisdiction of the Board of Trustees pursuant to §275-3(C)(5) of the Southold Town Code, would you kindly prepare a non- jurisdiction letter for the project. Although no Building Permit or other Town approvais are required for this project, I have discussed it with Jamie Richter and will be providing him with a copy of the proposed site plan for his information. Keith, PE Attached is a 1 inch equals 60 feet partial plan of the Breezy Shores Community showing the proposed project to install dry wells to mitigate frequent local flooding. The bold line outlines a nominal drainage area within which storm water will drain to three clusters of 3 10 foot diameter, 3 feet deep dry wells. The volume of storm water storage in these units is as follows: 9 dry wells x 3 feet x 68.4 cubic feet per foot = 1847 cubic feet The area within the outlined nominal service area equals 91,400 square feet To fully comply with the Town of Southold Section 161-28 requirements for storm drainage, the dry well storage for this area would be as follows: 91,400 sq. ft. x 0.3 runoff coefficient x 0.167 ft. of rainfall (2 inches) = 4579 cu. ft. Therefore, the nine proposed dry wells will accommodate: 1847 cu. ft. divided by 4579 cu. ft. = 40.3% of the volume required by the Town which equals a rainfall volume within the nominal area equal to .403 x 2 inches = 0.806 inches. Note: The proposed dry wells will not store and hold the volume ora two inch rainfall. However, by providing a vertical drainage path beneath each of the three dry well clusters the project will allow more rapid release of the stored water to the groundwater than would otherwise occur through nine feet of the existing impervious subsoils.
