New Jersey 07043, as Trustee of THE JIM WELLES IRREVOCABLE TRUST
AGREEMENT, dated October 16, 2008, with an eighty-five (8:5%) percent interest in
the premises and MICHAEL CHRISTOPHER WELLES, residing at 86 Edgemont
Road, Montclair. New Jersey 07043. as Trustee of THE JIM WELLES FAMILY
TRUST #I, under agreement dated October 16, 2008, with a fifteen (15%) percent
interest in the premises;
party of the first part. and
JAMES WELLES, residing at 275 Munn Lane, Orient, New York 11957;
party of the second part.
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Orient, Town of Southold, County of Suffolk and State

Southwesterly comer of the premises hereby conveyed and being the Southeasterly comer

minutes West, 88 feet, to a point;
THENCE along other land formerly of Clement J. Welles, North 87 degrees 12 minutes
West, 94,94 feet, to the Easterly linc of lands formerly of Clement J. Welles;
THENCE North 4 degrees 50 minutes East, 88 feet, to a point on the Southerly linc of
lands of Newell;
THENCE along the Southerly line of lands of Newell, South 87 degrees 12 rhinutcs East,
94,94 feet, to thc point or place of BEGINNING.
TOGETHER WITH all thc right, tide and interest of the party of thc first party, of, in and
to thc land lying in the struts in front of and adjoining said three parcels, and all fights of
way appurtenant to said parcels, and to the lands under water of Orient Harbor adjoining
Pan:el III.
BEING AND INTENDED TO BE the same premises conveyed to the Grantor by Deed
dated Octol~r 16, 2008 and recorded in the Suffolk County Clerk's Office on March 3,
2009 in Liber D00012581 page 869, the Grantor being the same person described as the
Grantee in said Deed.
Together with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the a~ve-described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of thc first pan in
~and :o said premises:
To have and to hold thc premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second pan forever,
And the party of thc first part covenants that the party of the first part has not done or
sufferexl anything whereby the said premises have been encuml~r~d in any way whatever,
except as aforesaid.
And thc party of thc first pan, in compliance with Section 13 of thc Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for thc purpose
of paying the cost of improvement and will apply the same first to the payment of the cost

of thc improvement before using any part of thc total of thc same for any other purpose.
The word "party' shall be construed as if it read "parties" whenever thc sense of this
indenture so requires.
