There were present:.Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank Coyle. Absent: Mr. Alfred Grebe (due to unfavorable weather conditions) Also present: Eoward Terry, Building Inspector THE CHAIRMAN: It is 7:30 P.M., I will now ~call this meeting to order. Plat of property owned by W. H. D. Southold Town Planning Board -3- January 17, 1972 DANIEL SMITH: Yes, I would like to speak in favor of this subdivision. I think we have everything we need. If you have any questions, I will try to answer them. HENRY RAYNOR: Has the ownership changed from Overton to Mitchell on the property adjacent to the westerly boundary line of lot # 13 on the N/S Soundview Avenue? WILLIAM SMITH: Yes, I-believe a part of the Overton property was sold to Mitchell. DANIEL SMITH: Ail of.the 10ts in this subdivision front on an existing town road, Soundview Avenue, therefore, no road construction will be necessary. The maps have been. signed by H.W. Davids of the Health DePt. and John'Flynn of the Suffolk County Department of~Environmentai Control. Inciden~ly, I had qui~e a bit of trouble with the Dept.~of Environmental Control. I made an appointment with Mr. Ftynn, but after.going all the way up there, he wasn't in. When he finally did sign the maps, the office, called.and told me to come.pick them up because they had no budcet for postage for sending out subdivision maps. VICE-CHAIRMAN MOISA: I believe everything is in order. The maps contain'the signatures of H. W. Davids and John Flynn and all fees have been paid. VICE-CHAIrmAN MOISA: Is there anyone else present wishing to be heard in reference to this subdivision? (There was no response.) VICE-CHAIRMAN MOISA: Hearing none, the Planning Board will now make a determination on this subdivison. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town.Planning Board grant final approval to the proposed subdivision of W~ H. D. Realty Corp., to be known as "NORTHWOOD ESTATES ~T SOUTH©LD", property located at north and south sides of. Soundview Avenue, Southold, New'York. The Chairman signed the final maps. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Southold Town Planning Board -4- January 17, 1972 Richard Cron, Attorney presented the Planning Board with a revised map for the proposed m~nor subdivision of O. A. Ringewald, property located at private right-of-way off N/S Main (State) Ro~d, Orient, N.Y. This minor subdivision was granted preliminary approval at the last Planning Board meet- ing on December 20, .1971, subject to right, of~way (on the property) being increased to at least 25 ft. in width. The revised map showed 25ft. right-of-way as required by the Planning Board~ This minor subdivision contains five' (5)lots and each lot contains over 2 acres of ~rea. Discus§ion was held on the excessive size of these lots. M~r. Cron pointed out that it would be impossible to further subdivide these lots without obtaining a variance from the Board: of Appeals for reduced frontage. The Zoning Ordinance now calls for 135 ft. frontage. These lots presently contain from 187 ft. to 240 ft. of frontage, therefore, they could not meet the minimum frontage requirement if they were further ~subdivided. The Planning Board instructed that the followin~ statement be recorded in the minutes of this meeting: "The Planning Board is determined that under no circumstances will any of these lots be re-subdivided. Mr. Cron has been sent Health Dept. referral forms and instructions for submitting the necessary maps. Upon receipt of the completed Health Dept. forms and necessary maps, the Planning Board will forward this minor subdivision to the Health Dept. for their deter- mination before granting final approval. On motion by Mr~ Wickham, Seconded'.by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposedminor subdivis~sno6f O. A. Ringewald, property located at private right,of-way off N/S Main (States Road, Orient, N.Y., the condition of increasing the right-of-way~having been~met by the applicant. Vote of the Board:- M~es: Messrs: Wickham, Mo±sa, Raynor, Coyle. Richard Cron, Attorney appeared before the Planning Board in reference~o the propos~d~sub~ision of Clausen~Construction Co., Inc~, property located at S~S Leslie Road, Peconie, New York. Preliminary approval was granted to this~subdivision at the last Planning Board~meeking, subject to Mr.'Cron making an effort to obtain a wedge of the easterl~ adjoining property owned by Mr. Pontino, to increase the frontage on lot no. 10. The Planning Board required that they 'be presented with a copy of letter of requ&$t to purchase additional proper~t~, to, be sent to Mr. Pontino by'~ichard Cron, and copy of answer~received from Mr. Pontino', ~if ~any~ Mr.~Cron p~esented the Planning Board with a copy of the letter, dated December 23, 1'971~ which he sent to Mr. Pontino. ~wir. However, Mr. Cron stated that he has called him twice on the telephone to request a reply to his letter, at which time Mr. 'Pontin~ told ~im that he was not interested in selling any of his property. The Planning Board determined that the condition ~or preliminary approval has been satisfactorily met by the applicant's attorney. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board grant preliminar~ approval to the proposed subdivision of Clausen Construction Co., Inc., property located at S/S Leslie Road, Peconic, N.Y., the condition for this approval having been satisfactorily met.by the applicant'~ attorney. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Gottlieb Nickles & Margery Burns presented the Planning Board with a revised preliminary map for the proposed minor subdivision of their property located at S/S Old Middle Road (off CR 27), Southold, N.Y. This revised map showed a division of the property into five (5) lots: 4 lots fronting on the road and one interior lot adjacent to the L.I. Railroad. The Planning Board~advised them that they did not Like this division of the property because the back lot~was undesir.~te adjacent to the L.I. Railroad. Mr. Nickles presented the Planning Board with a letter from Mr. Steve Doroski statinq~that he.is not interest- ed in leasing the back of the proper~ .for nursery purposes. Mr. Coyle stated that he thought that:th~ division of this property into 4 lots was more feasible than. 5 lo~s. The Planning Board was of the same opinion. Mr. Nickles and Mrs. Burns agreed that a division of 4 lots would be suitable to them also. The Planning Board stated that this is a very hard piece of property to divide. On motion by Mr. Coyle seconded by Mr. Wickham~l it was RESOLVED that the Southold Town Planning Boa~?grant final approval to the PropoSed minor subdivision of GO~eD Nic~ies and Margery Burns, property located at s/s Old ~i!~dle Road ioff CR 27), Sou~hold, N.Yi, subject to receipt of=th~ following: 1. Six (6) copies of~final map showing a division of the property into 4 lots, as approved by the Planning Board, and cOntaining all necessary' information as required by the Health Dept. 2.Favorable determination of the Health Dept. 6n the Planning Board referral of this mino~ subdivision. Reply from the Town Attorney on the feasibility of requiring that a covenant be filed with the deed stating that the lots in this minor subdivision cannot be further subdivided. 4. Two (2) copies of formal application. 5. Application fee of $40. ($10. per lot) Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Coyle. Mr. Henry Raynor abstained from voting on this minor subdivision. Dominic Aurichio, Attorney appeared before the Planning Board in reference to the proposed subdivision "Petty's Bight". T~e final hearing on this subdivision was recessed at the last Planning Board meeting. Hearing was to be reconvened subject to receipt of the following:- (1) Updated ~etter of approval from the Supt. of Highways; (2) Formal review by the Suffolk County Planning Commission and letter of approval; (3)Approval and signature of the map by the Suffolk County Dept. of Environ- mental Control; (4) Recommendation or approval of the Town Attorney in reference to the bonding of the westerly 256.96 ft. of Petty's Drive, which is to be left as' "Reserved for Possible Future Dedication to the Town of ~Southold for Highway Purposes." (5) N/W corner of lot no~ 11 must be marked as "Reserved for Possible Future Dedication to the Town of Southold for Highway Purposes." Letters of approval have not yet been received from the Supt. of Highways, the Suffolk County Planning Commission, or the Town'Attorney. The maps have been signed by John Flynn of the Suffolk County Department of Environmental Control. It was determined that requirement 9 5 (in reference to the N/~ corner of lot no. 11~ ~s covered ~n the present map by the surveyor's notes. On motion by Mr. Wickham, sec~nded~by Mr. Coy!e, it was RESOLVED that the Southold~Town Planni~g~Boa~d'grant final approval to the proposed subdiwi~ion of Ir~i~ &.George NeWman, to be known as "Petty's Bight", located off N/S Main (State) Road, Orient, New York, subject to the following conditions: 1. Receipt of up-dated letter of approval from the Supt. of Highways. 2~ Receipt of approval from the Suffolk County Planning Commission. 3. Receipt of approval 6r recommendation from the Town Attorney in reference to the bonding of the westerly 256.96 feet of Petty's Drive, which is to be left as "Reserved for Possible Southold Town Planning Board -7- January 17, 1972 Future Dedication to the Town of Southold for Highway Purposes. 4. Receipt of notice of acceptance of performance bond, from the Southold Town Board, for the completion of roads and other improvementS. Performance bond must be posted with the Southold Town Board within ninety (90) days from this date. 5. Receipt of application and filin~ fees in the ~amount of $2,350.00 (4% of performance bond of $55,000. = $2,200.00, $50. flat fee, plus $5.00 per acre w/ 20 acres = $100.00 = total fee of $2,350.00 This motion shall include authorization for the Chairman or Vice-Chairman to sign the final maps upon fulfillment of all above listed requirements. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. George Ahlers appeared before the Planning Board with Ralph Myller, Architect; Alan P. Wolpert, Consultant; and John McNulty, Attorney in reference to his proposed plan for "Southold Commons Apartment Project", to be located on property between W/S Young's Avenue and E/S Horton's Lane (north of L.I.R.R.), Southold, New York. Mr. Ahlers et al presented the Planning Board with a pro- posed plan for clustered apartment dwelling units. The total area of this property is 23 acres. The plan proposes 153 dwell- ing units w/ 6,300 sq. ft. per unit. There will be a total of 11 buildings containing from 14 to 16 units per building. They propose to have 10% studio apartments; 208 two (2) bedroom apart- ments; and 70% one (1) bedroom apartments. Rentals will be from $175. to $250. per month. The project is designed to attract young marrieds and retired people. It is centrally loCated, within walking distance of the Southold business area, school, and churches. The project will house a population of 300, and will increase the school enrollment by only 32. This project will require both public water and sewer. Public water can be obtained from the Village of Greenport Water System. They will be able to tie into the hydrants north of Agway on Young's Ave. and ~orth of the Railmoad on Ho~ton's Lane.~ The size of the mains will have to be incr~eased from these points to Middle Road. They will have to e~tablish their own sewerage treatment plant. John McNulty requested specifications on sewerage treatment plants. The Chairman advised him to contact the Town Attorney and the County Sewer Agency. The Chairman advised them that it may take from 1 - 1/1/2 yea~s to obtain complete approval on this pro~ect. He stated that because the Town has no explicit framework for clustering, it has to be approached bit by bit and piece by piece. This property is presently zoned "C" & "A". The Board advised them that their first step is to apply to the Town Board for a change of zone for either an "M-l" or "B" Southold Town Planning Board -8- January 17, 1972 district. The Chairman cautioned them that the Planning Board will require exacting specifications and estimates for the cost of the sewerage treatment plant. The Chairman said that most of these package sewerage plants work well for 3 or 4 years them develop problems. The T~wn of Southold will demand a sewerage plant that will work well for at least 20 years. They will also be required to submit a precise estimate for the operational and maintenance costs of the sewerage treatment plant. The Board also advised them that must be able to produce a statement for stable means of financing the entire project. The Planning Board informed them that they must submit all of the above mentioned items before this project can even be considered for preliminary approval. Stephen Mitaechione appeared before the PLanning Board in,reference to his proposed.minor subdivision located at S/S ~ene~Re.~d; Cutchogue; N~Y. Tbe~Ch~irman rea~'the deter- mination of the Health Dept. on the Planning Board's referral Of this minor-subdivision. ~he~ 5ealth ~Dept. recommended that this property be divided into a.minor slubdivision of two lots instead of three. Mr. Mitacchione agreed to a minor subdivision of two lots. He said that he would li~e to combine the two nOrtherly lots as one lot, thereby cre~ting a minor subdivision of two lots. ~he Board stated that the~ would like a minor sub- division of two equally.divided lots. It was suggested that the lot line of the southerly lot be moved northerly 40 feet to create an equal distribution of the area. This divi§ion would t~ke in the approved test well on the press~t northerly lot and re,locate it on the southerly lot. Mr. MitacchiOne stated that he :plans to build his residence on the northerly lot. The Board suggested that Mr. Mitacchione o~tain an easement to this well ~rom the buyer of the southerly lot. After further discussion it was~decided that it would be more feasible to create a jog in the division tine o~ theroad so that the northerly lot would take in the approved well. The Board advised Mr. Mitacchione that the~ would accept a minor sUbdivision of two lots as above specified. Mr. Mitacchione to present revised maps showing two lots, formal ~application, and fee of $20 at next Planning Board meeting. The Planning Board was presented with a sketch for the proposed subdivision of John, Reginald, David, and William Groenveld, property located at S/S Orchard'Street, Orient, N.Y. (presently under contract to purchase from Ernest Wilsberg). ~he sketch showed ~ division of the property into 11 lots with a 50 ft. proposed road.. All lots contain- ed 40,000 + sq. ft. of area. The Plan~ing Board advised them to present preliminary maps for this proposed subdivision. Southold Town Planning Board -9- January 17, 1972 The Planning Board was.presented with a corrected copy of the "Covenant and Restriction" wit-h fee of $5.50 for recording in the County Clerk's Office, and application fee of $50. for the minor subdivision of Elaine Axien, property located at private right-of-way off N/S Middle Road (CR.27), Peconic, N.Y. Final approval was granted to this proposed minor subdivision at the Planning Board meeting Of October 27, 1971, subject to the following conditions: (1) Restriction to read as follows: "That the premises or any part thereof shall not be further sub- divided." (2) Covenant and Restriction to be in the proper form for recording in the office of the Suffolk County Clerk, and fee for recording to be collected by the Planning Board. Upon inspecting the "Covenant & Restriction", the Board finds that it meets our requirements and all necessary fees have been collected. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that'the Southold Town Planning Board grant final approval to the proposed minor subdivision of Elaine Axien, property located at private right-of-way off N/S ~iddle Road (CR 27), Peconic, N.Y. The Chairman signed the final maps. Covenant and Restriction to be forwarded to the County Clerk's Office for recording. Vote of the Board: Ayes:- Messrs: Wickham, Mois$, Raynor, Coyle. The Planning Board was presented with a sample copy of a proposed "Covenant & Restriction" for the proposed minor sub- division of~David L. Gillispie, property lOcated at north side Main (State) Road, East Marion,. N.Y. After inspecting the "Covenant & Restriction , the Planning Board approved it as presented. Mrs. Giliispie to be advised to submit a signed copy Of "Covenant & ~Restriction,, recording fee of $5.50, and application Tee for minor.'subdivision Of $40. This minor sub- division must be transmitted to the Health Dept. for their determination. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED.that the Southold Town Planning Board transmit the prop®sed minor subdivision of David L. Giltispie, property located at NJS Main (State) Road, East Marion, N.Y., to the Suffolk County Health Dept. for~their inspection and approval. Southold Town Planning Board -10- January 17, 1972 Letter to be sent to Mr. Gillispie advising him of the procedure and requesting the necessary number of maps and completion of Health Dept. forms. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyie. The planning Board was presented with preliminary maps, two copies of formal application, and fee of $20, for the proposed minor subdivision of Jean Schneider, property located at private road off S/S Main Road, East Marion, New Y~rk. The preliminary map showed a division of the property into two lots; the total area of the property being 1.335 acres. A division of this property ~om~d.create lots with less than 40,000 sq. ft. of area, which is the minimum requirement under our present Zoning Ordinance. The Planning Board agreed that this appli- cation should be denied on.the basis of insufficient lot area. This application could be presented to the Board of Appeals for a variance, if the applicant so desires. Letter to be sent to the applicant's attorney, William Wickham, advising him of the Board's determination in this matter and check of $20. to be returned. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board deny the application of Jean Schneider for proposed minor subdivision of her property located at private right-of-way 6ff S/S Main Road, East Marion, New York. This application is denied on the basis of insufficient lot area - less than 40,000 sq. ft. of area per lot. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board was presented with preliminary maps for the proposed minor subdivision of W. Perry Hukill, property located at S/S Main (State) Road, East Marion, N~Y. The map showed a division of the property into two lots; the total area of the proPerty being 41,614 sq. ft. Lot no. 1 contained 21,509 sq. ft. of area, lot no. 2 contained 20,105 sq. ft. of area. A division of this property would create lots with less than 40,000 sq. ft. of area, which is the minimum requirement of our present Zoning Ordinance. The Planning Board agreed Southold Town Planning Board -11- January 17, 1972 that this application should be denied on the basis of insufficient lot area. Letter to be sent to W. Perry Hukitl advising him of th~ Planning Board's determination on this matter. On motion by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board deny the application of W. Perry Hukill, for proposed minor subdivision of his property located at S/S Main (State) Road, East Marion, New York. This application is denied on the basis of insufficient lot area - less than 40,000 sq. ft. of area per lot. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board was presented with preliminary maps for the proposed minor subdivision Of Hugh L. Switzer, property located at W/S Mill Road, Peconic, N.Y. The map showed a division of the property into three (3) lots: lot no. 1 contained 40,000 sq. ft. of area; lot no. 2 contained 40,000 sq. ft. of area; lot no. 3 contained 46,000 sq. ft~ of area. The Planning Board stated that they would accept a minor subdivision of this property into three lots as presented. This minor subdivision must be trans- mitted to the Health Dept. for their determination. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVE~ that the Southotd Town Planning Board transmit the proposed minor subdivision of Hugh L. Switzer, property lo~ted ak W/S Mill Road, Peconic, N.Y. to the Suffolk County Health Dept. for their inspection and approval. Letter to be sent to Carroll Schutze a/c Hugh L. Bache Bleecker) $19,000 4/5/66 to 4/5/70* - extension to May--6, 1971 NOtice of default sent by Planning Board 11/29/71.- reply received 12/9/71 minor work to be completed - Planning Board says O.K. * dates include extensions, etc. Southold Town Planning Board -12- January 17, 1972 The Planning Board reviewed this list of expired subdivisions and performance bonds and instructed that a letter be sent to each of the developers of'these subdivisions requesting that they appear at our next Planning Board meeting on-February 7, 1972, to discuss steps for the correction of their default. On motion by Mr. Wickham, seconded by Mr. Moisa, it was RESOLVED that the next meeting of the Southold Town Planning Board be held at 7:30 P.M., Monday, February 7, 1972, at the Town Office, Main Road, Southold, New York, for the purpose of reviewing expired subdivisions and performance bonds. Vote of the Bgard: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. On motion by Mr. Moisa, seconded by ~r. Raynor, it was RESOLVED that the minutes of the Southold Town Planning Board, dated December 20, 1971, be approved as submitted. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, R~no~, Coyle. Lawrence Tuthill P.E. presented the Planning Board with a revised estimate for a performance bond, in the amount of $55,000., for the completion of roads and other improvements in the subdivision "Petty's Bight", property located at N/S Main (State) Road, Orient, New York. On motion by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board, a performance bond in the amount of $55,000.00, estimate as prepared by Lawrence Tuthill- Construction Engineer, for the completion of roads and other improvements in the subdivision to be known as "Petty's Bight", located at N/S Main (State) Road, Orient, New York, owned and developed by Irving & George Newman. Copy of this resolution, together with copy of bond estimate to be forwarded to the Southold Town Board. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle.
