A regular, meeting of the Southold Town Planning Board was
held at 7:30 P.M.,~Monday, February 7, 1972, at the Town Office,
Main Road, Southold, New York.
There were p~esent: Messrs: John Wickham, Chairman; Henry
Moisa, Vice-Chairman; Henry Raynor; Frank Coyle.
Absent: Mr. Alfred Grebe (due to unfavorable weather conditions)
Also present: Howard Terry, Building Inspector
On January 18, 1972 the Planning Board sent letters to
each.of the owners or developers whose subdivis£ons or p~-
formance bonds are in default as specifiedon the "Subdiv~ision
Review List", dated January 17, 1972. Tke developers were
instructed to appear at the next meeting of the Planning Board
on February 7, 1972 to diScuss steps for correction.

Mr. Harold Reese appeared before the Planning Board in
reply to letter received from the Planning Board on date of
January 18, 1972 regarding the condition of the roads in
Sections I, II, & ~II of Harbor Lights Estates.. The Chairman
read letter of February 2, 1972 from Mr. Reese to the Planning
Board explaining his position, and Mr. Reese submitted the
following letters in explaination: Letter of January 3, 1972
from Mr. Reese to the Aetna Insurance Co.(his bonding company)
stated Mr. Reese's numerous attempts to dedicate these roads
to the Town of Southold; all to no avail. This letter stated
that during the summer of 1969 Mr. Reese made application to
the Town of Southold for dedication of the roads. About two
months passed and not hearing from the Town Mr. Reese contacted
them and was told that the application had either been lost or
misplaced. When he offered to re-file the application it was
suggested that he wait while a search was made. About a week
later Mr. Reese was informed that the application had been
found and that it would no~ be processed. An inspection was
made and he was given a list of repairs .that had to be made
before the Town would accept the roads. The same contractor
that had installed the roads now made the additional repairs
and again Mr. Reese requested the Town to accept the roads
for dedication. Mr. Reese was now told by the Town Board that
it was too late in the year and that he would have to wait until
the spring of 1970. Mr. Reese~stated that two further attempts
were made in 1970 & 1971 both with the same results as in 1969.
Mr. Reese also submitted copies of two letters to the Town
Attorney from the Aetna Insurance Co. requesting information
on this matter~ on date of.March 4, 1971 a~d June 15, 1971.
These letters were not answered by the Town Attorney until
June 17, 1971 at which time the Town Attorney told them that
the Highway Committee of the Town Board would contact him.
Mr~ Reese stated that he had never been contacted by any
members of the Town Board. Mr. Reese sa~d that he has recently
spoken with the Supt. of Highways regarding this matter. Mr.
Reese said that he is going to contact the Town Board early
this spring for a list of necessary repairs and Mr. Dean
assured him that' an inspection would be made and as soon as
the ~repairs are completed Mr. Dean will submit a recommenda-
tion for dedication. The Chairman suggested that the Planning
Board grant a six (6) month extension on Section I, II, & III
of this subdivision.
On motion by Mr. Moisa, seconded by Mr. Raynor, it was
RESOLVED that the Sou%hold Town Planning Board grant a
six (6) month extension of time to the subdivision "Harbor
Lights Estates, Section I" ( includes roads in Sections II
& III) This extension shall be effective from February 7,
1972 until August 7, 1972.

On motion by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board send the
following letter to the Southold Town Board:

Gentlemen:
It would appear from copies of correspondence from Mr.
Reese which we have in our file of "HARBOR LIGHTS ESTATES",
SECTIONS I, II, & III", that you have delayed the dedication
of the roads in this subdivision 'for unknown reasons, thereby
causing a great deal of'hardship to Mr. Harold Reese. We
find no copies of correspondence from the Town Board, Highway
~55~ee, or Supt. of Highways ~i~ Mr. Reese on the matter
of these roads.
The Southold Town Planning Board is granting a six (6)
month extension to Sections ~, ~,& III.of "Harbor Lights
Estates", to be effective from February 7, 1972 ~ntil August
7, 1972. We are hopeful that dedication and acceptance of
the roads will take place b~ere the expiration of this six
(6) month extension.

Discussion was held on "Harbor Lights Estates, Sections
IV & V. The Chairman read letter of January 14, 1972 from
Mr. Reese to the Planning Board. Mr. Reese stated in this
letter that arrangements are being made with the Village of
Greenport to work out plans to provide public water for
Sections IV & V. Mr. Reese submitted letter of July 31,
1970 from the Health Dept. granting a renewal of approval
on Sections IV & V subject to arrangements being made ~
provide public water. Mr. Reese also submitted letter from
the Health Dept. dated June 2.3, 1971 granting an extension
o~fthis approval until June 23, 1972. The Planning Board
informed Mr. Reese that as of December 17, 1971 (the effective
date of the Amendments to the Zoning Ordinance) the Town of
Southold requires subdivision lots to have 40,000.sq. ft. of
area; or 20,000 sq. ft. of area with provision of both public
water and sewerage. The Planning Board advised Mr. Reese
that they granted "preliminary approval only" to Sections

IV & V of Harbor Lights Estates. If it had been in the final
stages of approval it would be a different matter. However,
it will now be necessary to provide both public water and
public sewerage on lots of 20,000 sq. ft. or go to lots of
40,000 sq. ft. The Planning Board suggested that Mr. Reese
form his own water district and sewerage plant. Mr. Reese
stated that he would look into the possibilities of this.
Joseph Fusaro a/c C.P.F. Land Corporation appeared before
the Planning Board in regard to the status of the roads in the
subdivision "Blue Horizons, Sec. I", located at Peconic, .N.Y.
The Chairman read the Planning Board's letter of Ja~u!~ry 18,
1972 to the C.P.F. Land Corporation; and letter from the Health
Dept. to the C.P.F. Land Corporation, on date of January 21,
1972, granting th~ an ~extenslon of their approval. Mr. Fusaro
stated that they plan to begin construction of ~e roads as soon
as the weather breaks in the spring. He stated that the reason
for the delay of the construction of these roads was the sickness
and death~of. Angelo p. Curto, President of the C.P.F. Land Corp-
oration. The Planning Board informed Mr. Fusaro that this sub-
division ~s not on the approved list of subdivisions in the
Amendments to the Zoning Ordinance, therefore the ~o~ts~in.this
subdivision will have to be ~ncreased to 40,000 sq. ft. of area.
The Planning Board will, however, grant ~ six (6)month extension
of time in order to complete the roads in this subdivision accord-
to the specifications for which they were bonded.
On motion by Mr. Coyle, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning Board grant a
six (6) ~month extension of the performance bond ~n order to
complete the roads and other improvements in the subdivision
"Blue Horizons, Section I", located at Peconic, N.Y. ~his
extension shall be granted from February 7, 1972 until August
7, 1972."
This subdivision is not on the approved list in the Zoning
Ordinance. ~he lots in thi$~subdivision are sub'standard and
will have to be increased to meet the new requirements of the
Town, as well as the Health Dept., which is 40,000 sq. ft. of
area per lot.

Attorney & David M. Daly, Attorney appeared before the Planninq
Board in regard to the status of the roads in their subdivisio~
"Town Harbor Terrace", located at Southold, N.Y. Mr. Hoey
stated that the roads have been roughed in by Schroeder and
Van Tuyt put the stakes in, but their problem has been trying
to get a contractor to do the work. The Planning Board advised
them that this subdivision is not on the approved list in the
Zoning Ordinance, therefore, the lots will have to be increased
to 40,000 sq. ft. of area. Mrs. Hoey stated that this would be
satisfactory to them becuase it was their original intention to
sell two (2) lots jointly with a restriction to build one house
on them. However, Mrs. Hoey said that they would like to sell
the lots on the creek as is. There are existing water mains on
T~wn Harbor Lane. The Planning Board advisedtthem that in order
to keep the lots on the. creek as is, they would have to obtain
a variance from the Board of Appeals.
On motion by Mr. Wickham, seconded by Mr. Moisa, it was
RESOLVED that the SoUthold Town Planning Board grant a
six (6) month extension of the performance bond in order to
complete the roads and other improvements in the subdivision
"Town Harbor Terrace", located at Southold, N.Y. This exten-
sion shall be effective from February 7, 1972 until August
7, 1972.
This subdivision is not on the approved list in the
Zoning Ordinance, therefore the lots in this subdivision
are sub-standard and will have to be increased in area or
combined to meet the new requirements of the Town, as well
as the Health Dept., which is 40,000 sq. ft. of area per
lot.

Kurt Hambseh, Vice-President of South Fork Development
Corporation and Eugene Francolini, Attorney, appeared before
the Planning Board in regard to the status of the roads in the
subdivision "Corey Creek Estates", located at Southold, N.Y.
The Chairman read the Planning Board's letter of January 18,
1972 to South Fork Development Corp. Mr. Francolini presented
the Planning Board with a letter from H.S. Roberts, Inc.
(Contractors) stating that the unfinished work in this sub-
division will be completed by!them as soon as the weather
permits. The work to be completed is as follows: Sweep sand
that has been placed on 1st coat of oil. Apply .5 gallon
per square yard of RC - 2 Asphalt Cutback and cover with
3/8" stone and roll. Additional curb to be placed as directed
by Town Engineer. Mr. Francolini stated that they have an
extension of the bond coverage until June 22, 1972 and requested
that the Planning Board grant them an extension of the performance

bond until that time.
On motion by Mr. Raynor, seconded by Mr. Wickham, it was
RESOLVED that the Southold Town Planning Board grant an
extension of the performance bond in order to complete the
roads and other improvements in the subdivision "Corey Creek
Estates", located at S/S Bayview Road, Southold, New York.
This extension shall be effective from February 7, 1972
until June 22, 1972 - the expiration date of the bond coverage.

~ache Bleecker appeared before the Planning Board in regard
to the status of the roads in his subdivision "Willow Point",
located at SOuthold, N.Y. The Chairman read the report of the
Inspection Engineer, Chas. Abrahams dated January 17, 1972. Mr.
Abrahams submitted the following report:- (1.) The highway
Section on Budd's Pond Road, does not appear to be centered in
the bounds of the highway. At lot 6 there is a monument located
18 feet north of the highway section and directly opposite on
lot 15 there is a monument located only 3 feet south of the road
section. (2.) At.lots 6 & 15 on Budd's Pond Road, the shoulder
area has not been graded down to a slope of 1 on 24 (3.) There
a~e no mOnumSnts on the turnaround on Budd's Pond Road. Mr.
Bleecker submitted a survey dated February 4, 1972 showing the
location of the paved surface of Budd's Pond Road. The Planning
Board agreed to send a recommendation to the Supt. of Highways
to waiver the requirement that the road be centered in the bounds
of the highway.
On motion by Mr. Coy!e, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board grant a
six (6) month extension of time in o~der to complete the roads
and other improvements in the subdivision "WillOw Point",
located at SSS Main Road add E/S B~y Home~ Road, Southold, N~Y.
This extension shall be ~ffective from February 7, 1972 until
August 7, 1972.

Coyle.
On motion by Mr. Wickham, seconded by Mr. Moisa, it was

RESOLVED that the Southold Town Planning Board recommend
to the Superintendent of Highways that the requirement for the
road to be centered in the bounds of the highway be waivered
in the subdivision "Willow Point" located off south side of
Main Road and east side of Bay Home Road, Southold, New York.
It appears that the road was laid out in the wrong
position and we feel that there would be no need of the
additional time consuming effort and expense to re-locate
the road as it is only a local traffic street.

The Planning Board was presented with a letter received
from Bernard Kaplan Dawn Estates, developers of "Cleaves
Point, Section III" Mr. Kaplan acknowledged receipt of the
Planning Board's letter of January 18, 1972. He stated theft
he will be out of town during the months of February and March
and requested an extension of time in which to meet with the
Planning Board. Mr. Kaplan stated that he would be available
anytime during the month of April and asked the Planning Board
to inform his office of the time and date on which to appear
before the Planning Board. The Planning Board instructed
that a letter be sent to Mr. Kaplan's office advising him to
contact the Planning Board office upon his return so that
arrangements can be made for him to appear before the Board
in re~rd to his subdivision "Cleaves Point, Section"III.
The Planning Board was pres~ed with letter, dated
January 24~ 1972, received from Lefferts P. Edson, Attorney
a/c ~rank Sturm in reference to "Eastern Shores, S~otionV''
Subject letter contained the following statements: "The
roads s~own on the map of Section V have not yet been ~edi-
c~ted to the Town of Southold as public highways be~ausle the
present assessment values of construe%ion thereon dO not
qualify for the dedication. The roads s~own on the map of
Section~V were constructed prior to the approval of the map
by the Town Board an~ prior to the signing of the map by the
Planning Board. This was done in order to avoid the necessity
of obtaining a bond for the construction. Mr? Sturm states
that prior to the approval of the map by the Town Board and
the signing of it by the Planning Board, approval of the
road construction was obtained after he initiated the ex-
amination of the roads by talking to the Superintendent of
Highways." The Planning Board instructed that the following
letter be sent to Mr. Sturm:

Dear Sir:
The Planning Board received a letter from your attorney
Lefferts P. Edson, on date of January 24, 1972, in reference
to your subdivision "Eastern Shores, SEction V", at their
meeting held on February 7, 1972.
Please be advised that we have no records of these roads
ever being approved by any of the Town departments. It appears
that these roads are deteriorating and we feel that they cannot
be considered as approved access for very much longer. It is
our opinion that these roads will be impassable by spring. When
this occurs, the Building Inspector will be instructed not to
issue any building permits in this subdivision.

The Planning Board was presented with letter received from
Walter Uhl - Woodhollow Properties, Inc., on date of January 28,
1972, in reference to his subdivision "Orient-By-The-Sea, Section
II" This subdivision is not on the approved list of subdivisions
in the Zoning Ordinance. The Planning Board instructed that the
following letter be sent to Mr. Uhl:-

Dear Mr. Uhl:
Your letter of January 28, 1972 was received by the
Planning Board at their meeting held on February 7, 1972.
The fact that the performance bond on the highways in
this subdivision was waivered is no reason for you to neglect
the highways. It is the feeling of this Board that in view

of the factthat none of the highways are in even passable
condition, it is obvious that the Building Inspector should
not grant any building permits, there being no approved
access. Also please be advised that your subdivision is
not on the approved list of subdivision in the Zoning Ordinance.
Please contact the Planning Board office upon your
return from your trip so that arrangements can be made for
you to attend our Planning Board meeting in March.

Alvah Goldsmith of the Southold Town Trustees appeared
before the Planning Board to inquire if the property located
at the S/W drain off Richmond Creek @ E/S Indian Neck Lane,
Peconic, N.Y. would be considered as ~wetlands. This would
be part of the minor subdivision of Richard Cron and part of
property owned by Gertrude Duchow. The Planning Board in-
formed Mr. Goldsmith that this property would be considered
as wetlands.
Michael Zukas appeared before the Planning Board in
reference to his proposed minor subdivision located at N/S
Bayview Road, Southold, N.Y. This proposed minor subdivision
contains 5 lots of approximately 1/25 acre to which the
Planning Board granted tentative approval on March 10, 1969.
However, the applicant never submitted final maps or applied
for final approval. On December 20, 1971, Mr. Zukas appeared
before the Planning Board to request final approval. At this
time the Board informed him that he must have 40,000 sq. ft.
of area per lot or possibly apply to the Board of Appeals for
a variance. Since that date, Mr. Zukas has consulted the
Board of Appeals. The Board of Appeals advised him that if
the Planning Board would grant him final approval on the
minor subdivision map, as shown on survey dated March 10, 1969,
the Board of Appeals would then have grounds to grant him a
variance for insufficient lot area.
On motion by Mr. Coyle, seconded by Mr. Moisa, it was
RESOLVED that the Southold Town Planning Board grant
final approval to the proposed minor subdivision of Michael
Zukas, property located at N/$ B~¥view Road, Southold, N.Y.,

as shown on survey dated March 10, 1969 by Otto Van T~yl,
subject to presentation of the following:
1. Three (3) copies of final map.
2. Two (2) copies of formal appIication.
3. Application fee of $50.00
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,

The PlanningBoard was presented with letter from the
Superintendent of Highways, Raymond Dean. In this letter
Mr. Dean stated that he and Larry Tuthill have several
suggestions for new Highway Requirements, to the following
effect:
1. Ail major and minor subdivisions adjacent to existing
Town Roads shall meet the following conditions:

If the Town road is not 50' in width, 1/2 of the
additional width necessary to achieve such a width
shall be dedicated to the Town by the Subdivider
from his property.
b. Curbs shall be required and placed in accordance
with the Highway Specifications.

The unpaved area between %he curb and the existing
pavement of the Town roads shall be paved in accor-
dance with the Highway Specifications. The Subdi-
vider shall be responsible for maintenance of traffic
on Town roads and shall be required to submit a plan
for such operations to the Supt. of Highways at least
2 weeks before such operations are to commence.
Additional drainage facilities will be required to
the extent than an equivalent of 2 drainage rings
4' high and 8' in diameter for each acre adjacent
to the Town roads shall be placed in accordance with
the highway Specifications.
e. A seperate performance bond for this work shall be
required.
The Planning Board reviewed these suggestions and instructed
that a letter be sent to Mr. Dean stating that the Planning Board
is in general agreement with him, however, we submit the following
recommendations for minor changes in wording:-

If the Town road is not 50' in width, 1/2 of the

on each side of the road.
Curbs shall be required on the Town Highway and
placed in accordance with the Highway Specifications.
Add - Area between curb and property line shall be
properly graded and seeded.
Additional drainage facilities will be required up to
the extent that an equivalent of 2 drainage rings 4'
high and 8' in diameter for each acre adjacent to the
Town roads shall be placed in accordance with the High-
way Specifications or as required by the Town Engineer
and Town Board , excepting over 5% slopes facing the
highway.
The Planning Board was presented with recommendation
from the-Superintendent of Highways, dated January 25, 1972,
recommending the release of the performance bond on the sub-
division "Northwoods Estates", located at E/S Cox Lane,
Cutchogue, N.Y., owned and developed by Northville Construction
Co. Copy of report by Inspection Engineer, Chas. Abrahams
was attached.
On motion by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board recommend
to the Southold Town Board, the release of the performance
bond on the subdivision "Northwoods Estates", located at
E/S Cox Lane, Cutchogue, New York, owned and developed by
Northville Construction Co.
The above recommendation is made with regard to the
favorable recommendation from the Supt. of Highways and
report of the Inspection Engineer, Charles Abrahams.
Subject performance bond in the form of:- Passbook # 17-13862
issued by Security National Bank, Riverhead, in account with
Daniel Hallock, in the amount of $3,600.00 - at Supv. Office.

The. Planning Board was presented with the following
proposed "Amendments to the Building Zone Ordinance and
Building Zone Maps of the Town of Southold" (amendments
made on Town Board's own motion), as transmitted to them
by the Southold Town Board on November 29, 1971:
I. By changing from "A" Residential and Agricultural
District to "C" Light Industrial District the following
described property, to wit:
2Premises at New Suffolk in the Town of Southold being
all that ladd~south of JaCkson Street and east of First
Street to the ordinary high water mark of Cutchogue
Harbor excepting, however, so much of said premises as
is presently within the "C" Light Industrial District.
The Planning Board discussed this proposed change of zone.
On motion by Mr. Moisa, seconded by Mr. Coyle, it was
RESOLVED that the Southold Town Planning Board recommend
favorably to the Southold Town Board the change of zone from
"A" Residential and Agricultural District to "C" Light In-
dustrial District on the above described property.
This has been industrial property since before the
enactment of the Zoning Ordinance, and it is the opinion
of the Planning Board that it should remain as such."

II~ By.~changing from "A" Residential and Agricultural
District to "B-l" General Business District the following
described property, to wit:
Ail that certain plot, piece, or parcel of land situate,
lying and being at Southold, in the Town of Southold
bounded and dsecribed as follows:
Beginning at the intersection of the westerly line of the
Main Road with the southerly line of Ackerly Pond Lane;
from said point of be~i~ing running southerly along said
westerly line of Main Road on a curve to the right having
a radius of 1110.92 feet, a distance of 344.34 feet; thence
still along said westerly line of Main Road South 27
degrees 33 minutes West 18.0 feet to land of Willow Hill
Cemetery; thence along Willow Hill Cemetery, North 52
degrees 29 minutes 50 seconds west 234.07 feet to the
southeasterly line of Lower Road; thence along said south-
easterly line, North 41 degrees 45 minutes East 144.48

The Planning Board discussed this proposed change of zone.
On motion by Mr. Raynor, seconded by Mr. Moisa, it was
"RESOLVED that the Southold Town Planning Board does not
recommend favorably to the Southold Town Board the change of
zone from "A" ~Residential and Agricultural District to "B-l"
General Business District on the above described property.
This is a very dangerous area - due to the topography of
the land. There is a curve in the Main Road (Route. 25), a
three (3) - way intersection, and generally blind intersection
from at least two directions. To zone this property business
would greatly enhance the danger. We feel that the change
granted on the old Zoning Map was a serious mistake, it should
not have been done."

III. By changing from "A" Residential and Agricultural
District to "B-l" General Bu~ness District the following
described property, to wit:
Ail that certain plot, piece, or parcel of land situate,
lying and being at Southold, in the Town of Southold,
bounded and dsecribed as follows:
Beginning at a point on the easterly line of Wells Avenue
200.03 feet southerly along said easterly line from Main

The Planning Board discussed this proposed change of zone.
On motion by Mr. Moisa, seconded by Mr. Raynor, it was

recommend favorably to the Southold Town Board the change of
zone from "A" Residential and Agricultural District to "B-i"
General Business District on the above described property.
In view of the fact that none of the Business District
property on the S/S of the Main Road is more than 200 ft. deep,
we fe~ that it would be a mistake to put a jog into the resi-
dential property unless a large area were to be included such
as the balance of the block to Mechanic Street. There has been
much objection to granting smngle property "fingers" into resi-
dential areas."

The Planning Board discussed th~s proposed amendment.
On motion by Mr. Wickham, seconded by Mr. Raynor, it was
RESOLVED that the Southold Town Planning Board does not
recommend favorably to the Southold Town Board the above amend-
ment as submitted.
The Southold Town Planning Board ddes, however, recommend
favorably to the Southold Town Board, the following modified
amendment:-
"Ail construction shall meet the requirements of the
Southold Town Housing Code and all other applicable
laws?, and no buildi~gshall be erected or added to
until a permit therefore has been issued by the
Building Inspector."
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle.
Henry Raynor stated that he has been checking into the
requirements of other townships for filing subdivision maps,
and finds that most other Towns have the following require-
ment:
"The lot lines on subdivision maps, as filed, cannot be

altered without permission from the Planning Board; and lots
must be sold as shown on the subdivision map."
The Planning Board was unanimously in favor of such a
requirement and instructed that a letter be sent to each of
the surveyors (Otto Van~Tuyl, Alden Young, & Robert Kart)
advising them of the new requirement.
This matter will be discussed further by the Planning
Board at their next meeting and provisions will be made for
incorporating this requirement into the "Subdivision Regulations."
On Motion by Mr. Moisa, secOnded by Mr. Coyle, it was
RESOLVED that the minutes of the Southold Town Planning
Board, dated January 17, 1972, be approved as submitted.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle.
On motion by Mr. Wickham, seconded by Mr. Raynor, it was
RESOLVED that the next regular meeting of the Southold
Town Planning Board be held at 7:30 P.M., Monday, February
28, L972, at the Town Office, Main Street, Southold, New York.
Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor,
Coyle.
