Y. 11971 PLANNING BOARD MEMBERS John WIckham, Chairman Henry MoTsa Alfred Grebe Henry Raynor Frank Coyle MINUTES SOUTHOLD TOWN PLANNING BOARD March 7, 1972 An executive meeting of the Southold Town Planning Board was held at 7:30 P.M., Tuesday, March 7, 1972, at the Town Office, Main Road, Southold, New York. There were present: Messrs: John Wickham, Chairman; Henry Moisa, Vice-Chairman; Henry Raynor; Frank ~Coyle~ Absent: Mr. Alfred Grebe (due to unfavorable weather conditions) Also present: Howard Terry, Building Inspector; and Raymond Dean, Superintendent of Highway~ The Planning Board was presented with revised preliminary maps for the proposed subdivision of F. W. Koehler & Sons, located at north side of Main (State) Road, Orient, New York. Southold Town Planning Board -2- March 7, 1972 Preliminary approval was granted to this subdivision by the Planning Board on November 22, 1971, as shown on map dated October 28, 1971. The revised maps, as presented, were dated December 1, 1971 and showed a revision of the road lay-out. The easterly connecting road was shifted northerly between lots 7 & 8. This map was taken up to the Suffolk County Planning Commission for an informal review. Charles Lind recommends that the entrance off the State Road be shifted 50 ft. easterly, at right angles to center line of State Road, and corners to be rounded off on 20 ft. radius. The required 100 ft. turn-around reservations, on the easterly connecting road, were not shown on this map. This 100 ft. reservation must be p~t back on the map. This map must be re-submitted to the Supt. of Highways for his approval of the road lay- out. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the proposed subdivision of F. W. Koehler & Sons, located at north side of Main (State) Road, Orient, N.Y., as shown on survey dated December 1, 1971 by Otto Van Tuy!, subject to the following conditions: 1. Presentation of revised maps as follows: ae Map to show 100 ft. turn-aronnd reservation at easterly connecting road. Entrance off State Road to be shifted 50 ft. easterly, at right angles to center line of State Road, and corners to be rounded off on 20ft~-~radius as recommended by the Suffolk County Planning Commission. 2. Approval of the road lay-out by the Supt. of Highways. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. The Planning Board was presented with three (3) copies of final map, two (2) copies of formal application, and application fee of $50. for the proposed minor subdivision of Michael Zukas, located at north side of Bayview Road, Southold, N.Y. The Planning Board granted final approval to this proposed minor subdivision on February 7, 1972 subject to receipt of above items. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant authorization to the Chairman to sign the final maps of the proposed mino~ subdivision of Michael Zukas, property located Southold Town Planning Board -3- March 7, 1972 at north side of Bayview Road, Southold, New York, survey dated March 10, 1969 by Otto Van Tuyl. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Rudolph L. Melk presented~the Planning Board with revised or corrected copy of site plan for proposed "Bohack Village"' as required by the Planning Board at their meeting of February 28, 1972. The original site~plan showed no provision for right- of-way on the westerly side of the property, the westerly side of property was shown in required plantings. After the right- of-way was provided for, 4,000 sq. ft. of the required area for plantings was lost. The corrected site plan, as presented by Mr. Melk, showed the right-of-way on the westerly side of the property and an additional 5,360sq. ft. of plantings. The additional 5,360 sq. ft. of plantings were added to the front area and islands were added immediately ~orth of this. Mr. Melk stated that a~t trees will be of s~stantial size and planted in con~unction with shrubs so as to makethe area' estatically attractive. Mr. Melk staten that the reason he did not show the right-of-way on the original site plan was~because it did not show on the survey. The ~urvey only indicated a dirt road which he did not know w~s a right-of-way. Mr. Melk sta~ed that they hope to open in the near future. The certificate of occupancy is ~hinging on approval of the water supply an~'?~eptic tanks by the Health Dept. Further discussion was held ~n~hs drainage at the westerly entrance off the State Road. The Chairman stated that our engineer has reported that there was water running out of this entrance onto the State Road in a torrent. Mr.~Melk said that the proposed grading has not been d~ne yet and the curbing has not been installed. He said that when these improvements are made there will be no probi~m$. The Chairman inquired as to what drainage standard was being used. Mr. Melk stated that their drainage standard is for 2'~ rainfall in 24 hours, and they have one well for each 5,000 sq. ft. of roof area. The Chairman stated that this is ~ufficient, however, he does not want to see any water standing in the parking area. Mr. Melk stated that he has done other projects with this drainage standard and never had a problem with water standinq in the parking area. The Chairman stated that t~e Planning Board's engineer is going to keep a close watch on the drainage, and if there are any problems, they will have to be corrected. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board grant approval to the revised or corrected site plan of "Bohack Village'~, as signed and dated by the Chairman at this meeting of March 7, 1972. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle, Southold Town Planning Board ~arch 7, 1972 The Planning Board was presented with '~Certificate of Abandonment",-together with certification 6f recording from the County Clerk's Office,. on the lots in Greenport Driving Park c~ntained on the minor subdivision map of Tendler & others, property located at E/S Ninth Street and S/S Brown Street, Greenport, New York. The Chairman read letter of December 21, 1971 sent to the owners of this minor subdivision by the Planning Board advising them that final apprpval was granted on ~ugust 16, 1971, subject to receiptcof certification of the recording of the Certificate of Abandonment from the Suffolk County Clerk's Office; and further advising them that this condition had not been met to date. The Planning Board inspected the final maps of this minor subdivision. These maps showed lot ~ 1 as the "Abandonment of Greenport Driving Park' - with lot lines and lot numbers. The Planning Board stated that they will require revised maps to be submitted to show lot ~ 1 without the map of Greenport Driving Park printed on it. Letter to be sent to Mr. Aur~chio advising him of the Plamning Board's requirement for revised maps. On motion by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board grant authorization to the Chairman to sign the final maps of the minor subdivision of Tendlers & others upon receipt of such revised maps showing lot ~ 1 without t~e map of Greenport Driving Park printed on it. Vote of the B~ard: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Raymond Dean, Superintendent of Highways was present at this. Planning Board meeting at 8:00 P.M. Further discussion was held on. the proposed subdivision of F. W. Koehler & Sons, located at N/S Main (State) Road, Orient, N.Y. ~r. Dean was pre'sented with a copy of the preliminary map for this proposed subdivision. Mr~ Dean statsd that there must b~ a 100 ft. turn- around on the easterly connecting road as previ~sl~ stated by the Board. The Planning Board advised Mr. Dean of %'he Suffolk County Planning Commission's rscommendation that the entrance off the S~ate Road be shifted 50 fe~t easterly, at right angles to ce~te~ line of th~ State ~oad, and that the corners be rounded off on 20 ft. radius. A discussion was held as to whether or not the recommendation for revision of the entrance as shown on the map was more !feasible. Mr~ Moisa was of the opinion that the entranc~ plan as shown on the map presented ~was more of a natural outlet rather than the County's recommendation. Mr. Dean agreed with Mr. Moisa, but questioned why the County made such a recommendation. He was informed that the County bases their recommendations on the State's requirements. If the County recommendation is not followe~, they will have'trouble getting a permit for a curb cut from $outhold Town Planning Board -5- ~rch 7, 1972 the State. Mr. Dean to send in his recommendations on this subdivision. The Planning Board discussed the proposed minor subdivision of Frank S~illo (formerly Peter Sledjeski), lo~ated off north side of Main (State) Road, Orient, N.Y. The Supt. of Highways was advised that Larry Tuthill has suggested that the connecting roads be built according to Town Specifications. The Supt. of Highways stated that he will recommend 50 ft. connecting roads parallel to the Sound, to be built to Town Specifications, and set back to connect to other subdivisions in the area. Mr. Dean to send recommendation to the Planning Board to the foregoing e~fect. The Planning Board and the Superintendent of Highways discussed the proposed major subdivision of Richard Young, located at north side of Eugene's Road, Cutchogue, New York. Mr. Dean reported that Mr. Young was in to see him. Mr. Dean said that Mr. Young told him that he plans to sell the east- erly parcel (outside of the subdivision) to the adjoining property owner, Mike Shepish. The Chairman stated that if he is g6i~g to sell this parcel to Mike Shepish, he must make a deal with him for another access road either on Bay Avenue or Eugene's Road. After further discussion, it was decided that the best location for another access road would be on Eugene's Road, to be located between lots 14 & 15, and 21 & 22, immediately east of the little house outside the subdivision. Mr. Dean to send in his recommendations on this subdivision. A lengthly discussion was ~eld by the Planning Board and the Supt. of Highways in regard to new highway speci- fications. The Chairman read Mr. Dean's recommendations as dated February 4th; and the Planning Board's letter of February 8th containing their recommendations and additions for revisions. Mr. Dean stated %hat he doesn't approve of minor subdivisions. He said %hat developers should not be allowed to run a dirt road through 4 or 5 lotS, they should be required to construct town roads. The Planning Board was also of the opinion that town roads should be required in minor subdivisions, except in real hardship cases. The Chairman s~ted that he also feels that we are getting too many minor subdivisions, but by the same token it is better to have minor subdivisions, than to build on the road frontage and leave the interior property vacant. The Chairman suggested that we require any road in a minor subdivision which is 500 ft. Southold Town Planning Board -6- ~arch 7, 1972 or mo~e in length to be paved. Mr. Dean said that 500 ft. is too l~ni~nt, 250 ft. would be more reasonable. The Planning Board advised Mr. Dean that before any definite plans are made to amend our subdivision regulations, they would like Mr. Dean to ~iscuss this matter with the Town Board. The Chairman suggested that this requirement to build Town Roads in minor subdivisions should be tied in with some sort of commitment with the Town Board to accept roads more efficiently, especi- ally if minor subdivision roads are built to Town Specifications. The Planning Board was presented with a recommendation from the Superintendent of Highways for release of performance bond on the subdivision "Jackson's Landing", located at West Mill Road, Mattituck, New York. On motion by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board, the release of the performance bond on the subdivision "Jackson's Landing", located at West Mill Road, Mattituck, New York, owned and developed by Jackson's Landing, Inc. - John E. Hurley, Sec.-Treas. The above recommendation is made with regard to the favorable recommendation from the Supt. of Highways. Subject performance bond in the form of:- Bond No. SU 4462 issued by the Utica Mutual Insurance Company in the amount of $26,500. file @ Town Clerk's 8~ffce. The Southold Town Planning Board received from the Southo~d Town Board the amended petition of Philip W. Abatelli, Cutchogue, New York, relative to change of zone from "A" Resi- dential and Agricultural District to "B-i" General Business District on certain property situated at S/S Main Read, Cutchogue, New York, together with the instructions to p~epare an official report defining the conditions contained therein. This property is situated at Cutchogue, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: BEGINNING at a monument on the southerly side of Main Road distant 136.14 feet easterly from Eugene's Road Continuing thence to a monument 90 feet along Main Road on a bearing North 42 degrees 12 minutes East Thence on a bearing South 50 degrees ~ minutes East a distance of 121 feet to a monument Thence on a bearing South 42 degrees 12 minutes West a distance of 90 feet to a monument Thence on a bearing North 50 degrees 34 minutes West a distance of 121 feet to a monument at the point of BEGINNING. The Planning Board discussed this proposed change of z~e application. On motion by Mr. Moisa, seconded by Mr. Coyle, it was RESOLVED that the Southold Town Planning Board recommend favorably to the Southotd Town Board the change of zone from "A" Residential and Agricultural District to "B-i" General Business District on the above described property. This proposed change of zone would complete the business zoning within the perimeter of the lot. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. This amended proposed change of zone application is to be referred to the Suffolk County Dept. of Planning for their determination. This property is situated at Mattituck, in the Town of Southold, County of Suffolk, New York, and more particularly bounded and described as follows: NORTH L.I.R.R. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board does not recommend favorably to the Southold Town Board the change of zone from "A" Residential and Agricultural District to "C" Light Industrial District on the above described property. It is the opinion of the Planning Board that this property is located too close to the cemetery, it is not well shaped for a business property, and it does not conform with the Town Master Plan. It is the feeling of the Planning Board that the present non-conforming use should be continued as is. On motion by Mr. Wickham, seconded By Mr~ Raynor, it was RESOLVED that the Southold Town Planning Board does not recommend favorably to the Southold Town Board the change of zone from "A" Residential and Agricultural District to ~'B~i" General Business District on the above described property, because of the following reasons: 1. It would constitute the unwarranted perpetuation of strip commercial development along Route 25; 2. It would tend to establish a precedent for further down'zonings in the locale and along the s~a~e roadway detrimentatl%o the safety and traffic carrying capacity of said facility. 3. It is not ~hRsistent with the Town Master Plan which designates this area for surburban density residence development; 4. The Town Master Plan does not recommend commercial ribbon development along Route 25; 5. There does not appear to be any demonstratabte need for additional commercial develop~.t in the locale. Staples, Greenport, New York, relative to change of zone from "A" Residential and Agricultural District to "B-l" General Business District on certain property situated at~ S/W-corner of Wilmarth Avenue & Main Street, Map of Wash- ington Heights, Lots 3, 4, & 5, Greenport, New York, together with the instructions to prepare an official report defining the conditions contained therein. This property is situated at Greenport, in the Town of Southold, County of Suffolk, New York, and more part- icularly bounded and described as follows: "Lots 3, 4, & 5 on Map of-Washington Heights, situate at Greenport, Suffolk County, New York, made by Otto Van Tuyl and dated December 8, 1927 and filed December 29, 1927 as~ file numbar 651 in the Office of the Clerk of Suffolk County. Being 198.52 feet on Wilmarth Avenue; 115.73 feet on Main Street; 211 feet on the South and 115 feet on the West. The Planning Board discussed this proposed change of zone application. On motion by Mr. Coyle, seconded by Mr. Moisa, it was RES©LVED that the Southold Town Planning Board recommend favorably to tke Sou~hold Town Board the change of zone from "A" Residential and.Agricultural District to "B-t" General Business District on the above described property. Vote of the Board: Ayes:- Messrs: Wickha~]~ Moisa, Coyle. Mr. Henry'Raynor abstained from voting. This proposed change of zone application is to be referred to the Suffolk County Dept. of Planning for their determination. Southold Town Planning Board -12- ~arch 7, 1972 As requested by the Planning Board at their last meeting, and pursuant to Article XIV, Section 1400 - C-3 of the Zoning Ordinance, Howard Terry presented the Planning Board with the report of his review of the proposed plot plan of "Bayview Development Corp." for modular apartments on property located at S/S Bayview Road, Southold, New York. The Chairman read the report.~ The Planning Board d~cussed this proposed plot plan at some length. On motion by Mr. Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Planning Board send a letter to the Bayview Development Corp. advising them of the following: (1) There is about 304,926 sq. ft. of area in the "M-l" district which will permit 33.8 dwelling units without both public water and public sewer, or 46.8 dwelling units with both water and sewer. (2) There is about.48,000 sq. ft. of area in the "A" district (200 ft. from Bayview Road tc the M-l" district line) which cannot be counted for area in the multiple resi- dence project and through which no access should be approved without a variance from the Board of Appeals~ (3) There is not enough seperation between some of the buildings. Article V, Section 502 - No building shall exceed 125 feet in length. The minimum distance between principal buildings shall be equal to two times the height of the high- est building, and the minimum distance between a principal and an accessory building shall be twenty (20) feet. Any inner court shall have a minimum dimension of sixty (60) feet and any outer court shall have a minimum dimension of twenty (20) feet and its depth shall not exceed its width. (4) The plot plan must show both 5 ft. elevations or contours, and all wetlands area subject to tidal floodings. (5) The plot plan must also show water and sewer lines, and all interior paths and sidewalks. (6) There is a review fee due of $25. This list is not to be construed as final determination. This is only a list of additional information needed by the Planning Board immediatelY. Vote of the Board: Ayes:- Messrs: Wickham, Moisa, Raynor, Coyle. Southold Town Planning Board -13 ~arch 7, 1972 The Planning Board was presented with letter from the Department of the Army, dated February 29, 1972, and-question- naire in reference to "L.I. Sound Regional Study Shoreline Erosion Information." The Planning Board feels that this is a very serious problem which concerns us because we have so much shoreline in Southold Town. The Planning Board instructed that a letter be sent to the Town Board requesting authori- zation to have Lawrence Tuthill P.E. do a study on it. Letter also to be sent to the Soil & Water Conservation District requesting their assistance on the study. The Planning Board was presented with unfavorable determination fromtthe Suffolk County Planning Commission on the proposed change of zone from "A" Residential and Agricultural Distric~ to "B-l" General Business District on parcel situated 200 ft. south of Main Road abutting Wells Avenue, Southold, N.Y. (Item ~ 3 of the Town Board's Amendments to the Zoning Ordinance.) SubjeQt determination placed in file. The Planning Board received and placed on file, the 1972 list of County Maintained Roads from the Suffolk County Department of Public Works. The Chairman said that he would like to recommend, sometime in the future, that New Suffolk Lane be turned over to the Town. · he Planning Board received and placed on file, the minutes of the Southold Town Trustees meetings, dated February 2, 1972 and March 6, 1972. The Chairman reported that he spoke with the County Planning Commission on the telephone in re~ard to the Annexation of Greenport Village. The County informed him that they will not step in because there is no change of zone involved at this time. The fact that the density allowed in the Greenport Village "A" zone is greater is beside the point. They will not take any part in it, they will not review it. The Chairman said that he also spoke with HW Davids of the Dept. of Environmental SanitatiOn - Health Dept. He is interested and willing to help, but Southold Town~lanning Board March 7, 1972 feels that there is nothing he can do becamse of the fact that the point that the Greenport Water Plan% is op~ting the well fields in Southold has been eliminated. He is not able to say with any justification that they are taking our water, and he cannot make an issue of it without any justi~ fication. The Chairman said that the one strong point that the Town may have is the fact that the'Greenport Sewer Plant is in violation of the Federal & State requirements because they are dumping improperly treated raw sewerage into the Sound. The Chairman said that he spoke with the New York Dept. of Environmental Conservation. They suggested that we send them a statement of our legal objections. This will be the only strong.point that the Town may have in objecting to the proposed Annexation to~Greenport Village. Henry Raynor has been doing some research in regard to possibilities for legal Town objections. Mr.. Raynor read some excerpts from ,McKinneys Consolidated Laws of New York", Book 23, General Municipal Laws, Sections 200 to End." A len~thly discussion was held by the Planning Board in regard to possible objections. On motion by Mr. Wickham, seconded by Mr. Moisa, it w~s RESOLVED that the Southold. Town Planning Board appoint Henry Raynor to do further research on this.matter and sub- mit a report to the Planning Boar~ at their next meeting on March 21, 1972. Frank Coyle was appointed to assist Mr. Raynor'by reviewing such report. Vote of the Board; Ayes:- Messrs: Wickham, Moist, Raynor, Coyle.
