Y, 119~1 M I NUT E'S SOUTHOLD TOWN PLANNING BOARD June 6, 1972 A ~egular meeting of the Southold Town Planning Board was held at 7:30 P.M., Tuesday, June 6, 1972, at the Town Office, Main Road, Southold, New York. There were present: Messes: John Wickham, Chairman; Henry'Moi.sa, Vic~ Chairman; Alfred Grebe; Henry Raynor; Frank Coyle. AlSo present: Howard T~rry, Building Inspector. The Southold Town Plannin.g Board and Mr. Bob Gillispie discussed a proposed subdivision on 20 acres at orient, New York, owned by Leonard Gordon and Herbert Hamburger. Southold Town Planning Board - 2 June 6, 1972 The Chairman stated that in many cases a request for a minor subdivision with lots of two acres or more are, in effect, an evasion of the major subdivision regulations, so we want to proceed carefully and we often invariably insist that the property owner present a recordable instrument meeting the approval of the Town Attorney insuring that the lots will never be re-sUbdivided. Mr~ Gillispie said he was aware of that requirement and discussed it with the owners and they are perfectly willing to make such a restrictive instrument. Mr. Giltisple'said there were two existing homes on the property. The Chairman said then there appears to be seven lots, not five. The Chairman suggested that Mr. Gillispie leave the map with the Board to talk over some possibili~ties with the Town Attorney. As far as the Board is concerned there are some possibilities which we would like to investigate; namely having the Town Board amend the Ordinance in order to provide for lots of more than one acre or possibly more than three, acres in minor subdivisions, and this being a case in point we want to move slowly and see what the Town Attorney s~ys. Something will have to be done about the two dwellings. As it~stands you actually have seven lots by our definitions. I am generally familar with the property but I want to look at it again and I am sure the other members would, too. The Chairman asked if this was a private road that had been in use for some 30 or 40 years; his thinking being that if we are talking about a highway to run further east, is this the best way to enter it or can we enter back further west. Mr. Moisa said right now, as the situation presents itself, this is the best way. Mr. Gillispie thanked the Board and left the map with them. The Planning Board discussed the subdivision known as Petty's Bite,~.located at Orient~, New York, with iDominic Au~ichi0, Esq,, an~Dr. George NeWman. The Chairman ~aid that the minutes of the last ~eet~ng show what m~S~i, be ~0ne ~fer the map to be accepted. ~r~ NeWman asked if ~it was his understanding that i~ the m~P. were changed as shown it w~tL ~e approved. The Chairman said as far.as we can see this is the only thing you have to do. This is not a major undertaking and the Board felt that these were reasonable changes. AS far as we are concerned it is a clear cut case now. There is a sligh~ difference in angle in the lot lines and the intersection is to be changed. Dr. NeWman thanked the ~Oard and said this would be done. Southold Town P~anning Board June 6, 1972 The Southold Town Planning Board and Mr. Bob Krupski discussed a proposed subdivision on Bridge Lane, Peconic, New York, owned by Isidere P. Krupski. Mr. Krupski stated that the subdivision is on Bridge Lane and has 20 lots. Most of the lots are over 40,000 square feet and the tO~&l acreage is 20.359 acres. The Chairman asked how wide Bridge Lane was. Mr. Terry stated generally i~ was 50 feet but a couple of spots in .the old section might be less. Mr. Raynor asked if Mr. Krupski held any additional property across the road. Mr. Krupski sai~ no, this was all the property. The Board and Mr. Krupski discussed owners of adjoining property. Mr. Raynor asked Mr. Krupski if he had given any thought to park and play ground area. Mr. Krupski said that would be up to his father. Mr~ Moisa said the best place is next to the Long Island Railroad but that was not a safe spot for a play ground. The Chairman told Mr. Krupski that the Town Attorney will not allow us to take cash in lieu of park and play ground area. We either have to require it or waive it. There is no i~between. The Chairman asked Mr. Krupski to leave the map with the Board to allow time to loOk it over and see what can be done. There was a problem about someone who wanted to b~itd. Mr. Krupski said tha~ they have already built. The Chairmani said that we usually include hhat in the subdivision and give the inspector the green light for a building permit. Mr. Raynor asked if Bridge Lane~had telephone poles Mr. Krupski said yes and that the Long Island Lighting Company had told an adjacent property owner that LILCO would run 500 feet free to his property. The Chairman said the Board must advise Mr. Krupski that after June 30, 1972, LILCO is under a directive to put underground service in all subdivisions. Mr. Krupski said he knows this and if they must put~.in underground service they would. The Chairman said they would l®ok at the map and come to some sort of conclusion on Parkland Play Ground requirements. Mr. Krupski asked what is the procedure for the map now. The Chairman said the Board wants to look at the property and come to some conclusion on Park and Play GroUnd requirements and after that you have to have test borings and a Department of Health certificate. Mr. Terry stated it must be endorsed by both the County Departments of Environmental Control and Health. The Chairman said the Boar~ w~uld get in touch=with Mr. Krupski within a month and probably earlier. Mr~ Krupski thanked the Boaad. The Sou~hoTd Town Planning Board received from the Southold T~wn~Board the original petition of Bayview Development Corp~, Southold, New York, relative to change of zone f~om "A" Residential'and Agricultural District to "M-l" Multiple Residence District on certain real property situated at Southold Town P~nning Board June 6, 1972 Bayview Road, Southold, New York, together with instructions to prepare an official report defining the conditions contained therein. This property is situated at Bayview in the Town of Southold, ~ounty of Suffolk, New York, and more particularly bounded amd described as follows: N - ~ayview Road E - William Victoria and James Bitses S Corey Creek W - A. & F. Koke Mr. Terry stated that they wanted to change a piece of a 200 foot strip between Bayview Road and the M zone on the end. A plot plan was submitted but was off and they submitted a corrected plot plan for what is now the M-1 zone. The Chairman said he was not particularly enthusiastic about putting a~ M-1 zone all the way out to the highway. Mr. Raynor asked where the letter was from the Suffolk County Health Department approving sewage. Mr. Terry said you don't get a letter from the Health Department; they just stamp the map. Mr. Raynor said he would like to have someone from the County Health Department come down and tell us more. The Chairman said a letter would be written to Mr. Villa to ask him to attend next meeting on June 20, 1972, at 7:30 P.M. On motion of Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board denial of the petition for change of zone from "A" Residential and Agricultural District to "M-l" Multiple Residence District on the above described property. The property is located in an improper place for a large multiple residence. Vote of the Board: Ayes: Grebe, Coyle. Messrs: Wickham, Moisa, Raynor, The Planning Board next discussed the proposed subdivision owned by Mr~ Valentine Ruch, Southold, New York. The Chairman said the~map had been made April 29, 1971 and revised May 31, 1972. They have public water bUt no public sewers. On motion of Mr. Raynor, seconded by Mr. Grebe, it was Southo~d Town Planning Board - 5 - June 6, 1972 RESOLVED to disapprove the proposed subdivision of Valentine Ruch, Southold, New York on the basis that nearly one-third of the property is meadow land and since the County will not allow cesspools below the seven foot contour two of the lots would be unbu~dable. Vote of the Board: Ayes: - Messrs: Wickham, Moisa, Raynor, Coyle, Grebe. The Planning Board discussed the property owned by Creighton W. Phillips, Jr., and hi~ wife, located at Nassau Point, Southold Town, New York. Mr. Terry said Mr. Creighton wants to split the property and put two houses on it. Mr. Moisa asked if it had to go to the Board of Appeals. Mr. Terry said it was a filed map. On motion of Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the request of Creighton W. Phillips, Jr., and his wife, Dorothy A. Phillips, to split their property to put two dwellings on it be denied because the lot is too small. Vote of the Board: Ayes: Coyle, Grebe. Messrs: Wickham, Moisa, Raynor, The Chairman directed the Secretary to write to F~oehlich & Mahoney, Esqs., to attend the next meeting 'of the Planning Board on June 20, 1972, at 7:30 P.M. Mr. Terry said he has maps of the Village of Greenport Water System. Southo~d Town Planning Board - 6 - June 6, 1972 The Planning Board received the following letters from Eugene Francolini, E~q., with reference to Corey Creek Estates: Dear Mr. Wickham: June 5, 1972 I have in my possession a signed statement from Raymond Dean, Superintendent of Highways, that the work relative to the above mentioned subdivision has been completed pursuant to Southold Town specifications. As I understand it, it is now possible for the developer, namely, South Fork Development Corp., to be released from its performance bond. Under the circumstances, would appreciate your returning the performance bond, together with any additional papers which will be required by the insurance company, thereby enabling the developer to be released under the terms of said bond. Very truly yours, Eugene R. Francolini Attached to that letter was a copy of a letter Mr. Francolini had written to H. S. Roberts, Inc., Robert Avenue, Westhampton Beach, New York, 11978; it reads as follows: Dear Mr. Roberts: June 1, 1972 Re: Corey Creek Estates This will acknowledge receipt of your final statment relative to the above mentioned subdivision. I have been requested to have you forward ~e a letter from the Superintendent of Highways of the Town of Southold, indicating that the work performed by you within said subdivision complies with the Town specifications. Upon receipt of said letter, I shal~ see to it that your bill is paid forthwith. In the event you have any questions, please do not hesitate to contact me. Very truly yours, Eugene R. Francolini cc: John Wickham, Chmn. Southold Town Planning Board Mr. Terry said Raymond Dean apparently has sent Mr. Francol~Ri a letter that it is OK, but we have no copy of it. Mr. Terry told Mr. Dean's office that the Planning Board will need a copy of his letter before any recommendation is made to release the bond. Southold Town Planning Board - 7 - June 6, 1972 The Planning Board discussed proposed minor subdivision owned by John P. Gaillard on Fishers Island, New York. Mr. Terry said this subdivision was approved and he was to submit final maps for signature. On motion of Mr. Grebe, seconded by Mr. Moisa, it was RESOLVED to approve the minor subdivision of John P. Gaillard locatedaat Fishers Island, New York. Vote of the Board: Ayes:-Messrs: Wickham, Moisa, Raynor Coyly, Grebe. The Planning Board~received a letter from the Village of Greenport dated May 31, 1972; it reads as fellows: Dear Mr. Wickham: The standard agreement between Mr. Valentine Ruch and the Village of Greenport to supply water to a development called "Shorecrest", Ashamomaque was signed by all parties and approved at the Village Board Meeting of May 30, 1972. ] The agreement is on file with the Village Clerk, 236 Third Street, Greenport and follows the map prepared by Van Tuyl and Son. Monsell Superintendent of Public Utilities The Planning Board received a letter from Joseph P~ Hoey, dated May 4, 1972, with regards to Town Harbor Terrace, Southold, New York. It reads as follows: Southold Town Planning Board - 8 - June 6, 1972 Dear Mr. Wickham: The work on the roads in the above subdivision has been started by Mr. Irving C. Latham. I examined the cleared property last weekend and became rather apprehensive about the fact that the plans call for 2400 feet of curbing. It appears that if all the curbing were entered that it would not be possible to enter upon any of the existing properties which would front upon this new roadway. In view of this, I request the approval for this roadway be amended and that curbing be required only at the intersections. In this way it will be possible for the families presently living on this roadway to enter upon their property without having ~o cross the curbing or to have the curbing broken so that they could enter their property. I would appreciate a favorable action upon this request. A copy of this letter is being sent to the Hon. Raymond Dean, the Superintendent of Highways. Raymond Dean Town Highway Commissioner Peconic, New York The Chairman said a letter would be sent to Mr. Hoey stating that the curbing is covered by bond and we feel it should be installed. Under some conditions the Town Highway Superintendent and the Highway Committee of the Town Board have the right to waive these requirements. To date we have not heard from the Highway Department regarding this matter. A copy of this letter is to be sent to Raymond Dean, Superin- tendent of Highways On motion of Mr. Coyle, seconded by Mr. Grebe it was RESOLVED that the minutes of the April 3, 1972 meeting of the Southold Town Planning Board be approved.as submitted. Southold Town Planning Board - 9 - June 6, 1972 On motion of Mr. Gillispie, seconded by Mr. Coyle, it was RESOLVED that the minutes of the May 22, 1972 meeting of the Southold Town Planning Board be approved as corrected. Vote of the Board: Ayes: Raynor, Coy!e, Grebe. Messrs: Gillispie, Moisa, The Board reviewed a proposed drawing for standard residential driveway entrance submitted by Lawrence C. Tuthill, P.E., and Raymond C. Dean, Superintendent of Highways. A getter was received from the Tri State Regional Planning Commission announcing election of Richard A. Wiebe, Chairman. On motion of Mr. Gillispie, seconded by Mr. Raynor, it was RESOLVED that the next regular meeting of the Southcld Town Planning Board be held at 7:30 P.M., Tuesday, June 20, 1972, at the Town Office, Main Road, Southo~d, New York.
