SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A I4-14 to 23, and the Suffolk County Department of Planning issued its
reply dated February 25, 2011 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The
LWRP Coordinator issued his reply dated March 30, 2011, based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed construction of an in-ground swimming pool is CONSISTENT with LWRP
policy standards and therefore is CONSISTENT with the LWRP, regarding the existing Shed location in the side
yard, the proposed action is EXEMPT from Coastal Consistency Review.
PROPERTY FACTS/DESCRIPTION: The subject parcel is improved with a one story framed dwelling and
detached accessory shed. It contains 20,000 sq. ft. with 100.00 feet of frontage on Harbor Lights Dr., 200.00 feet
along the western property line, 100.00 feet along a creek or canal and 200.00 feet along the eastern property line
as shown on the survey prepared by Nathan Taft Corwin, III, LS. Dated last revised June 29, 2011.
BASIS OF APPLICATION: Request for Variances from Art. XXII Code Section 280-116 and section 280-15 and
the Building Inspector's January 19, 2011 Notice of Disapproval based on an application for building permit to
construct accessory in-ground swimming pool and existing shed at; 1) bulkhead setback of less than the code
required 75 feet for the pool, 2) location other than the code required rear yard for the shed.
RELIEF REQUESTED: The applicant proposes to construct an in-ground swimming pool setback 54.7 feet from
the existing bulkhead where the code requires 75 feet and to allow the existing shed to remain in the side yard
where the code requires a rear yard location.
AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity
with the code. The applicant on June 30, 2011 submitted a plan increasing the setback to 56.7 feet, bringing the
plan into more conformity with the codes.

ADDITIONAL INFORMATION: During the Public Hearing a neighbor's agent stated concerns for the bulkhead
setback. Subsequently, after speaking with the applicant and reviewing the revised plan the neighbor submitted a
letter dated June 9, 2011 in support of the amended application. This Board granted a variance under
application #4683 on May 5, 1999 for a 52 foot setback from the bulkhead to a neighboring property
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application April 7, 2011, June 2, 2011 and August 4,
2011, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the
following facts to be true and relevant and makes the following findings:
1. Town Law §267-b(3){b)(l). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The existing homes in this subdivision have similar setbacks
to the bulkhead and several have swimming pools in the rear yard. The 8 ft. x 12 ft. as built shed is small and is
visually screened from adjacent properties by mature landscaping
2. Town Law §267-b{3)(b){2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. A swimming pool is a common accessory in this
neighborhood and due to the existing location of the dwelling any accessories located in the rear yard would
require a variance. The as built shed has a 6.1 ft. side yard setback where the code requires 10 ft., and it is not
practical for the applicant to move it to a conforming location because of it's proximity to the proposed pool
3. Town Law §267-b{3)(b)(3). The variance granted herein is not substantial regarding the swimming pool it
represents a 24% relaxation of the code however, it is in keeping with neighboring properties. The variance
granted heroin for the existing accessory shed is substantial; however, it is well screened and is located over 75 feet
from the bulkhead. Placing the shed in the front yard would not be feasible, since it is used for pool equipment and
is located next to the proposed swimming pool location.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
drywell for the swimming pool is proposed landward of the pool and all storm water will be contained on site.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created, due to the location of the dwelling and the
applicant's desire to have a swimming pool. The applicant purchased the parcel after the Zoning Code was in
effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the
parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an in-ground swimming pool and shed while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Homing, and duly
carried, to
GRANT~ the location of the as built accessory shed, and
DENY~ as applied for regarding the in-ground swimming pool, and GRANT ALTERNATIVE RELIEF as noted
below:
1. The in-ground swimming pool shall be placed no closer than 56.7 feet from the bulkhead as shown on the survey
prepared by Nathan Taft Corwin, III, L.S. Dated last revised June 29, 2011.

Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department of a building permit, and may require a new application and public hearing before
the Zoning Board of Appeals.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site
maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code. other than such uses,
setbacks and other features as are expressly addressed in this action,
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconformity.

The proposed construction of an in-ground swimming pool, with a 54.7' setback to a bulkhead
has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed
action is CONSISTENT with the Policy Standards to the greatest extent practicable and
therefore is CONSISTENT with the LWRP.
The existing shed located in the side yard is EXEMPT from LWRP review.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the
proposed action.

(1) An undesirable change will not be produced in the CHARACTER of the neighborhood
or a detriment to nearby properties if'granted, because:
Referring to the attached aerial photograph, please note the property located to the
south, directly across Harbor Lights Drive, the adjacent property to the west and the
following property to the west are all improved with similar residential swimming pools.
These swimming pools have been in-place and in-use for over ten (lO) years without
resulting in any change in the character of the neighborhood or detriment to nearby
properties, including the Blackle¥ property. Additionally, the proposed swimming pool
will be substantially screened from the surrounding neighborhood by existinff
landscaping, fencing and the actual dwelling. Furthermore, the proposed swimming pool
will be proposed at grade, further decreasing its visibility from the surrounclinff
neighborhood. Consequently, we do not anticipate that this proposal will create a
detriment to nearby properties.
With respect to the existing frame shed, this structure is a typical residential
appurtenance for storage of lawn & gardening equipment, and has existed hereon for the
past five (5) years without resulting in any form of change in the character of the
neighborhood or detriment to nearby properties. Additionally, the existing shed is also
substantially screened by existing landscaping, fencing and the existing dwelling itself.
(~2) The benetit sought by the applicant CANNOT be achieved by some inethod feasible for
the application to pursue, other than an area variance, because:
With respect to the proposed swim~ning pool, due to the pre-existing/non-conforming
nature of the property in terms of size, opportunity to place any accessory structure
within the rear yard is substantially limited from the north by the ~'5.0' setback required
from both the wetlands boundary and the existing bulkhead, and from the south by the
location of the actual dwelling and decking. Relocation of the proposed swimming pool
into a designated side yard, if possible, would result in further non-conformity with
respect to zoning. Relocation of the proposed swimming pool into the front yard would
be permissible as per § ~80-15 (F), however, it would not be able to meet the required
front yard setback of 50.0'. Consequently, the applicant requests a variance of eo.$' for
the construction of a proposed swimming pool located 54.7' from the existing bulkhead.
With respect to the existing frame shed, this structure has existed harmoniously within
this site for over live (5) years without any form of detriment to this property or

surrotmding properties. The applicant requests a variance of $.9' for the existing shed
located 6.1' from the side yard property.
($) The amount of relief requested is not substantial because:
With respect to the proposed swimming pool, the variance requested amounts to only
~7% of the required setback and which can be represented as being non-substantial.
Please note that the existing swimming pool located two (~) properties to the west is
situated 5~.o' from a bulkhead and was permitted via Town of Southold Zoning Board of
Appeals Determination No. 4685 on May 10, 1999. To date, this swimming pool has
existed harmoniously within this property without resulting in any form of detrimental
impact to surrounding properties. In that our requested relief is slightly less, we believe
that this variance is non-substantial.
With respect to the existing shed, this structure has existed hereon for the past five (5)
years without any apparent detrimental impact to the surrounding neighborhood due to
its minor size and use, as well as it being visually screened from all surroundinff
neighbors. The shed is situated at 6.1' from the side yard property boundary, where 10.0'
is required. Consequently, relief of only $.9' is requested, which is slightly less than the
width of the shed itself. Consequently, we believe that this variance is non-substantial.
(3) The variance will NOT have an adverse ex'lFct or impact on the physical or
environmental conditions in the neighborhood or district because:
Again, referring to the attached aerial photograph, please note the property located to
the south, directly across Harbor Lights Drive, the adjacent property to the west and the
following property to the west are all improved with similar residential swimming pools.
These swimming pools have been in-place and in-use for over ten (10) years without
resulting in any form of negative impact to the surrounding area, including the Blackley
property. Additionally, please note that this project benefits from a New York State
Department of Environmental Conservation (NYSDEC) Permit, and will be issued a
wetlands permit from the Town of Southuld Board of Trustees. Accordingly, the
granting of this variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood.
With respect to the existing frame shed, this structure also benefits NYSDEC approval_
and meets the required 75.0' setback from the wetlands boundary, as required by the
Town of Southold Board of Trustees. Consequently, the granting of this variance will
not have an adverse effect or impact on the physical or environmental conditions in the
neighborhood.

No. The property is pre-existing/non-conforming with respect to size, and the area of
conforming build-ability within the designated rear yard is extremely limited due to the

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 19, 2011 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of JAMES & KATHLEEN
BI.ACKLEY applied to the Southold Town Trustees for a permit under the provisions of
Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated December 3, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 19, 2011, at which time all interested persons were given an
opportunity to be heard, and,

I am writing in reference to the above mentioned request for variance. I would like to
raise my objection to our neighbor's request for a variance to locate their proposed poo!
at approximately 55' from the water. In our opinion, there is more than enough area to
locate the pool within the allocated code requirement of 75'. We built our home over
10 years ago and were able to put our pool within the allowed distance. We love our
pool and hope our neighbors will love their's as well within the approved distance.
When I received the original notice I contacted our neighbors to express our reluctance
to their proposed location and got no further response.

new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to al_l owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or during the
hearing, providinq the returned letter to us as soon as possible;
AND not later than March 28th: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the
green/white receipts postmarked by the Post Office. When the green signature cards are
returned to you later by the Post Office, please mail or deliver them to us before the scheduled
