SOUTHOLD TOWN PLANNING BOARD
October 3, 1972
A regular meeting of the Southold Town Planning
Board was held at 7:30 P.M., Tuesday, October 3, 1972,
at the Town OffiCe, Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman;
Henry Moisa, Vice Chairman; Frank Coyle; Henry Raynor.
Absent: Alfred Grebe
Also present: Howard Terry, Building Inspector
Bob Douglass appeared before the Board in reference
to the proposed minor subdivision owned by N. Douglass
Latham off. King Street, Orient, N.Y. Mr. Douglass stated
that the Gun Club will take the piece of property at the
end and make it a p~anent game preserve. He said he
had spoken to SuperviSor Martocchia about it and was told
that the Gun Club could take the property, it could be
put under the Land Sa~e Program, or the Federal Government
could take it. Mr. Latham is going to give the property
to the Gun Club. Mr. Wickham said the minor subdivision
still has to have four lots. It was suggested that lots

#1, ~2, and ~3 be enlarged to make them approximately
60,000 square feet and make lot ~4 larger. Mr. Wickham
also told him when he brings in the map for approval it
has to be set UP with a perpetual easement on it. You
are conveying it out to somebody else subject to hard
and fast covenants that it will never have any building
on it. Mr. Wickham asked what would happen to the land
if the dikes are abandoned? Mr. Douglass said nothing;
unless there was a hurricane. Mr. Wickham asked what
this would do to the other diked areas. Mr. Douglass
said there is nothing in the area that would be bothered.
Mr. Moisa said it is high enough. Mr. Wickham said
that is one of the things you have to consider when you
give it to the Gun Club, but it would have to be subject
to a perpetual easement. Mr. Wickham marked a copy of
the proposed map-with the changes in the lot lines
suggested and the restriction to bAeplaced on the property
to be given to the Gun Club. The Chairman told Mr. Douglass
the right of way would have to be 30 feet if you want a
mortgage. Mr. Coyle asked if there was a good water supply
and Mr. Douglas said he had dug test holes and there was
no problem. Mr. Wickham said he would have to put the
perpetual easement on the property before it is conveyed
to the Gun Club. Mr. Douglass said he would have the map
redrawn.
The Planning Board discussed Orient-By-The-Sea at
Orient and the pictures taken by members of the Board on
September 28, 1972, were presented showing that no work
had been done on the r®ads. These pictures were made a
part of the record. Mr. Wickham said when he went down
there on some of the roads you could not even see they
were skinned.
The Board discussed the proposed miner subdivision
of Valentine Ruch. Mr. Wickham asked if the new proposed
map dated 9/27/72 was acceptable to the Board. Mr. Raynor
said it was not acceptable to him. As far as I am

concerned lot ~1 is unbuildable and lot ~3 is part of
somebody else's property. Mr. Wickham said he did not
bring in the instrument asked for at the last meeting;
I will entertain a motion that this be approved and
that he be required to give a legal instrument in
recordable form stating that lot #3 will not be built
on. Motion was not made. Mr. Raynor made a motion
that the subdivision be denied for the following reasons:
(1) Lot ~3 does not contain 40,000 square feet; (2) Lot
.~1 ~y good discretion is not buildabte. There was no
second to this motion. Mr, Wickham said we will request
a legal instrument in recordable form saying that lot ~3
will not be built on unless it becomes the property of
Valerie Ruch.
Mr. Raynor asked ~f the Planning Board can do
anything if a subdivider complies with what the Town
Engineer has told him and it turns out to be wrong.
I am referring to Emma Enterprises and their attorney
tells me they are getting ready to ask for a re~ease
of the bond. I have had three people come and complain
to me. If we can't do anything about it the Town ~a~ot
take over the roads. The property gets flooded whenever
it rains. Mr. Coyle said this should be brought to the
attention of the Engineer. Mr. Raynor said he thought
the Board should recommend approval of the r~lease of
the bond but not recommend dedication of the roads.
The Chairman read the following letter from Stephen
Griffing in regard to the Petrucci property on Stillwater
Avenue, CUtchogue, dated September 29, 1972.
"Dear Mr. Wickham:
In accordance with our conversation of Friday,
the 29th of September, I enclose a copyyof
survey made for Sadick and Schlussel purchasers
from Angelo and Georgette Petrucci~ of property
on the north side of Still Water Avenue.

Ail I wish to have from your board is a letter
indicating that the dredged canal shown on the
survey was constructed in compliance with the
requirements set forth in your letter addressed
to Angelo Petrucci under-date of May 16, 1967.
For your further information, I enclose a zerox
copy of the face page of the Contract indicating
that there was three parcels of land conveyed
to Sadic~ and Schlussel which did not include
any conveyance of Reserved Plot "A". If this
is not sufficient evidence for you or for.your
meeting of October 3rd, I would be very pleased
to come to your next meeting providing it does
not fall between the 12th and 26th of October at
which time I will be on the West Coast.

Mr. Raynor said he never met the fourth requirement
in our letter of May 16, 1967~. Mr~ Wic~ham said-the lots
were not sold as shown on the minor subdivision and they
were sold by metes and bounds. Mr. Terry said they were
sold with the action o'f the Appeals Board.~ Mr~ Raynor
said the ~Appeals Board did not include ail ithe property
in the. original subdiv±sion. It should !haVe been included.
A clause on the deed o~f May 19, 1R72, from Petrucci to
Sadick and Schlussel states: "Sellers represent that
Zoning Board of Appeals granted a Variance ion Parcel No. 1
abovementioned on April 11, 1968, copy of Board of Appeals
Action is annexed hereto and made a part hereof"
Mr. Wickham said all these people want is approval of the
canal from us. He wants a statement from us that we have
no objlection to the canal in front of their property.
We have a question about t~e rights of way.:
On motion of Mr. Wickham, seconded by Mr. Raynor,
it was
RESOLVED that the. Southold Town Planning Board give
approval of the canal in front of the property of. Richard L.
Sadick and Murray Schlussel, said property ~described in
three deeds from Angelo Petrucci and Georgette Petrucci

and recorded in the office of the Suffolk County Clerk
on June 30, 1972, in Liber 7207, pages 75, 77 and 79.
This approval is for the canal in front of the described
property only and not for any adjoining property.
Vote of the Board: Ayes: Messrs. Wickham, Raynor,
Moisa and Coyle.
Mr. Samuel Glickman, attorney for Constantine Pappas
appeared before the Board. He said he represented Mr. Pappas,
the owner of a piece of land in Orient which runs
approximately from the end of the north road down to
the ferry. Prior to the last amendment of-the zoning
ordinance his property was zoned B-1 Business under the
old zoning and under the new maps. Under the master
plan maps it was continually zoned as B-1 and by adoption
of the Town Board it was stated that it was B-1. In
ma~ing the new zoning maps inadvertantly it was made part
B-1 and part ~ I am asking the.Planning Board to make
correction as it now stands to show the~property as all
B-1. Mr. Terry said this is right. We made the first
run on the zoning map and we penciled in the mistakes to
be corrected and this is one of the things that did not
get covered. The master plan shows it over to the east
line but when they did the final map there was about 1/8
inch not covered. Mr. Tasker said it has to go through
channelS to be corrected and it starts here with a letter
from the Planning Board ~hat it was on the master plan and
adopted by the Town Board. Mr. Wickham said we will need
to present to the Tow~ Board our work sheets.
On motion of Mr. Moisa, seconded by Mr7 Coyle, it was
RESOLVED that the Planning Board send a letter to the
Town Board that it h~s been called to our attention that
the flnal zoning map is in'error in that it does not
inClude all of the property of Constantine Pappas at
Orient Point shown On all of the work .sheets of the
Planning Board as well as the Master Plan Map and as
approved by the Town Board. This should be corrected as
soon as possible.

The Board discussed Mattituck Shopping Center with
Mr. Joe Cippoletti. Mr. Cassella could not attend the
meeting because of another appointment. The plans for
the A&P building that Mr. Cippoletti is working on are
not the plans approved by the Planning Board. The building
is being built with a mansard roof; the approved plans
are for a cupola. Mr~ Cippoletti said when he called
Mr. Terry a momth ago about a mansard around the rest of
the building he assumed he had those same drawings.
When I ca~ted today it was a big shock that Mr. Terry
did not have these drawings. Mr~ Terry said this was
a major deviation from the original approved plan.
Mr. Wickham said he had ~ever seen this new drawing until
this morning and you are susposed to be working from
plans approved by the Town of Southold. We can only say
that these are unauthorized. Mr. Terry said he thought they
should stick to the colonial type of roof. Mr. Cippoletti
said he didn't know how he could achieve this design
without ripping off the whole roof, Mr. Wickham told
him we are not so much concerned with the height. The
thing we want is the~colonial type of architecture for
the central motiff. I simply don't like the mansard
or french provincial roof. When we discussed it when
Mr. Cassella was here he said he wanted to do some of
it with mansard and we felt that Grants did not make that
much difference. Mr. Cippoletti said he would tell A&P
that this is not acceptable and you want to ~tick to
the colonial type roof. We will have to go over it with
the steel men and see what we can do. I know that the
roof is not structurally designed for that type of roof,
I would have to get the plans you have and take them
to our engineering department. Mr. Wickham said the
Board will review the plans he brought in we will try
to get copies of the plans we have for you. Mr. Cippoletti
said he will stop all construction on the A&P roof but
everything else I can continue with. Mr. Terry said he
will try to get the other set of plans printed up for
him. It,may take two or three days. Mr. Wickham said
we don't hold anything against you or Mr. Cassella but
weehave no faith in the architect you are working from.
Mr. Cippoletti said all the plans now are b~ng done
by John Jacobsen. When we leased the building to the A&P
this is the design that the A~P came up with and it was
incorporated~ at the time the lease was signed, Mr. Wickham
said he did not-want to speak for the Board, bUt if the
A&P is,completely sold on not wanting the cupola and if
yQu could come up with a colonial design without the cupola
that is attractive we would be open minded about it.
Mr. Cippoletti said he would if A&P will accept it and
inthe interim we will stop construction on the A&P
building.

On motion of Mr. Coyle, seconded by Mr. Raynor,
it was
RESOLVED that the next regular meeting of the
Planning Board will be held October 25, 1972, at 7:30
p.m. at the Town Office, Main Road, Southold, New York.
Vote of the Board: Ayes: Messrs. Coyle, Raynor,
Wickham, Moisa.
On motion of Mr. Wickham, seconded by Mr. Molsa,
it.was
RESOLVED that the minutes of the Planning Board
meeting of September 25, 1972, be approved.

The 'Chairman read the following letter from Bache
Bleecker in reference to Willow Point Subdivision,
dated September 29, 1972:
Dear Mr. Wickham:
I am in receipt of your letter of September 21
and can appreciate your concern in ~connection
with the completion of the ~mprovements at the
Willow Point subdivision.
· he only remaining work envolves a slight widening
of the paved section of the north side of Budd's
Pond Road at lots nos. 6 through 9. This work
was given out to the contractor, Paul Corrazini, last
June and in spite of constant prodding on mk- part
had not been completed as of the date of your
letter.
The subgrade for the widening has now~been prepared
and Mr. Corazini has promised me that the final

stone and oiling will be completed this week.
I regret very much for the delay in the comple-
tion of this work and wish to a~sure the Board
that I will make every effort to insure its
completion at the earliest possible date.

A letter was received from.William Wickham, Esq.,
in reference to property of Mary Zeneski, Little Neck
Road, Cutchogue, N.Y:
Gentlemen:
I enclose for your recollection a copy of the
Minor Subdivision as approved by you on
January 13, 1969. I am also enclosing a sketch
showing 4-1/4 acres on which Mrs. Zeneski has
received an offer.
It is my understanding that the purchaser does
not wish to subdivide further; that it is his
plan only to ask for a building permit for one
residence on the parcel.
We would appreciate your advise on how this
matter is to be handled by either your Board, or
the Board of Appeals, for right of access.

Mr. Terry s~id sh~ wants to sell 4 1/4 acres to somebody
WiCkham saying~that this matter be handled by the
Appeals Board but that the Planning Board is writing
to the Appeals Board telling them that it is only for
one residence. Mrs. Zeneski still has approximately 30
acres and we are not prepared to see her sell it off
one lot at a time; any further encroachment should be
a major subdivision, sectioned out.

Mr. Terry said Russell Case was in to see him-
this afternoon about spliting up property
and bringing in.four minor subdivisions~ ~e was ~Is.o
talking about expanding the ~elf course.
Mr. Wickham said he had talked to Bill Sterling
about his proposed minor subdivision at Cutchogue.
He is going to give the property to his son and
daughter. There are four lots~with roughly 50,000
square feet each.
On motion of Mr. Wickham, seconded by Mr. Moisa,

RESOLVED that the minor subdivision for Peter C.
and Eloys C. Sterling at Cutchogue, New York, be approved.

The:Southold Town Planning Board received from the
Southold Town Board a proposal on the Board's own
motion for a change of zone from."A" Residential and
Agricultural District to "B-i" General Business District
certain real property situated at Southold, New York,
together:with the instructions to prepare an official
report defining the conditions contained therein.
This property is situated in the Town of Southold,
County Of Suffolk, New York, and more particularly
b0und~d and described as follows:
BEGINNING.at a point on the westerly line of Mechanic
Street where' said line is intersected by t~he.line
between Zone A and Zone B-l; from said point of
beginning running southerly along said westerly
line of Mechanic Street, 620 feet, more or less, to
land of Rimmler; thence westerly along said land
of Rimmler 463 feet, more or less, to Wells Avenue;
thence along said Wells Avenue, two courses:

RESOLVED to table discussion on.the proposed change
of zone o~ Mechanic Street and Wells Avenue, Southold,
until the-next meeting on October 25,11972.

An application for a proposed.minor subdivision
at Gull Pond Road, Greenport, was received from Regens
International Corp. Mr. Terry said the property has
been filled and the Health Department would not let
them build on it. The adjoining subdivision is Fordham
Acres. A letter will be sent to Regens International
Corp. telling them to have a licensed surveyor draw
up a map showing adjacent property owners andaadvising
them that the right of way from Gull Pond Road to the
Beach ~s 50 feet with a 100 foot turnaround at the beach.
Their map shows a 20 foot right of way with 85 feet turn
around.
The meeting was adjourned at 10:35 p.m.
