FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING HELD NOVEMBER 13, 2008 ZBA # 6213 - HELEN and PETER LOUCA, APPLICANTS PROPERTY LOCATION: 475 Miriam Road, Mattituck CTM 99-1-32 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 10,500 square foot parcel measuring 50.0 feet along Miriam Road to the south, 210.0 feet along the west and the east lot lines, and 50.0 feet along the north lot line. The property is improved with a single-family house shown by a site survey map prepared by James Deerkowski, P.E. dated August 6, 2008. - BASIS OF APPLICATION: This request for a Variance under Section 280'122A and Section 280-124 is based on the Building Inspector's August 18, 2008 Notice of Disapproval, amended August 8, 2008, concerning additions and alterations to an existing single-family dwelling, for the reason that the new construction is in violation of the code-required single side yard setback of 10 feet and a total side yard setback of 25 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 30, 2008, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant requests a variance to allow reduction in a single side yard setback to 7'3" at its closest point and 11 feet as Page 2 - November 13, 2008 ZBA # 6213 - HELEN and PETER LOUCA, APPLICANTS CTM 1000-99-1-32 shown on the august 6, 2008 site plan, resulting in total side yard setbacks of 19'3" for the construction of a second-stow balcony, and extension of the second floor with total side yards at 23 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The footprint will remain the same except for the setback at 7' 3" for the second floor balcony which will extend 3' 8" feet into the side yard. 2. Town Law §267-b(3)(b)(2). The benefit of increased second-floor living space in a nonconforming dwelling cannot be obtained without a variance. The existing dwelling has side setbacks of 11 and 12 feet, and a nonconforming total setback of 23 feet, where the code requires 25 feet. 3. Town Law §267-b(3)(b)(3). The proposed variance is not substantial. The additional nonconformity will be a result of the addition of a second floor balcony which will extend only 3' 8" to into the side yard. 4. Town Law §267-b(3)(b)(5). The difficulty has been self-created only so far as the applicant wishes to expand the second floor of a +/- 27-foot wide house on a 50 foot wide lot. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Town Law §267'b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an addition to the second floor of their house, while preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, a motion was offered by Member Simon, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the August 5, 2008 elevation Page 3 - November 13, 2008 ZBA # 6213 ' HELEN and PETER LOUCA, APPLICANTS CTM 1000'99' 1'32 and floor diagram Sheets 1 to 5, and the August 6, 2008 site plan, prepared by James J. Deerkoski, P.E. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimus in nature for an alteration that does not increase the degree of nonconformity.
