party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on September 5, 1997, and by virtue of the power and
authority given in and by said last will and testament, and in consideration ofTEN ($10.00) Dollars, lawful
money of the United States, paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate,
lying and being at New Suffolk, Town of South old, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a point on the southwesterly side of Old Harbor Road at the northeast corner ofland
conveyed to Harry H. Tuthill and Julia M. Tuthill, his wife, by deed dated 7/6/61 and recorded in the
Suffolk County Clerk's Office on April 4, 1962 in Liber 5147 of deeds at page 85, from said point of
beginning;
RUNNING THENCE in a southeasterly direction along said southwesterly line of Old Harbor Road, 200
feet more or less to the ordinary high water mark of Cutchogue Harbor;
RUNNING THENCE in a southerly direction along said ordinary high water mark ofCutchogue Harbor
a distance of200 feet, more or less to the entrance of School House Creek;
THENCE along the ordinary high water mark of School House Creek and a canal which is a tributary of
school House Creek in a general westerly and then northerly direction a distance of375 feet, more or less
to the southeasterly corner of said land of Harry H. Tuthill and Julia M. Tuthill, his wife;

RUNNING THENCE along land last mentioned a distance of 150 feet, more or less, to said southweSterly
li~e of Old Harbor road at the point or place of BEGINNING.
EXCEPTING, however, from the above described premises that portion thereofheretobefore conveyed
to John F. Hartung and Gertrude Hartung, his wife, by deed dated March 5, 1970 and recorded in the
Suffolk County Clerk's Office in Liber 6714 of deeds at page 15, being more particularly bounded and
described as follows:
BEGINNING at a point on the southeasterly side of a private road 15 feet in width, which point or place
of beginning is distant the following two courses and distances from the point of the intersection of the
easterly corner ofland now or formerly ofLundine with the southwesterly side of Old Harbor Road:
1. South 46 degrees 18 minutes 30 seconds East, along the southwesterly side of Old Harbor Road,
145.85 feet;
2. South 30 degrees 39 minutes 00 seconds West, along the southeasterly side of said private road,
91.3 5 feet to the point or place of beginning;
THENCE South 64 degrees 53 minutes 30 seconds East, along land now or formerly of Tuthill, 172 feet,
more or less, to the ordinary high water mark of Cutchogue Harbor;
THENCE South 19 degrees 15 minutes West, along a tie line bearing only, 77.90 feet to a point, said
distance being actually measured alng the high water mark of Cutchogue Harbor and throuth a jetty and
terminating four feet, more or less, south of said jetty;
THENCE North 79 degrees 54 minutes 30 seconds West, 80 feet;
THENCE North 62 degrees 14 minutes west, 30.15 feet to the southerly end ofa private road first above
described;
THENCE South 62 degrees 30 minutes West, along the southerly end of said private road, 19 feet, more
or less, to the ordinary high water line of a canal which is a tributary of School House Creek;
THENCE Northwesterly along the ordinary high water mark of said canal 34 feet, more or less, to a point;
THENCE North 62 degrees 30 minutes East, across said private road, 19 feet, more or less, to the easterly
side of said private road;
THENCE North 27 degrees 30 minutes West, along the easterly side of said private road, 62.04 feet;
THENCE North 30 degrees 39 minutes East, still along said private road, 38.67 feet to the point or place
of BEGINNING.
TOGETHER with all of the right, title and interest of the party of the first part if any, in and to the lands
under the water of Cutchogue I-Iarbor, adjacent to said premises.
TOGETHER with all of the right, title and interest of the party of the first part, of, in and to the lands
under the waters of School House Creek adjacent to said premises, to the center line thereof
TOGETHER with all of the right, title and interest of the party of the first part of, in and to the lands
under the waters of the canal which is a tributary of School House Creek, adjacent to said premises to the
center line thereof

SUBJECT to 'covenants, restrictions, easements and agreements of record
BEING, and intended to the same premises conveyed to Katharine Tuthill by deed dated the 22'd day of
September, ]972, and recorded at the Suffolk County Clerk's Office at Liber 737 4 Page]]3 on April 6,
]973.
TOGETHER with all right, title and interest, ifany, of the party of the first part of, in and to any streets
and roads abutting the above-described premises to the center lines thereof,
TOGETHER with the appurtenances, and also all the estate therein, which the party of the first part has
or has power to conveyor dispose of, whether individually, or by virtue of said will or otherwise,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as ifit read "parties" whenever the
sense of this indenture so requires.
