INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced belbre issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

FINDINGS, DELIBE~TIONS AND DETERMINATION
MEETING OF NOVEMBER 4, 2004

Property Location: 600 Wunneweta Road, Cutchogue; CTM 104-11-13.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 36,033.07 sq. ft. parcel has 100.49 ft. on
Wunneweta Road, and is shown as Lot 297 on the Amended Map A of Nassau Point/Nassau Point
Club Properties, Inc.
BASIS OF APPLICATION: Building Department's May 28, 2004 Notice of Disapproval, citing
Section 100-33 in its denial of a building permit to construct a garage proposed in a front yard rather
than the code-required rear yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on September 14, 2004 and
October 21, 2004 at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a 22.67' x 26.67'
detached garage in front yard, 20 feet from the southerly side property line and 118.8 feet from fronl
yard line, as shown on the J.A, Ingegno survey dated June 8, 2000, revised May 24, 2004. The
height is shown at 18 feet to the top on the 5/21/04 plans prepared by Thomas E. Kosonen, R.A.
OTHER INFORMATION: Building Permit #30260 issued 4/26~04 indicates authorization for
construction of a new dwelling, to which the proposed accessory garage will be incidental.
REASONS FOR BO,~RD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant seeks to construct a garage
at a distance that far exceeds the minimum setback requirements of the code. This building

will be much smaller than a size building that is allowed under the code, thereby reducing the
impact that a large house could have if it were to be built utilizing the setback required by the
code.
The difficulty was not self-created. The topography of this lot is such that it has a steep
increase in grade from the front lot line to approximately 100 feet into the lot. Building any
structure closer to the front lot line will require expensive retaining walls and grading. Building
the garage in the rear yard after setting the house back to avoid the steep grade will reduce
the usable space in the rear yard and render the front yard useless.
The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance, because town code requires that accessory
structures be constructed in the rear yard. Due to the topography of the lot, placing the
garage in the required rear yard would reduce much of the usable space.
The variance granted herein is not substantial. The minimum front yard for a principal
structure in this zone in 40 feet. The applicant proposes to place the garage 118.8 feet from
the front lot line. This represents nearly a 300% increase in the distance from the front lot
line required by the code.
No evidence was submitted during the hearing or in the written record to indicate that the
grant of the vadance will have an adverse effect or impact on physical or environmental
conditions in the neighborhood or district. Setting the garage and house back, away from the
steep grade will require less disturbance to the physical and environmental conditions of the
neighborhood,
Grant of the relief requested is the minimum necessary and adequate the enable the
applicant to enjoy the benefit of a detached garage, while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION QF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by
Chairwoman Oliva, and duly carded, to
GRANT the variance as applied for, as shown on the June 8, 2000 survey, amended May 24,
2004 by Joseph A. Ingegno, L.S. (and referring to the 5/21/04 plans prepared by Thomas E.
Kosonen, R,A., SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the south and east sides of the garage be landscaped with evergreen trees such as
spruce or pine or similar), and be continuously maintained in good condition. This landscape
buffer shall consist of evergreens at a minimum height of 6 feet, 4 to 6 ft. on center.

2. That the Board reserves the right to inspect the landscaping for conformity to this
decision.
3. That the utilities to the garage will include water for the purposes of a slop sink on the first
floor, for normal and customary garage/cleaning purposes.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, selbacks and other
features as are expressly addressed in this action.

It is the contractor's responsibility to keep this construction document on site at all times. It la
also the contractor's responsibility to read all notes, specification and be familiarized with the
plans prior to work.

17. All materials, assemblies, and method of construction including but not limited to form-
work, block-work, framing, nailing, placing of concrete, etc. are to be carefully supervised
by the contractor to be sure they are in accordance with the drawings, specifications,
applicable codes and good practice. Deviations from the drawings and specifications will
not be permitted without written authorization of the architect/engineer,

Glazing, windows and doors: 1. All glass to be insulated Iow-E. Unless otherwise specified.
2. Glass doors and windows shall not be installed until proper clearances and provided,
3, All sliding glass doors, skylights, and any glass unit installed within 18" of finished floor shall
be of insulated tempered glass unless otherwise noted.
4. All glass units shall be installed in strict accordance with manufacturer's specifications.
5. Air windows to be caulked and sealed as per New York State energy conservation code.
6. Provide flashing pans under all sliding glass doors, windows, or any other type of glass unit
when within 6" of an exterior surface,
7. All exterior doors are to be weathered stripped and provide all screens and hardware
necessary for proper function of such units.
8. All glass Is to be free of scratches and imperfections. Glass should be guaranteed by the
manufacturer for a period of 5 years.
9. All windows to be Andersen unless otherwise noted, If contractor is to substitute with
another window manufacturer it ia the responsibility of the contractor to verify that the
characteristics of the window match the characteristics of the Andersen window specified.
The characteristics are as follows, but not limited to: Design pressure, rough opening, u-
factor, light area, vent area, and egress requirements,
Gypsum wallboard:
1. Gypsum wall board systems shall be of a tape joint and joint compound method.
2. All gypsum board shall be ~" on walls and ceiling, unless otherwise noted. Water resistant
(V~R.) at bathrooms and where deemed applicable.
3. 5/8"; one hour rated, type 'X' gypsum board on ceiling and walls (where applicable) at heat
producing equipment to extend three feet in each direction beyond the unit(s). Aisc at
heat producing equipment, concrete floor or if placed on wood frame, install concrete
panels of 518" thickness minimum.
4, Finish joints, j-beads, nail dimples, corners, and edges shall be taped and receive three
coats of joint compound. Allow 24 hou?sto dry between coats. Final coat to be sanded
smooth,
5. Metal corner bead to be used on all outside corners end around all openings.
6. Fasten gypsum board as per fastening schedule.
Asphalt roofing shlnglel:
1, All sloped roofing shingles shall be GAF-class-a asphalt roofing shingles or approved
equal,
2. Shingles shall be applied over 15# building felt, Unless other noted. Aisc apply GAF-
weather-watch ice and water barrier 2 feet from eaves, valleys, and flashing.
3. Provide flashing necessary for water tight and weatherproof construction,
4. Roofing is to be applied in strict accordance with manufacturer's specifications
5, Nailing of roofing shall be to code,
Site work:
1, Stakeout Is to be performed by a licensed surveyor, or by qualified sub-contractor,
2. Verify all given data on drawings. If there is adiscrepancy, receive clarification form
architect/engineer prior to proceeding,
3, Excavate and back fill for work indicated on drawings. Stockpile topsoil obtained from
stripping driveway and building site. Stockpile all excavated materials,
4, New and existing back fill material Is to be free of weeds, tree roots, rocks, and debris.
All surplus material that Is unsuitable for back fill material shall be removed from site.
