THIS INDENTURE, made the z y day of January nineteen hundred and ninety nine BETWEEN John P. Manning and Claire A. Manning, his wife, residing at 344 West 23rd Street, Apt. 6C and 61), New York 10011 , party of the first part, and Claire A. Manning, residing at 344 West 23rd Street, New York, New York 10011 , I party of the second part, WITNESSETH,that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of New Suffolk,Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a point on the southerly side of Jackson Street,distant 231.57 feet westerly from the corner formed by the intersection of the southerly side of Jackson Street with the westerly side of Fifth Street; running thence South 6 Degrees 08 minutes 20 seconds West 421 feet to the ordinary high water mark of Great Peconic Bay as it existed and as shown on a survey by Van Tuyl and Son, Licensed Land Surveyors,date May 24, 1967; running thence along said high water mark on a tie line of North 85 degrees 43 minutes 00 seconds West 100.05 feet to the easterly side of lands conveyed simultaneously herewith by Dorothy K.Verderese to James Manning;thence North 6 degrees 08 minutes 20 seconds East along the easterly side of said last mentioned land 424 feet to the southerly side of Jackson Street;thence South 84 degrees 00 minutes 00 seconds East along the southerly side of Jackson Street 100 feet to the point or place of BEGINNING. SUBJECT to any state of fads that an accurate survey may show. SUBJECT to covenants, restrictions, reservations, easements and agreements of record, if any. TOGETHER WITH all right,title and interest, if any, of the party of the first part to the present high water mark of said premises. TOGETHER WITH all rights and privileges of the party of the first part to the use of the water supply from the well located on the property owned by James P. Manning which is adjacent to the above described property. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveys= and will hold the right to receive such consid- eration as a trust fund to be applied fust for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises;'that the said premises are free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance of the title to said premises;and that said party of the first part will forever warrant the title to said premises. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
