ORLOWSKI, his wife, residing at 5180 New Suffolk Avenue, Cutchogue, New York �v 11935, parties of the first part, and BENNETT S. ORLOWSKI, JR., residing at P. O. Box 287, T Cutchogue, New York 11935 and BARBARA A. ORLOWSKI, residing at-*5180 New Suffolk Avenue, Cutchogue, New York 11935, as' tenants in common, parties of the second part WITNESSETH, that the parties of the first part, in consideration of Ten Dollars and other valuable consideration paid by the parties of the second part, does hereby grant and release unto the parties of the second part, the heirs or successors and assigns of the parties of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at New Suffolk, Southold Town, Suffolk County, New York, bounded and described as follows: BEGINNING at a concrete monument at the intersection of the westerly line of New Suffolk Lane and the northerly line of Oak Road; running thence North 13 degrees 30 minutes 40 seconds East along the westerly line of New Suffolk Lane 100.16 feet to land of Forrest H. Gordon; thence running in a westerly direction along said land of Forrest H. Gordon 141.78 feet to other land of said Forrest H. Gordon; running thence in a southerly direction 100 feet to the northerly line of Oak Road; running thence in an easterly direction along the northerly line of Oak Road 147.26 feet to the concrete monument and place of beginning. TOGETHER with all right, title and interest of the parties of the first part of, in and to those portions of New Suffolk Lane and Oak Road adjoining said premises to the center lines thereof. SUBJECT TO covenants and restrictions, if any, affecting said premises. BEING AND INTENDED TO BE the same premises conveyed to Grantor by deed dated October 1, 1948, recorded in Liber 2883 at page 564, Suffolk County Clerk's Office. TOGETHER with all right, title and interest, if any, of the parties of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the parties of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the parties of the second part, the heirs or successors and assigns of the parties of the second part forever. AND the parties of the first part covenants that the parties of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the parties of the first part, in compliance with Section 13 of the Lien Law, covenants that the parties of the first part will receive the consideration for thio conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvements and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "parties" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
