SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category
of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE COD;:: This application was referred as required
under the Suffolk County Administrative Cede Sections A 14-14 to 23, and the Suffolk County
Department of Planning issued its reply dated September 21, 2009 stating that this application
is considered a matter for local determination as there appears to be no significant county-wide
or inter-community impact.
LWRP DETERMINATION: A letter dated October 2, 2009 confirming consistency with LWRP
policy standards was submitted to the Board of Appeals under Chapter 268, Waterfront
Consistency Review of the Town of Southold Code and Local Waterfront Revitalization
Program.
PROPERTY FACTS/DESCRIPTION: The subject property is a 2.542 acre lot measuring 87.86
feet along Little Peconic Bay on the southeast, 1,293.36 feet along the southwest boundary,
24..83 feet along Indian Neck Road to the northwest, and 1,267.74 feet along the northeast
boundary. The lot is improved with a single family house, a garage/cottage, a frame shed, and
a tennis court, as shown by a survey prepered by Nathan Corwin, L.S. dated August 25, 2008.
BASIS OF APPLICATION: Request for Variances from Cods Sections 280-14 and 280-116,
based on an application for a building permit for an addition and alterations to a dwelling and the
Building Inspector's July 22, 2009 Notice of Disapproval stating that the new construction is not
permitted because the setbacks are proposed at:
(a) less than the code-required minimum of 75 feet from a bulkhead,
(b) less than the code-required minimum of 20 feet on a single side
(c) less than the code-required minimum of 45 feet for combined side yards,
(d) less than the code-required minimum of 75 feet from the rear property line.

FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on December 3, 2009, at
which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board finds
the following facts to be true and relevant:
RELIEF REQUESTED: The applicant requests variances for a 41 foot setback from the
bulkhead, a 10 foot 10 inch single side yard setback, a 39 foot total side yard setback, and a 73
foot 10 inch setback from the (waterside) rear property line.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted,
and personal inspections, the Board makes the following findings:
1. Town Law Sect. 267-bf3){b){3)f1). An undesirable change will not be produced in the
character of the neighborhood or a dethment to nearby properties. The proposed addition to the
west and north will not significantly change the floor plan, roof line, or exterior appearance of the
existing house. The residence and the adjoining residence to the east were both constructed
prior to the adoption of Section 280-116, which mandates a 75 foot rear yard setback from the
bulkhead. The side of the residence facing the waterfront will remain at 72.6 feet from the beach
front, and 42.9 from the bulkhead.
2. Town Law Sect.267-b(3)(b)(2). The benefit of expanding the residence cannot be achieved
by some method feasible for the applicant to pursue other than an area variance. Expanding to
the north or east would not be consistent with the applicant's desire to maintain key elements of
the existing structure. Expansion to the east is also constrained by the location of the existing
septic system.
3. Town Law Sect. 267-b(3)(b)(3). The amount of relief requested is not substantial. The
construction on the seaward side of approximately five feet will only extend the existing
nonconforming setback to the wast. Evidence has been presented that the reduction of west side
setback will not significantly affect the use of the western neighbor's property. The conforming
eastern side setback will not be changed.
4. Town Law Sect. 267-b(3)fb){4). No evidence has been submitted to suggest that a variance
in this residential community will have an adverse impact on the physical or environmental
conditions in the neighborhood.
5. Town Law Sect. 267-b(3)(b)(5). The difficulty has been self-created in so far as it is a result
of the applicant' s decision to expand the first floor living space of an 886 square foot house'on a
2.5 acre lot having a width of 87.86 feet by 1,367 square feet.

features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.

Dear Mr. & Mrs. Scopaz:
Based on the information you have submitted, the New York State
Department of Environmental Conservation has determined that:
The property landward of the bulkhead which was constructed prior
to September 20, 1977, as shown on the survey prepared by Roderick
VanTuyl dated August 8, 1979 is beyond jurisdiction of Article 25.
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act . Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.

TERMS AND CONDITIONS
The Permittee, John Sconaz. residing at 6300 Indian Neck Lane. Peconic. NY. as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Tmstces and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third patties, and the said Permittce
assumes full liability with respect thereto, to the complete exclusion of the Board of
Tmstces of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittce wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Pemfit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustecs,
the work shall cause unreasonable obstruction to free navigation, the said Permittce will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the sz/id Board will be notified by the Permittec of the completion oftbe work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
