a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
l~ Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regmlations affecting the
property ha~)e been enacted in the interim, the Building Inspector inay authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Dear Mr. & Mrs. Goldstein:
The Southold Town Planning Board, at a meeting held on Monday, September 11,
2006, adopted the following resolutions:
The final public hearing was closed.
WHEREAS, on May 27, 1975, the Town Board granted a change of zone from "A"
Residential and Agricultural Distdct to "M-1" General Multiple Residence District and "A"
Residential and Agricultural Distdct to "B" Light Business District; and
WHERAS, on November 9, 1976, the Town Board issued a permit for the "maintenance
and operation of a tourist camp to contain not more than 51 units (increasing the original
permit on Section I, dated August 12, 1976, from 73 sites to 124 sites)"; and
WHEREAS, in 1989 the Town amended the zoning of the subject parcel to Resort
Residential; and
WHEREAS, this amended site plan is for an 80-space over flow parking lot with a
controlled access/egress and new landscaping on a 24-acre parcel in the RR Zone
located on the s/s/o of County Read 48 at the s/w intemection of County Road 48 and
Queen Street/Lane in Greenport. SCTM# 1000-40-3-5; and
WHEREAS, Myron and Donna Goldstein are the owners of the property located on the
s/s/o of County Road 48 at the s/w intersection of County Road 48 and Queen
Street/Lane in Greenport; and

WHEREAS, on July 5, 2005, the agents, Myron and Donna Goldstein, submitted an
amended site plan application for approval; and
WHEREAS, on October 1, 2005, the Suffolk County Department of Health Services
issued permit number 51-6637 to operate a campground with a 186 site capacity valid
for three (3) years; and
WHEREAS, on November 16, 2005, the Greenport Fire Department responded
requiring a 20' sliding gate be installed at the northern end of the proposed overflow
parking area along Queen Street/Lane; and
WHEREAS, on November 25, 2005, the Suffolk County Department of Planning
responded after review and determined this matter is for "local determination as there
appears to be no significant county-wide or inter-community impact(s)" and the Planning
Board accepts this pursuant to 239L & M General Municipal Law; and
WHEREAS, on December 1, 2005, the Architectural Review Committee reviewed the
architectural drawings and associated site plan materials and approved the project
subject to one recommendation and the Southold Town Planning Board has accepted
their approval and considered their recommendation; and
WHEREAS, on January 10, 2006, the Southold Town Planning Board, acting under the
State Environmental Quality Review Act (6 NYCRR), Part 617.5 c, makes a
determination that the proposed action is a Type II and not subject to review; and
WHEREAS, on January 17, 2006, the Southold Town Building InsPector reviewed and
certified the site plan for a "Campground" use; and
WHEREAS, on February 10, 2006, the Suffolk County Department of Public Works
responded after review and determined a permit is not necessary at this time; and
WHEREAS, on February 28, 2006, the Southold Town Engineer reviewed the proposed
site plan and responded with recommendations and the Planning Board accepts the
recommendations and incorporates necessary recommendations as part of this
approval; and
WHEREAS, on August 17, 2006 a "Bargain and Sale Deed with Covenant Against
Grantor's Acts" was signed by Myron W. Goldstein transferring a portion of the subject
property to the Town as per the odginal Tourist Camp Permit and Change of Zone
issued by the Town Board; and
WHEREAS, on September 11, 2006, Chief Darryl F. Volinski of Greenport Fire
Department determined no access gate is necessary as 'It would not be more
difficult/dangereus to maneuver through the facility in the event that fire-related
equipment and/or apparatus was required"; and

WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, the following items shall be required:
All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries. The lighting must meet town code requirements.
2. All signs shall meet Southold Town Zoning Codes and shall be subject to
approval of the Southold Town Building Inspector.
3. As per the landscape survivability guarantee, the applicant agrees to replace any
of the landscaping which dies within three (3) years of planting; be it therefore
4. All handicap parking stalls and access aisles must comply with New York State
Code and ADA requirements.
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action
under the policies of the Town of Southold Local Waterfront Revitalization Program and
has determined that the action is consistent provided that the best management
practices outlined in the April 26, 2006 memo prepared by the LWRP Coordinator are
implemented; and be it further
RESOLVED, that pursuant to Southold Town Code 280-131 Part I, the applicant agrees
to incorporate all the requirements, comments, and recommendations of each reviewing
agency as referenced above and as indicated on the site plan and corresponding
attachments; and be it further
RESOLVED, that the Southold Town Planning Board grant approval on the site plan
drawings S-1 prepared and certified by Mark A. Schwartz, AIA dated September 8,
2006 and authorize the Chairperson to endorse the site plans with the following
conditions:
The completion of the road dedication with the Town to the satisfaction of the
Office of the Town Attorney, Town Engineer and Superintendent of Highways. A
copy of the filed dedication must be submitted to the Southold Town Planning
Department within thirty (30) days of receipt. This requirement must be met
within six (6) months of the resolution and if applicant/agent/owner fails to adhere
to this requirement within the prescribed time periods, this approval shall become
null and void.
Keep the proposed 191.3' x 24' new access road leading to the proposed
overflow parking lot as grass provided it is maintained and does not pose a
safety hazard to patrons of the campground, neighboring property owners or

property owned by the Town of Southold. The applicant/agent/owner shall
maintain the existing grass and replant, as necessary, in the access road and
overflow parking lot. in addition, all drainage must be contained onsite and shall
not, at any time, be permitted to enter Queen Street/Lane. The
applicant/agent/owner shall mitigate any hazardous conditions that may adse in
connection with the access road and overflow parking lot at the direction of and
to the satisfaction of the Town Engineer or Superintendent of Highways in the
event, in their opinion, it poses a hazard or falls into disrepair. The
applicant/agent/owner shall abide by the determination of the Town Engineer or
Superintendent of Highways regarding the existing condition or necessity of
repair/mitigation. Ifthe applicant/agent/owner fails to adhere to this requirement,
this approval shall become null and void.
3. A valid Suffolk County Department of Health Services permit must be maintained
and renewed as necessary.
The existing vegetation along the western property line extending 295.2' south
from County Road 48 must remain in a natural state. A minimum 12' vegetated
buffer consisting of trees and shrubs shall be maintained along the westem
property line adjacent to the proposed overflow parking area. Mowing within this
vegetated buffer, as described above, is stdctly prohibited.
The western travel aisle in the proposed overflow parking area, extending east
24' from the required 12' vegetated buffer, as described above, shall be used for
vehicular circulation only and parking is stdctly prohibited within this 24' aisle.
6. Every attempt should be made to fill the parking spaces in the southeast corner
of the proposed parking lot first, moving north and west as necessary.
7. The site plan approval requires that all work proposed on the site plan shall be
completed within three (3) years from the date of this resolution.
Prior to the request for the Certificate of Occupancy, if required, the owner or
authorized agent must request, in writing, the said Building Inspector and the
Planning Board to perform an on-site inspection to find the site improvements are
in conformity with the approved amended site plan.
The applicant/agent/owner must submit, in writing, a request for an on-site
inspection prior to the expiration of this resolution. Prior to the request for an on-
site inspection, the applicant/agent/owner must submit a copy of all required
approvals from any necessary agencies to the Southold Town Planning
Department.
10. If the as-built site improvements vary from the approved amended site plan, the
Planning Board reserves the right to request a certified as-built site plan detailing
all the changes.

11 .Any changes from the approved site plan shall require Planning Board approval,
and any such changes without Planning Board approval will be subject to referral
to the Town Attorney's Office for possible legal action.
12.The Planning Board agrees that no additional lighting will be required in the
proposed overflow parking area at this time.
The Planning Board will issue a final site plan approval in the form of a letter following a
site inspection and at the time the site improvements are found to be in conformance
with the approved site plan.
A copy of the approved amended site plan is enclosed for your records. As per the
Town Code, one copy each will be distributed to the Building Department and Town
Engineer/Highway Department.

RESOLVED that the Southold Town Planning Board, acting under the State

ACTION OF THE ZONING BOARD OF APPEALS
Eastern Long Island Kampgrounds, Inc.
Afte~ investigation and inspection the Board finds that
the applicant own approximately 24 acres on the south side of
CR27. On March 28, 1976, the southerly 18.87 acres was zoned
"M-l" and the northerly portion of approximately 5.12 acres wa:
zoned "B" (Light Business) by the Southold Town Boad, after
referral to the Planning Board and the Suffolk County Planning
Commission, which deemed the chanqe of zone a matter of local
determination subject to compliance with the following conditi~
1. Public water supply and sanitary sewage disposal will
be supplied by the Inc. Village of Greenport.
2. The number of campsites will be limited to 162 in com
pliance with "M-i" District requirements.
3. The buildings erected on Parcel II will be only those
used in connection with transient travel campgrounds.

A 100 ft. landscaped buffer zone comprising 0.4732
acres will be provided on the northerly portion of th~
premises as it fronts on Middle Road (CR27).
5. Queen Street is to be widened and improved as per
of Southold specifications.
The Suffolk County Planning Department has again on July
1976, approved the revised plan as presented to the Board of
Appeals and as approved by the Southold Town Planning Board on
June 21, 1976, stating that the current proposed Special Excep~
tion by the Board of Appeals is a matter for local determinati~
since the current proposed action of the Appeals Board is more
restrictive than the conditions set forth in the Planning Com-
mission letter of April 10, 1975~
In summary as of this date, the Board finds that the fol-
lowing agencies of County and Town government have acted as fol
lows in this matter:
Suffolk County Planning Commission - the Commission h.
reviewed this application several times and has deeme~
it a matter for local determination subject to the co~
ditions set forth in their letter of April 10, 1975.
Suffolk County Department of Health - the Health Depa~
ment approval has been received and copies of approve~
drawings have been sent to the Southold Town Planning
Board and Building Department as per letter dated Jun,
1976, from Richard C. Wilton for Eastern Long Island
Kampgrounds, Inc..
Suffolk County Department of Public Works - a pez~mit ]

6. Village of Greenport - the Village has signed a sewage
contract with the applicant and agrees to furnish wate~
7. The Board of Appeals - the Board held a hearing on
June 10, 1976, for a Special Exception and recessed
hearing until further notice. Pages 16-36 of the Boar(
minutes of June 10, 1976, record the hearing. A publi~
notice of the continuation of the recessed hearing is
given in the current Town newspapers.
The Board further finds that in addition to the above acti~
the following individuals or organizations have contributed an
understanding of this project for the establishment of 73 camp-
sites at the present time known as Section I:
1. Building Inspector - assistance in all aspects of plan.
ning including parking requirements estimated at 20,001
- sq. ft. adjacent to administration building.
2. $outhold Town Planning Board - initial recommendations
for change of zone, review of site plans, overall re-
quirements as to water, sewage, buildings, etc.
3. Holzmacher, McLendon and Murrell, Consulting Engineers
water and sewage layout.
4. John Jacobsen, Traffic En.~ineer - traffic count of ap-
proximately 400 or less per hour on CR27 between 4:00
P.M. and 8:00 P.M. on Memorial Day Weekend. K.O.A.
studies indicate a vehicular trip total of three (3)
per day per occupant of the campsite. Usual check-in
time is between 4:00 P.M. and 8:00 P.M..
5. Richard ~oopman - prepared a 36-page environmental stuc
for the applicant.
Richard C. Wilton - a soil study noted by Mr. Wilton il
dicates clay under a portion of the site, which will r~
quire sewer arrangements.
The Bcard finds that the public convenience and welfare ant
justice will be served and the legally established or permitted
use of neighborhood property and adjoining use districts will nc
be permanently or substantially injured and the spirit of the
Ordinance will be observed.
THEREFOP~E IT WAS RESOLVED, Richard C. Wilton, President,
Eastern Long Island Kam, pgrounds, Inc., P.O. Box 89, 600 Queen
Street, Greenport, New York be GRANTED permission to construct ~
campground and trailer park on the south slde of CR27 and the
west side of Queen Street, Greenport, New York, subject to the
following coDditions, which include the eight conditions origi-
nally outlined by the Town Board as well as additional conditiox
and interpretations of %he Board of Appeals:
1. That public water supply and sanitary sewage disposal
to the premises which are the subject of this

resolution be supplied by the Incorporated Village of
Greenport at ~the sole cost and expense of the petition-
ers which said water supply and sewage disposal system~
shall comply with all of the requirements of all agen-
cies having jurisdiction thereof, and that said water
supply and sewage disposal systems be installed and in
operation prior to the occupancy of the premises for
any purpose whatsoever.
2. That in the event that any portion of the premises lo-
cated within 100 feet of the land owned by the Village
of Greenport is utilized for campgrounds or trailer
sites, a 6 foot chain link or equivalent type fence
shall be erected and maintained along the boundary lin~
of said land of the Village of Greenport.
. That the portion of the premises adjacent to County
Route 27 to a distance of 100 feet therefrom shall be
at all times maintained as a landscaped buffer zone an(
that no buildings or structures of any type whatsoever
shall be erected or maintained thereon. That the type
and location of landscaping within said buffer zone be
approved by the Planning Board of the Town of Southold
that in the event that County Route 27 shall be widene(
altered or relocated that said buffer zone shall be ex.
tended so that said buffer zone shall at all times ex-
tend 100 feet from the said highway.
4. That to minimize traffic hazards that may occur by rea-
son of trailer vehicles entering and leaving said prem-
ises, suitable turn-off or deceleration lanes or such
other highway facilities as the agency having juris-
diction of County Route 27 shall prescribe shall be pr(
vided.

That in order to provide suitable access to the premis~
over Queen Street, a 33 foot wide Town highway, the sm
will be nequired to be widened to 50 feet. Prior to o(
cupancy of the rezoned premises by the owners thereof
for trailer park purposes, the owners shall at their o%
expense improve and pave a 17 foot strip along the wes~
erly boundary of Queen Street in accordance with the
Town highway requirements and when so improved and paw
dedicate the same to the Town of $outhold.

proved as far south as the southerly side of the en-
trance to the K.O.A. campground but not beyond.
That the portion of the premises extending from a poin-
100 feet south of County Route 27 to a point 600 feet
south of County Route 27 be restricted to open recrea-
tional uses with no structures constructed thereon.
The Board of Appeals, after consultation with the Town
Board, construes the prohibition against structures to
not prohibit fencing such as fencing which may bound ti
property; suitable fencing for recreational facilities
such as tennis, baseball, and other recreational uses;
small storage structures for recreational equipment.
The westerly border of the applicant's property shall 1
fenced with a 6 foot, chain link fence or equivalent a:
far south as land of Village of Green~ort, at which po
Condition 92 becomes applicable.

That any use of said premises as a campground as pro-
posed by Petitioners shall be on a seasonal basis
for the period from April 1st to November 30th of eac
year.
8. That sa~d premises be used only for the purpose of op
erating thereon campgrounds franchised by Kampgrounds
of America, Inc. in accordance with all of the ordi-
nances, laws and regulations of the Town of Southold
and other authorities hav~ng jurisdiction thereof and
that no buildings or structures shall be erected on
premises nor shall the premises be used for any use
cept the uses specified herein and uses accessory and
incidental thereto.
CONDITIONS ADDED BY THE BOARD OF APPEALS
9. A condition of granting this special excsption is tha!
the applicant's site plan shall meet all requirements
of the Tour/st and Trailer camp ordinance, which in-
cludes the requirement of a permit issued by the Town
Board. Among other things, minimum requirements undez
this ordinance require camp sites shall be not less
than 50 x 100 feet in area located so ~s to be readily
accessible from roadways or driveways; constructed to
a minimum width of 24 feet; constructed in accord with
Southold Town ~ighway specifications. No building per
mits may be issued until all requirements of Town or-
dinances have been met.
10. A parking lot of at least 20,000 sq. ft. built to Town
Highway Department specifications adjacent to the main
administration building shall be provided.

developed in accordance with the approved plan granted on September 12, 2006 through
