SUPERVISOR RUSSELL: Please rise and join with me in the Pledge of Allegiance to the Flag.
Before we get on with the regular meeting, we have a presentation that we would like to give out.
So, Philip Beltz, I am going to ask you to come up and tell everybody a little about the
competition.
Phillip Beltz, Chairman Youth Board
PHILIP BELTZ, SPECIAL PROJECTS COORDiNATOR: The Town of Southold Youth
Bureau decided to have a photo website competition for the town's newly created website. So
the Youth Board held a competition, we got responses from over a dozen students from
throughout the Town of Southold and we had a very difficult evening trying to judge who the
three awardees are. However, after a good two hour discussion and vetting of it and Councilman
Orlando was there as well, we came up with one person selected as having the winning entry and
we have two honorable mentions. So the Supervisor has recognition certificates and we also
have i-tune cards for you.
SUPERVISOR RUSSELL: Honorable mention, Evelyn Fisher.
MR. BELTZ: Thank you very much.
SUPERVISOR RUSSELL: We have another certificate of honorable mention, Katie Marlo.
MR. BELTZ: Katie could not make it tonight.
SUPERVISOR RUSSELL: First place winner is Luke Bugdin.

achievement of the youth in this community is astounding. And congratulations to all of you. I

WHEREAS the Board of Commissioners of the Fishers Island Ferry District adopted a
resolution at their June 30, 2011 to hire two part-time seasonal employees for the operation of
the movie theater for the summer season from July 1 st until September 7, 2011. Michael Conroy
as a Seasonal Recreational Aide at $125.00 per movie and Karla Heath as a Seasonal Clerk at
$200.00 per week, and
WHEREAS the Town Board of the Town of Southold is required to approve appointments and
salary adjustments of employees of the Fishers Island Ferry District, now therefore be it
RESOLVED that the Town Board of the Town of Southold hereby appoints Michael Conroy as
a Seasonal Recreational Aide at $125.00 per movie and Karla Heath as a Seasonal Clerk at
$200.00 per week. These appointments will begin on July 1,2011 and end on September 7,
2011.

Fiscal Impact:
.4 Resolution ,4uthorizing the Filing of an ,4pplication for a State Assistance from the Household
Hazardous Waste (HHPV) State Assistance Program and Signing of the ,4ssociated State Contract, Under
the '4ppropriate Laws of New York State.
WHEREAS, the State of New York provides financial aid for household hazardous waste
programs; and
WHEREAS the Town of Southold, herein called the MUNICIPALITY, has examined and duly
considered the applicable laws of the State of New York and the MUNICIPALITY deems it to
be in the public interest and benefit to file an application under these laws; and
WHEREAS, it is necessary that a Contract by and between THE PEOPLE OF THE STATE OF
NEW YORK, herein called the STATE, and the MUNICIPALITY be executed for such STATE
Aid;
NOW, THEREFORE,
BE IT RESOLVED BY the TOWN BOARD of the TOWN OF SOUTHOLD
That the filing of an application in the form required by the State of New York in
conformity with the applicable laws of the State of New York including all understanding
and assurances contained in said application is hereby authorized.
That Supervisor Scott A. Russell, or his/her designee is directed and authorized as the
official representative of the MUNICIPALITY to act in connection with the application
and to provide such additional information as may be required and to sign the resulting
contract if said application is approved by the STATE;

That the MUNICIPALITY agrees that it will fund the entire cost of said household
hazardous waste program and will be reimbursed by the State for the State share of such
costs.

Suffolk County Historical Society to use the following roads and town beaches for its
bicycle run on Sunday~ September 18~ 2011 beginning at 8:30AM in Riverhead, heading east
into Southold: Sound Avenue to Southold Town Beach continuing to Greenport's Main Road;
return trip via Main Road (Route 25) west to Bay Avenue in Mattituck to Peconic Bay Boulevard
into Riverhead, provided they file with the Town Clerk a One Million Dollar Certificate of
Insurance naming the Town of Southold as an additional insured and notify Capt. Flatley within
ten (10) days of the approval of this resolution to coordinate traffic control. Support is for this
year only, as the Southold Town Board continues to evaluate the use of town roads.

Create Economic Development Committee and Advertise for Resumes
WHEREAS, on October 20, 2009 the Town Board adopted a resolution calling for the
development of a new comprehensive plan, SouthoM 2020, acknowledging the need for a single
and concise document for guidance on Town policies, and
WHEREAS, community feedback on the Economic Development Chapter of the plan
suggested that the Town Board immediately create an Advisory Committee to the Town Board
known as the Southold Town Economic Development Committee to advance efforts to promote
economic development in the Town of Southold; and
WHEREAS, the Town Board would like to act on this recommendation to improve economic
development and to assist residents and bUsinesses,
NOW, THEREFORE, be it
RESOLVED that the Town Board of the Town of Southold hereby creates the Southold
Economic Development Committee consisting of representatives from a diverse range of
businesses and industries who will be responsible for making recommendations to the Town
Board regarding the development and implementation of successful initiatives relating to
economic development in the Town of Southold and further direct the Town Clerk to advertise

WHEREAS, Suffolk County has developed a program known as GML 72-H Affordable
Housing to transfer real property of tax-defaulted properties taken by the County to
municipalities exclusively for the purpose of developing affordable housing, and
WHEREAS, Suffolk County has offered the Town of Southold a site in the hamlet of Greenport
West that could possibly be developed as a two-bedroom affordable housing unit.
WHEREAS, The Town Board is interested in accepting the conveyance of the parcel from
Suffolk County for the development of an affordable housing unit, now therefore be it
RESOLVED, that the Town Board hereby authorizes Supervisor Scott A. Russell to execute a

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 260, Vehicles
and Traffic~ in connection with Parking on Factory Avenue".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Purpose.
Parking associated with Factory Avenue in the hamlet of Mattituck has resulted in
conditions that impact the public health, safety and welfare in the surrounding
community. The conditions consist of undue congestion, restrictions on access and
maneuverability as well as dangerous traffic impacts. Accordingly, it is necessary to
impose a range of parking limitations in this area to protect the residents of the Town and
restrict the blocking of traffic flow and the orderly use of Town roads. Accordingly,
Amendments to Chapter 260 are warranted.
II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows:

Law entitled, "A Local Law in relation to the Prevention and Control of Noise Pollution in
the Town of Southold" reads as follows:

A Local Law entitled, "A Local Law in relation to the Prevention and Control of Noise
Pollution in the Town of Southold".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. A new Chapter 200 of the Code of the Town of Southold is hereby adopted as follows:
§200-1. Title. This law shall be known as the "Prevention and Control of Noise Pollution Law
of Southold Town."
§200-2. Purpose. The gentle pace of life in the Town of Southold has traditionally provided a
respite from the noise and turmoil which has become an integral part of life in the city and
suburbs and which has even encroached into many resort areas on the East End. Crafting of
regulations that are uniquely appropriate for the Town of Southold are aimed to protect this rural,
almost nostalgic way of life while providing an atmosphere for businesses to flourish. The

existence of unreasonably loud, unnecessary disturbing or unusual noise within the Town has
become an increasingly, significant problcnn during recent years. Such noise pollution which is
prolonged, unusual or unnatural in its time, place and use is harmful to the peace, welfare,
comfort, safety, convenience, good order and prosperity of the inhabitants of the Town of
Southold. It is the public policy and findings of the Town Board that every person is entitled to
noise levels that are not detrimental to life, health and the enjoyment of his or her property. The
provisions and prohibitions hereinafter enacted are in pursuance of this policy and these findings
and for the purpose of protecting and promoting the public health, comfort, convenience, peace,
safety, welfare and prosperity of the Town of Southold and its inhabitants.
§200-3. Statutory authorization. This chapter is enacted pursuant to § 10 of the Municipal
Home Rule Law to promote the public health, safety and general welfare of Town citizens
through regulations intended to govern noise pollution within the entire Town.
§200-4. Definitions. As used in this Chapter, the following terms shall have their meanings
indicated.
AIRBORNE SOUND - Sound that reached the point of interest by propagation through the air.
AMPLIFIED SOUND - Sound which has its volume increased by electronic means.
CHARITABLE EVENT - An event whose sole purpose is to raise money for a specific charity
or non-profit organization.
COMMERCIAL SERVICE EQUIPMENT - All engine-powered or motor-powered equipment
intended for infrequent service work in inhabited areas, typically requiring commercial or skilled
operators. Examples of commercial service equipment are chain saws, log chippers, paving
rollers, etc.
CONSTRUCTION DEVICE - Any powered device or equipment designed and intended for use
in construction. Examples of construction devices are air compressors, bulldozers, backhoes,
trucks, shovels, derricks and cranes.
dB(A) - The A-weighted sound level in decibels, as measured by a general-purpose sound-level
meter complying with the provisions of the American National Standards Institute specifications
for sound-level meters, properly calibrated and operated on the A-weighing network.
DECIBEL ("dB") - The unit for measuring the volume of a sound based upon the pressure level
ora sound. For the purpose of this chapter, the standard reference pressure stated herein will be
used to assure a consistent and standard reference for measuring sound.
HOMEOWNER'S LIGHT RESIDENTIAL OUTDOOR EQUIPMENT - All engine-powered or
motor-powered garden or maintenance tools intended for repetitive use in residential areas,
typically capable of being used by a homeowner. Examples of homeowner's light residential
outdoor equipment are lawn mowers, garden tools, tiding tractors, snowblowers, snowplows, etc.
NOISE POLLUTION - Airborne or amplified sound which:
A. Causes temporary or permanent heating loss in persons exposed; or
B. Is otherwise injurious, or tends to be, on the basis of current information injurious to
the public health or welfare; or
C. Disturbs a reasonable person of normal sensitivities;
D. Exceeds standards or restrictions established herein; or
E. Interferes with the comfortable enjoyment of life and property or the conduct of

business. The following are deemed to interfere with the comfortable enjoyment of
life and property or the conduct of business:
1. Yelling or shouting that disturbs the quiet, comfort or repose of person or
persons residing or occupying an adjacent or neighboring property.
2. The using of, operating of or permitting to be played, used or operated,
any radio, receiving set, musical instrument, phonograph, television set
or other machine or device for the producing or reproducing of airborne
or amplified sound in such a manner as to disturb the peace, quiet and
comfort of the person or persons residing or occupying an adjacent or
neighboring property.
PERSON - An individual, association, firm, syndicate, company, trust, corporation, department,
bureau or agency or any other entity recognized by law as the subject of rights and duties
SOUND-LEVEL METER - An instrument for the measurement of noise and sound levels
including a microphone, amplifier, an output meter and frequency weighting networks which
comply with standards established by the American National Standards Institute (ANSI)
specifications for sound-level meters.
§ 200-5. General prohibition. No person or persons owning leasing or controlling the operation
of any source of noise on any lot or structure within the Town shall permit the establishment of a
condition of noise pollution. Except as provided in §200-6, the use of amplifiers, speaker or
other machines or devices capable of reproducing amplified or airbome sound from the premises,
dwelling or building within the Town shall be considered noise pollution and shall be prohibited
at all times.
§ 200-6. Standards. No person shall create or cause to be emitted any noise pollution which
when measured on a sound-level meter from the property line of a complaining property owner
exceeds the following standards:
A. Sunday through Thursday: (i) from 7:00 a.m. to 7:00 p.m. airborne or amplified sound in
excess of 65 dBA; and (ii) from 7:00 p.m. to 7:00 a.m. airborne or amplified sound in
excess of 50 dBA.
B. Friday and Saturday: (i) from 7:00 a.m. to 11:00 p.m. airborne or amplified sound in
excess of 65 dBA; and (ii) from 11:00 p.m. to 7:00 a.m. airborne or amplified sound in
excess of 50 dBA.
§ 200-7. Exceptions.
A. The provisions of §200-5 and §200-6 shall not apply to the following:
1. The intermittent or occasional use between 7:00 a.m. through 9:00 p.m. of
homeowner's light residential outdoor equipment with mufflers or commercial
service equipment, provided that such activities and such equipment and their use
comply with the other provisions hereof.
2. Construction activities between 7:00 a.m. through 7:00 p.m. and the associated
use of construction devices or the noise produced thereby, provided that such
activities and such equipment and their use comply with the other provisions
hereof.
3.Noise from agricultural equipment.
4.Noise from church bells or chimes used.

5. Noise from snowblowers, snowthrowers and snowplows when operated with a
muffler for the purpose of snow removal.
6. Non-amplified noise generated from lawful athletic or recreational activities,
events, or facilities.
7. Non-amplified noise-organized activities sponsored by any school district, private
school or fire district or department within the Town of Southold.
8.Noise from municipally sponsored celebrations or events.
9. Noise from lawful fireworks displays, parades, and other charitable and special
events held in accordance with all pertinent provisions of the Southold Town
Code.
10. Noncommercial public speaking or public assembly activities conducted on any
public space or public fight-of-way.
11.Emergency construction or repair work.
12. Noise from the activities of any fire depamnent, ambulance squad or similar
emergency or rescue organization in carrying out their official duties.
13. Noncommercial amplified sound that does not exceed the noise standard
established in §200-6 of this chapter.
14.Emergency stationary and mobile signal devices.
15.Audible exterior burglar alarms in operation for 15 minutes or less.
§ 200 - 8. Enforcement. The provisions of this chapter shall be administered and enforced by
the Southold Town Police Department and the Southold Town Office of Code Enforcement.
§ 200- 9. Penalties for offenses.
A. Any person who shall violate any provisions of this chapter shall be guilty of a violation
punishable by a fine not exceeding $500; and upon conviction of a subsequent offense,
punishable by a fine not exceeding $2,500. If the violation is ora continuing nature, each
one hour period of violation of any provision of this chapter shall constitute an additional,
separate and distinct offense.
B. In addition to any other remedy provided by law, the Town may bring an injunction
proceeding to enforce this chapter.
II. SEVERABILITY

Comments regarding resolution 539
SUPERVISOR RUSSELL: Let me just clarify for everyone's sake that that noise code is not
going to be an all encompassing code. There is undoubtedly going to be noise in a community
that is living and breathing and working and dying. This is about unreasonable noise at
unreasonable levels at unreasonable hours. Obviously new Board's can undertake the issue of
noise in the future, for the time being, we tried to simply bring some measure of satisfaction to
communities that have been put out by people that have just simply been disrespectful neighbors.
It is not about weed whackers and all the other things you hear about every day.

Enact Local Law to Amend the Zoning Map of the Town of Southold by Changing the Zoning Designation
of that Portion of SCTM #1000-140-2-32from R-40 to LI"
WHEREAS, by Local Law No. 30 of 1999, the Town Board of the Town of Southold, in
connection with the County Route 48 Land Use Study, rezoned the entirety of a parcel of land in
Mattituck identified as SCTM #1000-140-2-32, from Light Industrial (LI) to
R-40; and
WHEREAS, the rezoning of the entirety of the parcel appears to have been in error, as the
supporting Planning documents contemplated rezoning only the portion of that parcel fronting on
Mary's Road from LI to R-40; and
WHEREAS, the Town Board finds it appropriate to correct that error and to rezone the portion
of SCTM #1000-140-2-32 that was to have remained LI, back to LI; and
WHEREAS, rezoning of the portion of the subject site as LI is consistent with the County Route
48 Land Use Study, and
WHEREAS the Town Board of the Town of Southold has considered the change of zone of that
portion of SCTM #1000-140-2-32 that was intended to remain LI on its own motion; and now

Swain Dev Rights Elect to Purchase & SEQRA
WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of
the purchase of a development rights easement on a certain parcel of property owned by Bradley
T. Swain on the 19th day of July, 2011, at which time all interested parties were given the
opportunity to be heard; and
WHEREAS, said property is identified as part of SCTM #1000-107.-5-1.1. The address is 4390
Mill Lane in Mattituck. The property is located in the A-C zoning district and is situated on the
easterly side of Mill Lane approximately 300 feet northwesterly from the intersection of Mill
Lane and Wickham Avenue in Mattituck, New York; and
WHEREAS, the development rights easement comprises a part of the property consisting of
approximately 12.4+ acres (subject to survey) of the 15.4± acre parcel. The exact area of the
development rights easement is subject to a survey acceptable to the Land Preservation
Committee and the property owner; and
WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase
price is $65,000 (sixty-five thousand dollars) per buildable acre for the 12.4± acre easement plus
acquisition costs; and
WHEREAS, the property is listed on the Town's Community Preservation Project Plan as
property that should be preserved due to its agricultural value; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the
LWRP; and

WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; and,
WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and
Regulations for this action; and, be it further
RESOLVED that the Town Board of the Town of Southold hereby elects to purchase a
development rights easement on agricultural land owned by Bradley T. Swain, identified as part

Comments regarding resolution 541
COUNCILMAN RULAND: I would like to reiterate Councilman Krupski's comment about that
particular parcel and that particular corridor, from Route 25 to Oregon Road. Certainly it is a
key piece, I think as someone who owns property on the lower end of Mill Lane and it is part of
the preservation program, that when you look at the map it doesn't do as much justice as if you
ride up Mill Lane and what you can see and more importantly I think as Albert, as you have said
in the past, what people will continue to see indefinitely. And I vote Aye.
SUPERVISOR RUSSELL: If you choose to drive up Mill Lane and it is late at night, honk and
say hi to Bill.

York, the Town Board of the Town of Southold will hold a public hearing on a proposed
Local Law entitled "A Local Law to amend the Zoning Map of the Town of Southold by
Changing the Zoning Designation of that portion of SCTM #1000-140-2-32 from R-40 to
LI" at Southold Town HaH~ 53095 Main Road~ Southold~ New York~ on the 19th day of July~
2011 at 4:35 p.m. The portion of the property to be rezoned is approximately .52 acres, is
located off of Mary's Road in Mattituck.
I have a notice that it was posted on the Town Clerk's bulletin board on June 28 and that it was
posted in the Suffolk Times on July 7, 2011. I have a couple of letters, one from Martin Sidor,
chairman of the Southold Planning Board, "Thank you for the opportunity to provide comments
on the proposed local law referenced above. Then Planning Board has reviewed the proposed
legislation and supports this zone change." And from the LWRP coordinator, "The proposed
local law has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold and the LWRP policy standards. Based upon the information provided to this
department as well as the records available to me, it is my recommendation that the proposed
action is exempt from LWRP coastal consistency review pursuant to Chapter 268-3 and therefore
consider this recommendation in preparing its written determination regarding the consistency of
the proposed action." And from the Suffolk County chief planner, "Pursuant to the requirements
of section A 14-14 through A 14-25, the Suffolk County administrative code, the above
referenced application which has been submitted to the Suffolk County Planning Commission is
considered to be a matter of local determination as there is no apparent significant countywide or
inter-community impact. A decision of local determination shall not be construed as either an
approval or a disapproval." We have a letter from the applicants attorney. "We are the attorneys
for John and Frances DiVello, the owners of the property in question. We reiterate their
opposition to the original rezoning of any portion of the property to R-40, as set forth in the
record in the original rezoning proceeding in 1999 and in the action brought under Supreme
Court index # 00-08376. We ask that those matters be incorporated by reference into this

Code, the Town Board of the Town of Southold hereby sets Tuesday~ July 19~ 2011~ at 4:32
p.m.~ Southold Town Hall~ 53095 Main Road~ Southoid~ New York as the time and place for
a I~ublic hearinr, for the purchase of a development rights easement on property owned by
Bradley T. Swain. Said property is identified as part of SCTM #1000-107.-5-1.1. The address is
4390 Mill Lane in Mattituck. The property is located in the A-C zoning district and is situated on
the easterly side of Mill Lane approximately 300 feet northwesterly from the intersection of Mill
Lane and Wickham Avenue in Mattituck, New York. The proposed acquisition is for a
development rights easement on a part of the property consisting of approximately 12.44- acres
(subject to survey) of the 15.44- acre parcel.
The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owner. The easement will be acquired using
Community Preservation Funds. The purchase price is $65,000 (sixty-five thousand dollars) per
buildable acre for the 12.44- acre easement plus acquisition costs.
The property is listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Deparm~ent, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.
I also have a notice that it was posted on the Town Clerk's bulletin board on July 7. That is was
posted in the Suffolk Times on July 14, 2011 and we have got a short environmental assessment
form. And that is it.

COUNCILMAN KRUPSKI: I would just like to say that as the liaison to the Land Preservation
Committee, this is one of the easier decisions they've made. This is, them is a lot of road
frontage, it is active farmland. It adds to a nice block of preserved land in that part of Mattituck
and we are very happy the Swain family decided to go this route. It really does add to the
agricultural community there.
SUPERVISOR RUSSELL: I want to thank the Swain family for their generosity, the
preservation program works because we have willing landowners that are willing to participate
in the program and I want to thank them very much for their participation.

Leroy Itilliger, Mattituek
LEROY HEYLIGER: Good afternoon. My name is Leroy Heyliger and I live on Wickham
Avenue in Mattituck. First of all, I would like to thank the Board very much for their work on
the local law that you have passed for Factory Avenue. Certainly it is a piece of legislation
which we sorely needed, the attention to in that area. However, I am here with concern about a
beloved person in our community who died in a terrible accident on the comer of Wickham
Avenue on June 24. Her name was Judy Utter, she was 96 years of age and she was well-known
to the theatre goers for her work with the North Fork Community theatre. Also, I had occasion
to see her once in a while at the post office and when I, that terrible day when this accident
happened, she was making a left hand turn off of Route 48 onto Wickham Avenue which was
reported in the paper. She made that left hand turn and was struck by an asphalt track which
toppled over and spilled, she was killed instantly I believe. It was a terrible accident. I was on
my way home when I saw what happened and of course, the whole road was closed down for
several hours. We have had a lot of accidents there in the past. I have been living them since
1966 and the traffic has really gotten, coming off of Route 48, coming on Wickham Avenue,
then Grand Avenue up to Briarswoods, there has been developments, there has been homes put
them and there is a lot of traffic when the people are coming home especially this time of the
night and also the elderly who go shopping and come back home and it is a dangerous situation.
And I was just wondering if there was some way, like at Cox Neck Road, they have that light,
you know the left hand turn and we all know for senior citizens, in the defensive driving courses
they tell us left hand turns are the most dangerous especially for senior citizens and I am
wondering if some consideration could be given to have a light installed there, a green light for a
left had turn.
SUPERVISOR RUSSELL: Let me explain, we actually, that particular stretch of road is under
the jurisdiction of the Suffolk County Department of Public Works, it is a county road. On
behalf of the Town Board I have contacted the commissioner of the Suffolk County Department
of Public Works and asked for turning lanes, turning signals there, light signals and in addition to
that, a study of that area to bring more permanent traffic calming solutions because Route 48

isn't the road we remember growing up. It is a much different road today and we are asking the
county to look at the whole area. There has been a number of accidents over the past few years
and we are asking them for their evaluation to bring some sort of traffic calming solution to that
section that they control.
MR. HEYLIGER: Okay. Thank you.
SUPERVISOR RUSSELL: Would anybody else like to come up and address the Town Board
on any issue?

COUNCILMAN RULAND: I would like to make a comment, Scott. To Mr. Heyliger, we had a
meeting with the Chief of Police today and one of the discussions we had concerned Factory
Avenue and the fact that we felt that we were going to adopt that local law this evening and that
is going to prompt additional signage on Factory Avenue, some of which as you know and I have
seen has been removed by someone. So the plan is that the parking, the no parking signs are
going to be reinstalled where missing and the new ones put where they are supposed to be and
we made him aware of the fact that this was an important quality of life issue for that section of
the hamlet, not only for the residents who live along there but for the people who traverse it as
well. And made it known to him that we felt that enforcement, once the signs went up, should
begin right away. To make people understand that this is how we are going to rectify the
problem and we need to make it stick.
Councilman Vincent P. Orlando
COUNCILMAN ORLANDO: And plus, we also addressed the 5 minute idling role, the state
law. Tracks idling more than 5 minutes there.

SUPERVISOR RUSSELL: With the issue, with more specific to the issue of your church, we
are exploring all opportunities to try to either relocate that, our effort is to try to relocate that
dumpster out of your view, from that one business owner that is maintaining it there. And we are
pursuing all of our legal options there.
Councilman Talbot
COUNCILMAN TALBOT: One other thing that we had discussed because it came up at our last
meeting, the people from out of town and camping on the Sound, it was brought up last meeting
by a resident here regarding 67 steps and we spoke to the Police Chief today as well and there is
going to be a greater police presence on the Sound shore line in the entire area of Southold
Town. So, we look to nip that in the bud.
