RE:
STEPHEN & CHARLOTTE WAGNER, 20 HARBOR RIVER ROAD, ORIENT
SCTM# 24-1-11
Dear Ms. Santora:
The Southold Town Board of Trustees reviewed the survey prepared by Stanley J. Isaksen, Jr.
last dated October 4, 2005, received March 1, 2007 and determined the proposed construction
of an enclosed porch and bilco doors to the single family dwelling to be out of the Wetland
jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff, without further
authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or
Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions
are taken to prevent any sedimentation or other alteration or disturbance to the ground surface
or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may
result from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your
project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to call.

DEC No. 1-4738-00586/00003
As you requested, enclosed is a revised Page 1 of your permit which becar
9/19/2007. Please note that since the proposed addition of the porch area
installation of the cellar door are so minimal in area (a total of only 114 squ;
are located more than 75 feet from the Tidal Wetland boundary, they woul(~
a permit under the regulations.
In addition, you will note that the description of "Authorized Activity" contain
phrase, ",A!,I work shall be done according to the enclosed plans stamped '1
Approved. This covers all activities proposed on the approved site plan, wi
in that description or not. Any substantial changes to that plan would, howe
that an amendment to your permit be issued.
A copy of the revised page is being faxed to your agent, En-Consultants.
