Dear Ms. Shannon:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
The portion of your property which is located landward of the twenty foot (MSL) elevation contour on
a gradual, natural slope, as shown on the survey prepared by Stanley J. Isaksen, Jr, last revised June
12, 2007, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit la required under the Tidal Wetlands Act, Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the
ground sudace or vegetation within Tidal Wetlands jurisdiction which may result from your project.
Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence,
barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.

SEORA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls under the
Type II category of the State's List of Actions, without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The apphcant's property consists of 22,352
square feet with 75 feet along Peconic Bay Boulevard, 74.43 feet along the rear
property line adjacent to the bulkhead, and 338/48 feet between the front line at the
street and the high water line at the bulkhead along Great Peconic Bay. The property
is improved with a wood frame, single-family dwelling and accessory garage, as shown
on the June 12, 2007 survey prepared by Stanley J. Isaksen, Jr., Land Surveyor.
BASIS OF APPLICATION; This application for Variances under Sections 280-122A
and 280-124 is based on the Building Inspector's August l, 2008 Notice of Disapproval,
concerning a proposed demolition (in part), renovations and additions to the existing
dwelling, with an increase in the degree of the nonconforming side yard to be ]ess than
15 feet on one side, and less than 35 feet for the combined side yard setbacks.
RELIEF REQUESTED: The applicant wishes to make partial £rcst-floor alterations
and additions to her existing house that will involve adding a new front porch with a
conforming front yard setback, creating a new outside access to the basement,
expansions of the existing second floor, and raising the height of the existing roof ridge
to create a conforming interior ceiling height on the existing and expanded portion of
the second floor. All additions and alterations to the first floor will remain within the
existing non-conforming westerly side yard setback of 18.7' - 13.8' and the existing non-
conforming 5.1' easterly side yard setback. The proposed additions TO the second floor
extend 1.6 feet into the existing easterly side yard, thereby increasing the degree of
non-conformity.

FINDINGS OF FACT
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law ]267-biS)(b)¢3)(1). Grant of alternative relief will not produce an
undesirable change in the character of the neighborhood or a detriment to nearby
properties. The dwellings to the east and west of the applicant's property axe two
stories, of similar height, and well screened from view by mature evergreens. The
proposed steep roof pitch is designed to retain the Cape Cod style of the existing
dwelling that is also characteristic of houses in the neighborhood and will reduce the
impact on the easterly side yard.
2. Town Law {$267-b(3)(b)(3)(2). The benefit sought by the applicant cannot be
achieved by some method, feasible for the applicant to pursue, other than an area
variance because the existing house already has side yard setbacks that are less than
15' and the total side yard setbacks are less than 35' that would be required per code.
3. Town Law {$267-b(3)(b}{3}(3}. The variance granted herein is substantial. The
existing non-conforming easterly side yard of 5.1' is already a 66% reduction (variance)
from the code required minimum of 15'. The Board finds that reducing this setback by
1.6' on the second story to create a 3.5' side yard setback for primarily aesthetic reasons
is too substantial to grant as applied for.
4. Town Law ~267-b(3}fb}{3)(5). The alleged difficulty has not been self-created but
is the result of the existing non-conforming side yard setbacks on a lot that is narrow at
75' and very deep at +/- 339 feet.
5. Town Law §267-b~3}(b}~3)(4). No evidence has been submitted to suggest that
the proposed additions will have an adverse impact on physical or environmental
conditions in the neighborho~l. A Trustees permit has been obtained, a letter from
Suffolk County Soil and Water dated September 22, 2008 signed by Paul TeNyenhuis
indicates that the proposed additions and alterations will have no negative impact on
Peconic Bay, a letter from the Southald Town LWRP Coordinator, Mark Terry, dated
October 2, 2008 reports that the proposed action is consistent with the LWRP review
pursuant to article 268 of the Southold Town Code, and the site plan prepared by the
architects Searles, Stromski, Associates proposes to contain storm water with the
installation of two new storm drainage rings.
6. Town Law .q267-b. Grant of alternative relief is the minimum action necessary
and adequate to enable the applicant to enjoy the benefit of an enlarged and renovated
dwelling, while preserving and protecting the character of the neighborhood and the
health, safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-b, motion was offered by Member
Oliva, seconded by Member Simon, and duly carried to
DENY the variance as applied for, and to GRANT ALTERNATIVE RELIEF for a
second floor expansion which may intrude into the existin,q 5.1' side yard setback by
no more than 9 inches thereby creating a minimum side yard setback of 4.2 feet,
while retaining the existing 5.1 ff. first floor side yard setback.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicant's diagrams or survey site maps, are not authorized under this
application when involving nonconformities under the zoning code. This action does
not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and
other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature
for an alteration that does not increase the degree of nonconformity.
