(631) 765.1809 Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION REGULAR MEETING HELD JULY 30, 2009 ZBA File # 6288 - Dolores Villareal, Applicant Property Location: 722 Brown Street and (South Side of Linnett Street), Greenport CTM 1000-48.3-25.1 SEQRA DETERMINA_TION: The Zoning Board of Appeals has visited the property under consideration in this application and:determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The subject property is an 11,256 square foot pamel measuring 50.00 feet along Brown Street on the South, 225.14 feet along the Eastern boundary, 50.00 feet along Linnet Street on the North and 225.10 feet along the Western boundary. The property is improved with a two. story frame house as shown by a survey map amended Nov. 29, 1989 by Roderick Van Tuyl, L.S. BASIS OF APPLICATION: Requests for Variances under Section 280-15 based on the Building Inspector's June 10, 2008 Notice of Disapproval concerning a proposed new accessory garage building. The new construction will be located at less than the code required 15 foot side yard and be located in a front yard, instead o!~the code required rear yard location. FINDINGS OF FACT The Zoning Board o~Appeals held a public hearing on this application on June 25, 2009, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the pre'Perry, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant requests variances to construct a two-story 960 square foot accessoty garage structure (with a half bath), at 11 feet from the side property line located in a front yard, as shov~n on drawing number 042508/1 dated 11/02/2008 prepared by Robert O. Barrett, P.E. AMENDED APPLICATION: During the June 25, 2009 public hearing, the applicant was asked to bdng the plan into more conformity with the code. The applicant on June 26, 2009 submitted an alternative plan increasing the side yard setbacks to the code required minimum of 15 feet and reducing the size of the accessory garage structure to the code permitted maximum of 660 square feet (20 ft. by 33 ft.), bringing Page 2 - July 30, 2009 ZB File No. 6288 - Dolores,Villareal Applicant Property Location: 722 Brown St., Greenpod CTM 1000-48-3-25.1 the plan into moro conformity with the codes. The half-bath was also romoved, and the height of the structure to the top of the ridge was reduced to 18 feet permitting attic storage only, as shown on the revised 6126/09 drawing number 042508/1 by Robert O. Barrott. The structuro is proposed at 35 feet from the second front yard at Linnet Street and will still roquiro a front yard variance for its location. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections:, the Board makes the following findings: 1. Town Law §267,b¢3)(b)(3)H). Grant of the variance will not produce an undesirable change in the character of the nei[~hborhood or a detriment to nearby properties. The proposed accessory structure is a permitted use andr'its form and function will be similar to that of other accessory structures in this neighborhood. 2. Town Law §267-b(3)(b)12). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. All locations on this parcel for this proposed accessory garage structure will required a Front Yard variance. 3. Town Law §267-bi3)(b){3). The variance requested herein is not substantial. The proposed accessory garage structure will~ have a 35 foot setback from the Front Yard at Linnet Street and will conform to the code in all other aspects. 4. Town Law §267-b~3)(b)(5). The difficulty has not been self created. It is a consequence of this parcel having two Front Yards and no Rear Yard. 5. Town Law §267~(3)(bi(4i. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. As you know there are still outstanding violations on your property as well as two new violations based on my recent inspection. The existing shed is still in violation for its yard location and being onnstructed without the proper pecmits, as well as alterations to the existing dwelling (bathroom construction) pursuant to Chapter 144-8(A)(1) of the Southold Town Code, "No person, firm or corporation shall enmmance the erection, construction, enlargemant, alteration, removal, improvement, demolition, conversion or change in the nature of the occupancy of any building or structure, or cause the same to be done, without first obtaining a separate building permit from the Building Inspector for each such building or structure." I have noted that you are currently in front of the Southold Town Zoning Board of Appeals to construct a new garage to replace the existing shed and, as mantioned during my recent site visit, I am requiring that you submit a building permit for the bathroom construction immediately. Based on my inspection, I found two additional code violations, including the placement of an above- ground swimming pool, which is in violation for the same reasons mentioned above (shed) and an unregistered vehicle located on the property, in violation of 280-110, which states, "No unenclosed debris, vehicles, vehicle parts or refuse may be kept on property in a residential district, except registered motor vehicles, recreation vehicles, beats and commercial vehicles as set , forth in § 280-78, and except where located in an agricultural district and kept in connection with bona fide agricultural operations." Please remove the existing swimming pool and unregistered vehicle. I would like to re-inspect the property on August 21, 2009, to ensure that you are in compliance.
