THIS INDENTURE, made,the ';;l'~ay of January two thousand one
BETWEEN ETHAN KIBBE, residing at West Hill Road, New Lebanon, New York 12125,
party of the first part, and PATRICIA H. KIBBE, residing at 582 Viewland Drive, Yorktown Heights, New

WITNESSETH, that the party of the first part, in consideration ~f Ten Dollars and other valuable consideration paid by the party
of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party
of the second part forever, all his right, title and interest in,
THAT certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Fishers Island, in the Town of Southold, County of Suffolk, State of New York,
representing the entire interest of the party of the first part in said property, more particularly bounded and
described as follows:
BEGINNING at a point in the walk located northerly of Whistler Avenue, said point being 105.80 feet South
of a point which is 5,319.98 feet West of a monument marking the United States Coast and Geodetic
Survey Triangulation Station (PROS); and THEN RUNNING South 670 13' West 100.00 feet; THENCE North
220 47' West 173.86 feet to a point; THENCE North 670 46' East 100.00 feet to a point; THENCE South
" 22047' East 172.9 feet to the point of BEGINNING. Containing 0.40 acres, more or less.
TOGETHER with the right to use a strip of land 20 feet wide and 100 feet long located between the
northwesterly side of Whistler Avenue as it now exists and the southeasterly line of the premises for egress
and ingress to the premises until such time as said strip is accepted by the Town of Suffolk as a public road
known as Whistler Avenue.
TOGETHER with a right to use for purposes of ingress to and egress from the premises the following
described roadways in common with Race Point Corporation and owners of land which is situated on the
southeasterly side of Winthrop Drive and which was formerly owned by Race Point Corporation.
(1) A roadway 15 feet in width the center line of which is described as follows: BEGINNING at a point
on the proposed northeasterly line of Trumbul Drive said point being located 87.19 feet South of a point
which is 5,535.35 feet West of said "PROS" monument and thence running North 670 13' East 606 feet;
thence North 610 43' East about 97 feet; thence North 670 13' East about 431 feet to the southwesterly
i~ line of land of the Board of Education of Fishers Island Union Free School District No, 4,-'..: "1', I,
(2) A roadway 12 feet in width the center line of which is described as follows: BEGINNING at a point
on the northeasterly line of Winthrop Drive, said point being located 26.01 feet South of a point which is
5,564.10 feet West of the said "PROS" monument; and thence running North 670 46' East 380 feet to the
center line described as the last course of the roadway described in paragraph (3) below.
(3) A roadway 12 feet in width the center line of which is described as follows: BEGINNING at a point
on the westerly line of land of the Board of Education of Fishers Island Union Free School District No.4, said
point being located 439.20 feet North of a point which is 4,690.16 feet West of said "PROS" monument;
and thence running South 620 21' West about 609 feet; thence South 270 39' East about 105 feet to the
center line off the roadway described in paragraph (1) above subject to the right of Race Point Corporation,
owners of said roadways and strips of land and owners of property whose land is situated on the
southeasterly side of Winthrop Drive and which was formerly owned by Race Point Corporation to use said
roadways and strips of land comprising a portion of the premises for purposes of ingress to and egress from
their respective properties as aforesaid.

Being and intended to be the sam~. premises as conveyed to the party of the first part by deed dated
December 1, 1988 and recorded in the Suffolk County Clerk's Office, Division of Land Records on January
9, 1989 in Liber 10772 cpo 522 and deed dated March 30, 1990 and recorded in the Suffolk County Clerk's
Office, Division of land Records on April 13, 1990 in Liber 11052 cpo 114.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads abutting the
above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the perty
of the first pert in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second pert,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive
the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The_wQr.d_ "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
