TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streels and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of Ihe first part in and to said premises; TO HAVE AND TO HOLD the premises
herein grant,ed unto the party of the seconu part, the heirs or Sllccessors and assigns of the parly of the second part
forever.

AND the party of the first part, in compliance with SeCtion 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

BEGINNING at a stone monument set on the northerly side of a road 40 feet wide, and monument
being 329.96 feet north of a point which is 2914.97 feet wcst of another monument marking the U.S..
Coast and Geodetic Survey Triangulation Station "NIN" (which "NIN" monument is located near thc
western end of a ridge overlooking the South Shore of Fishers Island and on the highest point between
Chocomount and Mount Prospect and lies South 45 degrees 17 minutes 26 seconds East of North
Dumpling Light in Fishers Island Sound); and
RUNNING THENCE North 38 degrees 32 minutes 15 seconds West, 254, 15 feet to a monument
and then continuing on said course 51.38 feet more or less to the shores of Fishers Island Sound;
THENCE with the meanders of said Sound, North 71 degrees 28 minutes 20 seconds East, 196.65
feet to a stake;
THENCE South 29 degrees 08 minutes 00 seconds East, 37.94 feet more or less to a monument and
thence running on the same course 205.90 feet to a monument set on the northerly line or side of sai d
4,0 foot road;
THENCE along the northerly side of said road, South 57 degrees 16 minutes 20 seconds West 11 fee t
to a stake marking point of curve to the left whose radius is 725.77 feet and the direction of whose
radius at that point is South 32 degrees 43 minutes 40 seconds East; and
THENCE southwesterly still along the northerly side of said road (and following the arc of said
curve) 134.20 feet to the monument set at the point or place of BEGINNING.
PARCEL B
BEGINNING at a stone monument set 0'11 the Northwesterly side of a road 40 feet wide, said
monument being 329.96 feet North of a point which, is 2914.97 feet West of another monument
marking the U.S. Coast and Geodetic Survey Triangulation Station "NIN", which "NIN" monument
is located near the western end of a ridge overlooking the South Shore of Fishers Island and on the
highest point between Chocomount and Mount Prospect and lies South 45 degrees 17 minutes 26
seconds East of North Dumpling Light in fishers Island Sound, said poim of begillning being on a
curve to the left whose radius at that point is 725.77 feet .and the direction of whose radius at that
point is South 43 degrees 19 minutes 20 seconds East;
RUNNING THENCE Southwesterly along the Northwesterly line of said road and following the arc
of said curve a distance of 210.73 feet to a stake;
THENCE North 45 degrees 04 minutes 30 seconds West 289.60 feet to a stake on the shore of
Fishers Island Sound;
THENCE North 28 degrees 41 minutes 30 seconds East, 58.45 feet to a stake;
THENCE North 34 degrees 06 minutes 20 seconds West, 110.18 feet to a stake;
THENCE North 77 degrees 35 minutes 45 seconds East, 195.10 feet to a stake, these las t three lines
following the meanders of said shore line;
THENCE South 38 degrees 32 minutes 15 seconds East, 286.64 feet to the monument at the point
or place of BEGINNING.

Said Parcels. A and B being contig.uous and forming a single lot. Said parcels also being described as
lots 7 and 8 III Block 39 on a certalllmap of Fishers Island Development Corporation filed in the Office
of the Suffolk County Clerk on 9/25/01 as Map No. A-421. Said undivided fractional interest in and
to P~cels A and B having been acquired by the Grantors herein by deed, dated 12/16/98 from Volney
F. Righter, which deed was recorded in the Office of the Suffolk County Clerk on 1/25/99 in Libel'
11941 at page 252.
