BARGAIN and SALE DEED
with Covenant Aqainst Grantor's Acts
THIS INDENTURE, made the ~ day of February, 2001, BETWEEN
REV. ZENON A. SMILGA and GLORIA PYTLIK, jointly, both
residing at No# Winthrop Drive, P.O. Box 425, Fishers Island, New
York 06390, party of the first part, and
REV. ZENON A. SMILGA and GLORIA PYTLIK, as tenants in
common, both residing at No# Winthrop Drive, P.O. Box 425,
Fishers Island, New York 06390, party of the second part,

WITNESSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and
release unto himself/herself, the party of the second part, the
heirs or successors and assigns of the party of the second part
forever, all of the right, title and interest held by said party
of the first part in the following described real property, it
being the intention of the party of the first part to sever said
joint tenancy as to the interest hereby conveyed, pursuant to the
provisions of sec. 240-c of the Real Property Law:
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, if any, situate,
lying and being at Fishers Island, Town of Southold, County of
Suffolk, State of New York, bounded and described as follows:
BEGINNING at a point on the northwesterly line of Winthrop
Drive, said point being South 62 degrees 21 minutes 00 seconds
West, 236.40 feet from the southwesterly line of Equestrian
Avenue, said point also being 692.29 feet North of a point which
is 4723.95 feet West of a monument marking the United states
Coast and Geodetic Survey Triangulation Station 'PROS" and;
running thence North 27 degrees 39 minutes 00 seconds West along
land now or formerly of Thomas Jr. and Carolyn J. Doherty, 201.50
feet to land now or formerly of John C. Evans; thence South 62
degrees 26 minutes OO~seconds West along the last mentioned land,
110.83 feet to land now or formerly of William J. and Patricia J.
Faulkner; thence South 27 degrees 39 minutes 00 seconds East
along the last mentioned land, 201.60 feet to the northwesterly
side of Winthrop Drive; thence North 62 degrees 21 minutes 00
seconds East along the northwesterly side of Winthrop Drive,
110.83 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the
parties of the first part by deed dated June 30, 1998 and
recorded July 14, 1998 in Liber 11904 Cp 575 in the Office of the
Suffolk County Clerk, and previously conveyed to William R. Haase
and.Mary Alice Haase, his wife, by deed dated May 18, 1983 and
recorded May 26, 1983 in Liber 9364 Cp 134 in the Office of the
Suffolk County Clerk.
The aforesaid premises are not in an agricultural district and
are entirely owned by the transferors herein.
