WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Fishers Island, Town of Southold, County of Suffolk and State of
New York, the same being a portion of Lot No.5, Section 7 on "Map of Lots on Fishers
Island, made by C.B. Jennings, City Surveyor of New London, Conn.," filed September 28,
1878 as Map No. 339, bounded and described as follows:
See Schedule "A" description attached hereto.
Being and intended to be the same premises as conveyed to the party of the first part by
deed dated June 6, 1988 and recorded in the Westchester County Clerk's Office, Division
of I and Re.cards on/.June 30, 1988 in Liber 10635 page 532 and by deed dated 6/21/73
ana recorded on 6125/73 in Liber 7425 page 411.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any
streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with
the appurtenances and all the estate and rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, situate, lying and being at Fishers Island, Town of Southoid,
County of Suffolk and State of New York, the same being a portion of Lot No.5, Section 7 on "Map of Lots on
Fishers Island, made by CB. Jennings, City Surveyor of New London, Conn.," filed September 28, 1878 as
Map No. 339, said part of lot being more particularly bounded and described as follows:
8EGINNING at an iron pin with tap set on the westerJy line of the herein described premises and the easterly
line of land now or formerly of Elsa H. Rivers and which is distant 1444.35 feet north of a point which is
181.03 feet east of a monument marking the United States Coast and Geodetic Survey Triangulation Station
"PROS"; and
RUNNING THENCE North 40 degrees 23 minutes 00 seconds East along said land now or formerly of Elsa H.
Rivers, 119.00 feet, more or less, to the shore of Great Harbor;
THENCE in an easterly direction aiong said shore of Great Harbor, a tie distance of 75.00 feet, more or less, to
land now or formeriy of JNC Holdings LLC;
THENCE South 44 degrees 23 minutes 31 seconds West along said land now or formerly of JNC Holdings LLC,
140.00 feet, more or less, to an iron pin and cap set;
THENCE South 30 degrees 40 minutes 52 seconds East still along said land, 67.53 feet to an iron pipe and
land now or formerly of Robert E. Brooks;
THENCE North 83 degrees 29 minutes 30 seconds West along said land, 66.11 feet to land now or formerly of
