, THIS INDENTURE, made the
day of October two thousand
BETWEEN BARBARA J. McBRIDE and ROBERT A. DOYEN, both residing at 7 Devitt Road,
Old I_yme, Connecticut 06371, as tenants-in-common without right of survivorship,
party of the first part, and FREDERIC BANCROFT and suzAN/lte BANCROFT, his wife, both
residing at 741 Guard Hill Road, Bedford, New York 10506,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being on Fishers Island, Town of Southold, County of Suffolk and State of New
York, being bounded and described as follows:
BEGINNING at a point on the northerly line or side of the road known as The Gloaming, said point
being 1229.05 feet North of a point which is 118.37 feet East of a monument marking the U.S.
Coast and Geodetic Survey Triangulation Station "PROS"; and RUNNING THENCE from the point of
beginning the following six (6) courses and distances along lands now or formerly of Nazzarino,
Olivieri and Hedge: 1) North 21 022' West, 128.4 feet; 2) North 620 06' West, 45.2 feet; 3) South
22045' West, 31.08 feet; 4) North 71 0 14' West, 31.6 feet to a monument; 5) South 320 36'
West, 60.4 feet to another monument; 6) South 800 25' West, 49.83 feet to another monument;
RUNNING THENCE the following two (2) courses and distances along lands now or formerly of West
End L.and Company, Inc. and Roberts: 1) North 110 36' East, 60.87 feet to a drill hole in a rock; 2)
North 240 11' 15" East, 117.58 feet; RUNNING THENCE the following two (2) courses and
distances along lands now or formerly of William P. and Rose Pauline Arasimowicz; 1) South 650 48'
1-4' . "-East, 141 .86 feet; 2)~ bltl, 240 1 2' East, 58.17 feet to the southwesterly line of a proposed road;
and RUNNING THENCE along said southwesterly line or side of said proposed road the following two
(2) courses and distances: 1) South 21044' East, 52.51 feet; 2) South 70 14' 40" West, 177.43
feet to the point or place of BEGINNING.
TOGETHER with a right of way 15 feet in width for use as a roadway extending southwesterly across
land of William P. and Rose Pauline Arasimowicz, the northwesterly line of said right of way being
described as follows: BEGINNING at a point which is 1481.62 feet North of a point which is 55.98
feet East of said "PROS" monument; and RUNNING THENCE South 240 12' West, 53.46 feet;
TOGETHER with a right of way over said proposed road extending northerly and westerly from The
Gloaming to the northerly end of the above described right of way.
Being and intended to be the same premises as conveyed to the party of the first part by deed dated
October 17, 1978 and recorded in the Suffolk County Clerk's Office, Division of Land Records on
November 2, 1978 in Liber 8526 page 161.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any
streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with
the appurtenances and all the estate and rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
