7 THIS INDENTURE, made the 9.5 day of February, nineteen hundred and ninety-nine
BETWEEN

party of the first part, and
MICHAEL J. HENCHY and BARBARA HENCHY, husband and wife, both residing at 119

S CST WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and beim at Southold, in
the Town of Southold, County of Suffolk and State of New York, bounded and described as
follows:-
L/JQ BEGINNING at a monument on the northerly line of a 50 foot private road known as Calves
"t Neck Road ("Youngs Road West"); said point of beginning being the southeasterly comer of
land now or formerly of Hendrickson then from said point of beginning running along said
land of Hendrickson, North 46 degrees 25 minutes 20 seconds West a distance of 200.0 feet to
a monument and land now or formerly of Pbters;
THENCE along said land now or formerly of Peters, North 50 degrees 22 minutes East a
distance of 189.10 feet to a monument on the westerly line of a 50 foot private road known as
Calves Neck Road ("Youngs Road East");
THENCE along said westerly line of Calves Neck Road ("Youngs Road East"), South 45
degrees 04 minutes 30 seconds East a distance of 158.99 feet;
THENCE on a curve to the right having a radius
dius of 29.45 feet, a distance of 35.89 feet;

THENCE along said northerly line of Calves Neck Road ("Youngs Road West"), the
following three (3) courses and distances: (1) South 24 degrees 45 minutes West a distance of
68.40 feet; (2) South 53 degrees 00 minutes West a distance of 79.02 feet; (3) South 83
degrees 00 minutes West a distance of 27.70 feet to the point of BEGINNING.
TOGETHER WITH the right to use a right of way (in common with others) over a 50 foot
private road known as "Youngs Road East" and over a 50 foot private road known as
"Youngs Road West" from the southerly end of Youngs Avenue about 2700 feet to the
southwesterly corner of the premises.
TOGETHER WITH a right of way (in common with others) over a 50 foot private road known
as "Harper Road" from the southwesterly corner of the premises northeasterly about 500 feet
to said 50 foot private road known as "Youngs Road East."
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Arthur L.R. Francisco and Helen T. Francisco dated 12/27/90 and recorded in the
Suffolk County Clerk's Office on 1/9/91 in Liber 11202 cp 500.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid. W
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
