the second part,
WITNESSETI 1, that the party of the first part, in consideration of Ten Dollars and other good and
valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land,with the buildings and improvements thereon erected,
situate, lying and being on Fishers Island in the Town of Southold, County of Suffolk and State of
New York, designated as District 1000, Section 007.00, Block 06.00, Lot 008.000 and located at
Prival:e Road off East End Road,as more particularly bounded and described in Exhibit"A"attached
hereto and made a part hereof.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenane,:s and all the estate and rights of the party of the first part in and to said premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whoreby said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose. The word "party" shall be construed
as if it read "panics" whatever the sense of this indenture so requires.
The conveyance in this Deed is subject to all of the provisions of a certain Credit Line
Mortgagc(Wilh Fu�ure Advance Clause) granted by Margarette J. Owen, married and R. David
Owen, her spouse (,he "Mortgagor") in favor of Bank One, NA (the `Bank") dated September 18,
1997 and recorded on March 6 , 199 8i Liber of Mortgages No. 19308 ,page 47 in the
Off ice of the County Clerk of Suffolk County,New York(the"Mortgage"), and the Grantee,by its
acceptance of this Deed mid the ownership of the real estate described in this Deed,hereby assumes
and agrees to pay ,i 1 of the obligations in favor of the Bank that are secured by the Mortgage.

All that certain plot,piece or parcel of land,with the buildings thereon erected,situate,lying
and l,cing at Fishers Island, in the Town of Southold, County of Suffolk and State of New York,
being bounded and described as follows:
BEC INNING at a stone monument set on the northerly side of a road 40 feet wide, said
monument hero, 309.54 feet North of a point which is 938.59 feet East of another monument
marking the U.S. Coast and Geodetic Survey Triangulation Station "NIN" (which said "NIN"
monument is located near the western end of a ridge overlooking the south shore of Fishers Island
and on the highest point between Chocomount and Mount Prospect and lies South 45 degrees 17
minutes 26 seconds East of North Dumpling Light in Fishers Island Sound) and
RUNNING THENCE Along the northerly side of said road, South 71 degrees 13 minutes
20 seconds ;Vest,243.22 feet to a stake marking a point of curve to the right,whose radius is 501.82
feet and the direction of whose radius at that point is North 18 degrees 46 minutes 40 seconds West;
THENCE Westerly still along the northerly side of said road (and following the are of said
curve) 144.62 feetio a stake;
THENCE Not thwestwardly(following the arc of a curve to the right whose radius is 17 feet
and the direction of-whose radius at that point is North 02 degrees 15 minutes 54 seconds West),
31.20 feet to a stake;
THENCE North 31 degrees 19 minutes 30 seconds East, 42.64 feet to a stake;
THENCE North 35 degrees 14 minutes 00 seconds East, 132.14 feet to a stake;
