party of the first part, and
THE JAMES M. DURYEA QUALIFIED PERSONAL RESIDENCE
TRUST DATED APRIL 20, 1999, Melinda F. Duryea,
Megan Duryea Scott, and Oakley VP. Duryea,
TRUSTEES, having an address at No# Mansion House
Drive, Fishers Island, New York 06390,
party of the second part,
WITNESSETH, that the party of the first part, in
consideration of ONE and 00/100 DOLLAR ($1 . 00) and other valuable
consideration, paid by the party of the second part, does hereby
grant and release unto the party of the second part, its
successors, assigns and beneficiaries forever,

Atl that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being at Fishers Island, Town of Southold, County of Suffolk and
State of New York, and more specifically bounded and described as
follows :
BEGINNING at a stone monument on the westerly line of the
Mansion House Drive, said monument being 3910. 07 feet north
, of a point which is 1927 .70 feet west of another, monument
marking the U.S.C. and G. S. "PROS";
RUNNING thence South 7 degrees 15 minutes 30 seconds West
-85.77 feet abutting easterly on said Mansion House Drive;
THENCE North 80 degrees 32 minutes 10 seconds West, 88. 0 feet
on a line parallel to and 16 feet northeasterly from the
northeasterly line of land of H. Lee Ferguson Jr. ;
THENCE North 2 degrees 27 minutes 45 seconds East, 166.8
feet;
THENCE North 84 degrees 44 minutes East, 53.4 feet to the
southwesterly line of Mansion House Drive, these last three .
lines abutting southwesterly, westerly and northwesterly on
remaining land now or formerly of Fishers Island Farms, Inc.
THENCE South 20 degrees 15 minutes 30 seconds East, 107.7':
feet to beginning, abutting northeasterly.,on_ said Mansion
House Drive, containing 0.36 acres more or less .
The above described tract is conveyed subject to an existing
right of way 10 feet in width for a wager line, the center
line of which is described as follows :
Suffolk County Clerk; and being the same premises conveyed to
William M. Duryea and Mary A. Duryea, his wife, by Deed of
Helen K. Stueber dated November 4 , 1960 and recorded November
25, 1960 in Liber 4911 at Page 597 in the Office of the
Suffolk County Clerk; and being the same premises conveyed by
Correction Deed of Fishers Island Farms, Inc. to Helen K.
Stueber dated November 1 , 1960 and recorded November 25, 1960
in Liber 4912 at Page 1 in the Office of the Suffolk County
Clerk.
The aforesaid premises are not in an agricultural district and
are entirely owned by the transferor herein.
TOGETHER with all right, title and interest, if any, of the
party of the first part in and to any streets and roads abutting
the above described premises to the center line thereof,
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, and unto the survivor of them, and unto
such survivor' s heirs and assigns forever, to them and their own
proper use and behoof.
11 AND the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold
the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the
improvement and will apply the same first: to the payment of 'the
cost of the improvement before using any part of the total of
same for any other purpose.
AND the party of the first part covenants as follows:
First - That said party of the first part is seized of the said
premises in fee simple, and has good right to convey
the same;
Second - That the party of the second part shall quietly enjoy
the said premises;
Third - That the said premises are free from encumbrances,
except as aforesaid;
Fourth - That the party of the first part will execute and
procure any further necessary assurance of the title to
said premises; and
BEGINNING on the westerly line of Mansion House Drive, said
point being South 7 degrees 15 minutes 30 seconds West, 67.25
feet from a stone monument which is 3910.07 feet north of a
point which is 1927.70 feet west of another monument marking
U.S.C. S C. S. Triangulation Station "PROS";
THENCE running South 03 degrees 30 minutes 40 seconds West,
69 feet more or less to the southerly line of the above
described tract;
Subject also to another existing right of wav 10 feet in
width for telephone and electric ser the center line of
said right of way being described as follows:

BEGINNING at a point on the westerly line of Mansion House j
Drive, said point being South 7 degrees 15 minutes 30 seconds
West, 31.77 feet from the above mentioned stone monument;
THENCE North 86 degrees 20 minutes West, 76.87 feet;
THENCE North 47 degrees 46 minutes 30 seconds West, 20 feet
more or less to the westerly line of the above described
tract;
Subject further to any and all easements or rights of way of
record granted to Hay Harbor Realty Co. , Inc. or retained by
Fishers Island Farms Inc. for ^lectric light line, water
mains, telephone lines or sewage disposal mains, and for the
maintenance of the same whereby they shall treck across the
above described premises.
Subject further to a right of way or easement to be retained
by Fishers Island Farms Inc. , its successors or assigns to
continue the use and maintenance of any sewer line, waste
water line, telephone or electric lighc lire, which may treck
upon or across above described precr.issq. Above premises arc-
conveyed subject to the following cc, -_.ianta and restrictions
which shall run with the land:
(1) Said premises shall not be used for other than
residential purposes;
(2) No building shall be erected on the above described
premises other than a one-family dwelling house and
accompanying garage.
(3) Helen K. Stueber her hairs, distributees and assigns
shall have the rightto us>_ the present sewage disposal
system serving the above described premises so long as said
sewage disposal system exits on the condition that she
shares equally with others using said sewage disposal system,
all costs and expense of maintenance and repa,.r and clear-:,,,
of said sewage disposal system.
BEING AND INTENDED TO FE THE SAME PREMISES devised to
the Grantor in Paragraph Fourth of the Last Will and
Testament of William M. Duryea, in Probate Index No. 272308
for the County of Nassau and State of New York, with
Certificate of Letters Testamentary No. 300746 duly issued on
September 24,1991 to James M. Duryea and Wi))iam M. Duryea,
Jr. , Executors, a copy of which Last Wi-l. and Testament is
