REFEREE' S DEED
THIS INDENTURE, made this 1st day of August, 1997, between
KATHY GAIL BERGMANN, ESQ. , Referee, having an office at 381 Montauk
Highway, Remsenburg, New York, duly appointed in the action
hereinafter mentioned, grantor, and GEORGE T. HAWES, residing at
475 W. Merrick Road, Val-Ley Stream, New York, grantee .
WITNESSETH, that the grantor, the Referee appointed in an
action instituted in the Supreme Court of the State of New York,
County of Suffolk, between HOME FEDERAL SAVINGS BANK, plaintiff,
and WILLARD S . MAHOOD and MILLICENT R. MAHOOD, defendants, under
Index: No. 96-27901, foreclosing a mortgage, to wit, Willard S .
Mahood and Millicent R. Mahood to Home Federal Savings Bank,
recorded on the 5th day of April, 1994, in the Office of the Clerk
of the County of Suffolk in Liber 18798 , at page 482 , in pursuance
of a judgment entered at a special term of the Supreme Court of the
State of New York, County of Suffolk on the 11th day of April ,
1997, and in consideration of the sum of SIXTY SEVEN THOUSAND FIVE
HUNDRED ($67, 500 . 00) AND 00/100 DOLLARS paid by grantee, being the
highest bid at the sale cinder said judgment, does hereby grant and
convey unto the grantee, all the right, title and interest which
the said WILLARD S . MAHOOD and MILLICENT R. MAHOOD, the mortgagors
aforesaid, had at the time of the execution and recording of said
mortgage, it being their- interest in said premises which was so
sold and is hereby conveyed, together with all the right, title and
interest of the parties to the aforesaid action, of in and to:
ALL that certain plot, piece or parcel of land, situate, lying, and
being at Fishers Island, Town of Southold, County of Suffolk, and
State of New York, being bounded and described as follows :
BEGINNING at a monument on the northwesterly line of Fox Avenue,
said monument being located 4, 779 . 78 feet north of a point which is
2 , 647 . 04 feet west of a monument marking the United States Coast
and Geodetic Survey Triangulation Station "PROS" ; and
RUNNING THENCE North 67 degrees 51 minutes 10 seconds East, 28 . 74
feet along said avenue line to the southwesterly line of Crescent
Avenue;
THENCE along said avenue line North 16 degrees 47 minutes 00
seconds West, 317 .22 feet and North 44 degrees 39 minutes 00
seconds West, 262 . 72 feet;
