ninety seven
BETWEEN NANCY WILKS SMITH, individually and as Executrix of the
ESTATE OF THEODORE H. SMITH, III and BRISCOE R. SMITH, 100 Park
Avenue, New York, New York 10017
parties of the first part, and
FRANK A. BONSAL, JR. & HELEN B. BONSAL, New Enterprise Associates,
1119 St. Paul Street, Baltimore, Maryland 21202
parties of the second part,
WITNESSETH, that the party of the first part, in consideration of
ten dollars and other valuable consideration paid by the party of
the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereupon erected, situate, lying and being at
Fishers Island, Town of Southold, County of Suffolk, State of New
York, known and designated as Lot 1 on a certain plan entitled
"PRELIMINARY SUBDIVISION PLAN MADE FOR BRISCOE SMITH ET. AL.
EQUESTRIAN AVENUE FISHERS ISLAND, NEW YORK" , surveyed by Chandler,
Palmer & King, Norwich, Connecticut, and filed in the office of the
Town Clerk of the Town of Southold, County of Suffolk on September
6, 1985, as is more particularly described in Schedule A, attached.
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with
the appurtenances and all the estate and rights of the party of the
first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the
first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any
other purpose.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this
deed the day and year first above written.

ALL that certain plot, piece or parcel of land situate, lying and
being at Fishers Island in the Town of Southold, County of Suffolk
and State of New York, being bounded and described as follows:
BEGINNING at a point being located North 1481. 07 feet and West
3812. . 95 feet from a monument marking the U. S. Coast and Geodetic
Survey Triangulation Station "pros" , said point being the westerly
line of land now or formerly of Frank A. Bonsal Jr. and Helen B.
Bonsal;
RUNNING THENCE from said point of beginning along said lands South
66 degrees 00 minutes 00 seconds West, 123 . 00 feet;
RUNNING THENCE, South 12 degrees 41 minutes 55 seconds East 56. 52
feet to lands now or formerly of Barbara Kane Javelera;
RUNNING THENCE along said lands the following two (2) courses and
distances :
1. South 75 degrees 09 minutes 45 seconds West, 34 . 00 feet;
2 . South 89 degrees 42 minutes 15 seconds West, 106. 00 feet more
or less to the existing easterly shore line of Little Hay
Harbor;
RUNNING THENCE in a generally northerly, northeasterly and easterly
direction along said existing easterly shore line of Little Hay
Harbor 400 feet more or less to a point and land now or formerly of
Helen F. Vanoosten;
RUNNING THENCE along said lands the following four (4) courses and
distances:
1 . South 35 degrees 48 minutes 00 seconds East, 25. 00 feet;
2 . South 60 degrees 45 minutes 00 seconds East, 120. 5 feet;
3 . South 77 degrees 02 minutes 20 seconds East, 118 . 11 feet;

point or place of BEGINNING.
