WITNESSETH, that the party of the first part, in consideration of Tell Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party, of the second part forever, a one—half undivided interest in the
following property, being all of the interest in such property of the party of*

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" $ball be construed as if it read "parties" whenever the sense of this indenture so requires.

Town of Southold, Suffolk County, State of New
York, being a part of that portion of Fishers Island
formerly belonging to Fishers Island Corporation (which
portion is sometimes called the "Park") lying easterly of
the following line, viz :
BEGINNING at the southeasterly corner of land
owned by the United States, known as the Fort H. G. Wright
Military Reservation, Mount Prospect Tract, on the shore of
Block Island Sound or the Atlantic Ocean (as said Tract was
constituted prior to the extension thereof by the
acquisition of additional lands in condemnation proceedings
instituted in 1942) and running thence northerly following
the East boundary of the said tract of land of the United
States (as same was constituted prior to such extension
thereof) to the southerly line of East End Road (sometimes
called Oriental Avenue) and which point is the northeasterly
corner of said tract of land of the United States (as same
was constituted prior to such extension thereof) , thence
crossing the East End Road and following the same course as
the last to the shore of West Harbor or Fishers Island
Sound;
Said lots or parcels of land being bounded and
described as follows :
Parcel I
BEGINNING at a merestone on the Northerly side of
a road forty feet wide, said merestone being five thousand
five hundred sixty-four and eighty-seven hundredths feet
North of a point which is one thousand two hundred fourteen
and seventeen hundredths feet East of a monument marking the
U . S . Coast and Geodetic Survey Triangulation Station "Nin"
(which said "Nin" monument is located near the Western end
of a ridge overlooking the South shore of Fishers Island and
on the highest point between Chocomount and Mount Prospect
and lies South forty-five degrees seventeen minutes and
twenty-six seconds East of North Dumpling Light in Fishers
Island Sound) and from said merestone running
Southwestwardly along the Northerly side of said road on a
course of South fifty-nine degrees forty-five minutes and
twenty seconds West a distance of one hundred ten and
twenty-six hundredths feet to the actual point of beginning
of the herein described tract, said actual beginning point
marking a point of curve to the right whose radius is
thirty-three and fifty hundredths feet and the direction of
whose radius at that point is North thirty degrees fourteen
minutes and forty-seconds West; thence from said actual
beginning point Westwardly, following the arc of said curve,
forty-five and forty-five hundredths feet to a stake marking
a point of curve to the right whose radius to two hundred
eighty feet and the direction of whose radius at that point
is North forty-seven degrees twenty-nine minutes and thirty
seconds East; thence Northwestwardly, following the arc of
said curve, one hundred thirty-three and forty-one
hundredths feet to a stake; thence North one degree twenty-
nine minutes and thirty seconds West one hundred forty-two
and sixty-three hundredths feet to the shore of Fishers
Island Sound; thence with the meanders of said Sound, South
forty-nine degrees thirty minutes and thirty seconds West
sixty feet and North eighty-three degrees and thirty-eight
minutes West seventy-seven and eighty-one hundredths feet;
thence South five degrees and no minutes West forty-feet to

stake; thence South seventy-two degrees and forty-five
minutes East twenty-five feet to a stake marking a point of
curve to the right whose radius is thirty and eighty-two
hundreds feet and the direction of whose radius at that
point is South seventeen degrees and fifteen minutes West;
thence Southeastwardly, following the arc of said curve,
thirty-one and six hundredths feet to a stake; thence South
fifteen degrees and no minutes East one hundred fifteen feet i
to a stake marking a point of curve to the right whose
radius is twenty-seven feet and the direction of whose
radius at that point is South seventy-five degrees West;
thence Southwardly, following the arc of said curve, fifty-
three and sixty-nine hundredths feet to a stake set on the
Northerly side of said road, marking a point of curve to the
left, whose radius is two hundred thirty-nine and twelve
hundredths feet and the direction of whose radius at that
point is North eight degrees fifty-six minutes and twenty
seconds East; thence in a general Eastwardly direction,
along the Northerly side of said road and following the arc
of said curve, one hundred sixty-three and fifty hundredths
feet to the actual point of beginning; containing fifty-
seven hundredths of an acre, more or less .
BEING the same premises conveyed by David S .
Henkel and Helen S . Henkel, his wife, to the party of the
first part by deed dated May 17, 1983 and recorded in the
Office of the Clerk of the County of Suffolk on May 26, 1983
to Liber 9364 of Deeds page 411 .
Parcel II
BEGINNING at a stone monument set on the Northerly
side of a road forty feet wide, said monument being six
hundred and eight and forty-seven hundredths feet East of a
point which is fifty-four hundred and ninety-nine and
thirty-seven hundredths feet North of another monument
marking the U. S . Coast and Geodetic Survey Triangulation
Station "Nin" (which said "Nin" monument is located near the

left whose radius is forty-eight and thirty-seven hundredths
feet and the direction of whose radius at that point is

party of the first part in and to all land which may lie
between the respective meander lines above described and the
actual high water mark of Fishers Island Sound, and in and
to the shores and beaches of Fishers Island Sound, and in
and to the land under the waters in said Sound adjoining
said premises .
TOGETHER with all right, title and interest, if
any, of the party of the first part of, in and to any
streets and roads abutting the above described premises to
the center lines thereof .
TOGETHER with all easements, rights-of-way and
rights, privileges and appurtenances whatsoever granted to
the party of the first part by and under deed made by David
S . Henkel and Helen S . Henkel, his Wife, to the party of the
first part, dated May 17 , 1983, and recorded in said County
Clerk' s Office on May 26, 1983 in Liber 9364 of Deeds at
page 411 .
