BARGAIN AND SALEDEED
THIS INDENTURE, made as of February 20, 1997, between
FRANK: T. GILLAN and CYNTHIA S . GILLAN ( "Grantor" ) , having an
address at no number Peter' s Way, Fishers Island, New York 06390
and MARC K. BANKS and ANN K. BANKS, HIS WIFE ( "Grantee" ) , having
an address at no number Oriental Avenue, Fishers Island, New York
06390 .
That Grantor, in consideration of ten dollars ($10 . 00)
lawful money of the United States and other good and valuable
consideration paid by Grantee, does hereby grant, bargain, sell,
assicln and release unto Grantee, its heirs or successors and
assiclns forever, that dwelling unit (the "Unit" ) above the plane
defined by the top of the concrete foundation located on that
certain plot, piece or parcel of land situate, lying and being in
the town of Southold, County of Suffolk, State of New York,
described as :
Lot 11 according to the major subdivision
plan prepared for Walsh Park Benevolent
Corporation and filed in the Office of the
Clerk of the County of Suffolk, State of New
York, as Map No. 8871, on December 22 , 1989
( "Filed Map No. 8871" ) , as more particularly
described on S_^hedule A annexed hereto,
SUBJECT TO all restrictions, covenants and conditions
set forth in the Ground :Lease Agreement (the "Lease" ) , dated as
of December 17, 1990 (the "Lease" ) , between Walsh Park Benevolent
Corporation, as lessor, and Grantor, as lessee, a Memorandum of
Lease with respect to the Lease having been recorded in the
Office of the Clerk of the County of Suffolk, State of New York,
in Liber 11243 at Page 276 , on April 5 , 1991, and amended
pursuant to Amendment to Ground Lease Agreement, dated as of
March. 26, 1991, copies of which have been delivered to the
Grantee, the receipt of which is hereby acknowledged; all such
restrictions, covenants and easements set forth in the Lease to
apply to and bind Grantee, its heirs, successors and assigns; and
SUBJECT TO the Declaration of Covenants and
Restrictions recorded in the Office of the Clerk of the County of
Suffolk, State of New York, in Liber 10969 at Page 329 on
November 20, 1989 (the "Declaration" ) ; and
TOGETHER with t=he appurtenances and all the estate and
rights of Grantor in and to said Unit;
