WITNESSETH, that the party of the first part, witheul consideration paid by the patly of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL those certain plots, pieces or parcels of land, with the buildings and improvements thereon erected, situate,
lying and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more
particularly bounded end described as Pamel t, Parcel 2 and Parcel 3 as set forth on Schedule A hereto.
BEING AND INTENDED TO BE in the case of Parcel 1 as so described on Schedule A hereto, the same
premises described as Parcel I in the deed to the patty of the first part, daled October 7, 1998 and recorded in
the Off'~e of the Suffolk County Clerk on October 23, 1998 in Liber ~1924 page 694; in the casa of Parcel 2 as
so described on Schedule A hereto, the same premises described as Parcel II in the aforesaid deed; and ir~ the
case of Parcel 3 as sc described, the same premises described as Parcel V in the aforesaid deed.
TOGETHER wllh all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above des~il~ed premises to the cenler lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the r~st part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that Ih e party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for Ihe purpose of paying the cost of Ihs improvement and will apply the same first
to Ihs payment ot' the cast of the improvement before using any part of Ihs total of the same for any other
purpose. The word "party" shall be conslrued as if it read "parties" whenever the sense of this indenture se
