THIS INDENTURE, made as of the 6th day of May, 2011

ARTHUR STRAUSS and BETSY FRANK STRAUSS, Trustees of the Strauss Living Trust
dated May 6, 2011, residing at 765 Westview Drive, Mattituck, New York 11952, party of the
second part,
WITNESSETH, lhat the party of the first part, in consideration of Ten and 001100-($10.O~3}--clollars, and other good
and valuable consideration paid by the party of the second part, does hereby granl and release unto the party of the
second pall, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, situate, lying and being at Mattltuck, In the Town of
Southold, County of Suffolk and State of New York, mom particularly bounded and described as
follows:
BEGINNING at a point on the southerly side of Westview Drive distanl 675.12 feet southerly,
southwesterly and westerly as measured along the easterly, southeasterly and southerly sides of
Westview Drive from the southerly end of the curve which connects the easterly side of Westview
Drive with the southerly side of Brewery Road;
RUNNING THENCE from said point of beginning South 12 degrees 47 minutes 20 seconds East
a distance of 393.68 feet to Mattituck Creek;
RUNNING THENCE westerly along said ordinary high water mark of Mattituck Creek along a tie
coarse of South 66 degrees 04 minutes 00 seconds West 154.36 feet to land now or formerly of
Albrecht;
RUNNING THENCE North 05 degrees 38 minutes 30 seconds West along the last mentioned
land a distance of 418.72 feet to the southerly side of Westview Drive;
RUNNING THENCE Easterly along the southerly side of Westview Drive the following two
courses and distances:
1. Along the arc of a curve bearing to the left having a radius of 150.00 feet a distance of 21.30
feet;
2. North 71 degrees 42 minutes 40 seconds East a distance of 78.44 feet to the point or place of
BEGINNING.
BEGINNING AND INTENDED TO BE the same premises conveyed Io the party of the first part by
deed dated August 10, 2006 and recorded in the office of the Clerk of the County of Suffolk on August 23,
2006 in Liber 12465 at Page 994.
TOGETHER with all right, title and interest, ~f any, of the parly of the first part in and to any streets and roads abulting
the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to sale premises; TO HAVE AND TO HOLO the premises heroin granted
unto the pa~ty of lhe second part, the helm or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compfiance wilh Section 13 of the Lien Law, covenants thal the par~y of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideralion as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply Ihe same first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party"
shall be construed as if it read "parties" when ever the sense of this ir~dentura so requires.
