party of the first part,and DAVID C. BURNHAM, II and ANNE H. BURNHAM, husband and wife,
(no N) Whistler Avenue, P.O. Box 335, Fishers Island, New York 06390,
party of the second part,
WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of the second part,does hereby grant and release unto the party of the second part,the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,With the buildings and improvements thereon erected,situate,lying and
beingin4he at Fishers Island, Town of Southold, County of Suffolk and State of
New York, being more particularly bounded and described as set forth on Schedule A
hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
/ (under her name Betty M. Spohn) by deed, dated March 22, 1974 and recorded in the
Office of the Clerk of the County of Suffolk on April 29, 1974 in Liber 7627
page 575.
Tax Ma By accepting this deed, the party of the second part covenants and agrees for
Designation themselves and their successors and assigns that no structures shall be erected
on the above described premises until the earliest to occur of: (a) the death of
the father of the party of the first part, Elbert W. Burr, (b) the date the
Dist. premises situate northwest of Lots 22, 24 and 25 on Map No. 223 (filed March 11,
].913) known as Lots 1, 2 and 3 on such Map No. 223 are no longer owned by the
sec. said Elbert W. Burr, or (c) October 15, 2007.

TOGETHER with all right,title and interest, if any,of the party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines thereof, TOGETHER with the appurtenances and all the
estate and rights of the party of the fust part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the fust part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same fust to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read"parties"whenever the sense of this indenture so requires.

as shown on "Pian of Peninsulaat Fishers Island, owned by Charles W. Hedge and
Frances G. Thorp, made by Chandler & Palmer, Engineers, Norwich, Conn. 1913"
and filed in the Office of the Clerk of the County of Suffolk on March 11, 1913, file
No. 223.

BEGINNING at a point on the northerly side of a Right of Way at the southeasterly
side of corner of land now or formerly of Elbert W. Burr;
RUNNING THENCE North 24 degrees 07 minutes 55 seconds East, along land now or
formerly of Elbert W. Burr, 1.50.00 feet;
THENCE South 65 degrees 52 minutes 05 seconds East, 150.00 feet;
THENCE South 24 degrees 07 minutes 55 seconds West, 150.00 feet to the Right of
Way 1st above mentioned;
THENCE North 65 degrees 52 minutes 05 seconds West, along the northerly side of
Right of Way, 150.00 feet to the point or place of BEGINNING.
