AND the party of the first pan, in compliance with Section 13 of thc Lien Law, covenants that the
party of the first part will receive the ce~ideration for this conveyanc~ and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parti~" whenever thc sense of this indenture so
requires.
THIS CONFIRMATORY DEED IS BEING DELIVERED AND RECORDED: (1) TO
CONFIRM THE TERMINATION OF THE LIFE TENANCY OF MARTHA C. HUSING,
WHO DIED ON MARCH 19, 1997 (SUFFOLK COUNTY SURROGATE'S PROBATE FILE
#11}66P1997); (2) TO CONFIRM THE DESCRIPTION OF THE SUBJECT PREMISES ON
SCHEDULE A AFTER DELETING THE REFERENCE TO THE LIFE TENANCY; AND
(3) TO CAUSE THE MERGER OF THE TWO TAX LOTS INTO ONE TAX LOT.
